NEW SOUTH WALES HEAVY VEHICLE STANDARDS (CLASS 1 SPV) EXEMPTION NOTICE 2016 (NO.1)
- Purpose
The purpose of this notice is to exempt particular special purpose vehicles (SPVs) that operate under the New South Wales Class 1 SPV Notice from certain heavy vehicle standards requirements.
2. Authorising Provision
This notice is made under section 61 of the Heavy Vehicle National Law (HVNL) as in force in New South Wales.
3. Commencement
This notice commences on 26 August 2016.
4. Expiry
This notice expires on 6 February 2019, or if the New South Wales Class 1 SPV Notice is repealed earlier, the date that notice is repealed.
5. Definitions
(1) Unless otherwise stated, words and expressions used in this notice have the same meanings as those defined in the HVNL.
(2) In this notice—
New South Wales Class 1 SPV Notice means the notice titled Class 1 Special Purpose Vehicle Notice 2014, issued by New South Wales Roads and Maritime Services and published in the New South Wales Government Gazette No 15 of 7 February 2014, at pages 387 to 425.

This notice may be cited as the New South Wales Heavy Vehicle Standards (Class 1 SPV) Exemption Notice 2016 (No. 1).
7. Application
(1) This notice applies in New South Wales.
(2) This notice applies to a heavy vehicle that is permitted to operate under the New South Wales Class 1 SPV Notice.
Note- Clause 7(2) above distinguishes the vehicle standards exemptions in this Notice from those provided under the National Class 1 Special Purpose Vehicle Notice 2016, which was published on 6 May 2016. For vehicles that operate under the National Class 1 SPV notice, the necessary heavy vehicle standards exemptions are provided by that notice.
8. Exemption from Prescribed Vehicle Standards
Where an SPV is exempt from complying with a dimension requirement by Part 4 of the New South Wales Class 1 SPV Notice, that SPV is also exempt from compliance with Schedule 2 s34(1) of the Heavy Vehicle (Vehicle Standards) National Regulation in relation to that dimension requirement.
9. Conditions
An SPV exempted from compliance with certain heavy vehicle standards requirements under section 8 of this Notice must comply with all other requirements of the New South Wales Class 1 SPV Notice.
