NEW SOUTH WALES CONSOLIDATED NATIONAL HEAVY VEHICLE MASS AND DIMENSION EXEMPTION (NOTICE) 2014 (No. 1)
Purpose
- The purpose of this Notice is to exempt the stated categories of class 3 heavy vehicles from the prescribed mass and dimension requirements specified in the notice, subject to the conditions specified in this notice.

2. This notice is made under section 69(1) of the Heavy Vehicle (General) National Regulation.

SCHEDULE 1
NEW SOUTH WALES CLASS 3 HEAVY VEHICLE COTTON MODULE CHAIN BED SEMITRAILER COMBINATION DIMENSION EXEMPTION (NOTICE) 2014 (No. 1)
Purpose
- The purpose of this Notice is to exempt cotton module chain bed semitrailer combinations from the height and rear overhang limits in Schedule 6 of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation (the Regulation).
Note – This instrument is an exemption from heavy vehicle height and rear overhang limits for combinations consisting of a prime mover and a semitrailer with a chain bed specifically built for carrying cotton modules. This instrument does NOT exempt these vehicles from other requirements of the Heavy Vehicle National Law including, but not limited to, mass and other dimension requirements.

Definitions
6. Unless otherwise stated, words and expressions used in this Notice have the same meanings as those defined in the HVNL.
7. In this Notice—
‘Cotton module chain bed semitrailer combination’ means a combination consisting of a prime mover and a semitrailer with a chain-bed specifically constructed to transport cotton modules.
Application
8. This Notice applies to cotton module chain bed semitrailer combinations.
9. This Notice applies in New South Wales.
Exemption from prescribed dimension requirement
10. This Notice exempts a cotton module chain bed semitrailer combination from—
(a) The rear overhang limit for a combination that includes a semitrailer in section 5(1)(a) of Schedule 6 of the Regulation; and
(b) The height limit for a heavy vehicle in section 8(d) of the Regulation.
Conditions
11. The loaded height of the combination may not exceed 4.6m.
12. The rear overhang of the combination may not exceed 4.2m.
13. The semitrailer must be loaded in a manner that ensures—
(a) The risk to other road users are minimised; and
(b) The loading does not adversely affect the combination’s stability; and
(c) The restraining of the load complies with the Load Restraint Guide.
14. The combination may use any road in the local government areas list in Appendix 1 to this Notice.
15. The combination may only transport cotton modules on the safest direct route from the farm of origin to the cotton gin nominated by the producer of the cotton.
16. The combination may only transport cotton modules if the suitability of the proposed route has been assessed, and the combination does not strike or damage any overhead structures, including cables.
17. Where the height of a loaded combination is likely to interfere with overhead structures including cables, approval to travel the route must be sought from the relevant authority.
18. A copy of this Notice, and if applicable, a copy of the approval issued by the relevant authority pursuant to clause 17 must be carried in the driving compartment of the prime mover and must be produced to an authorised officer if requested to do so.
Note - Nothing in this notice exempts the driver or operator of the vehicle from complying with legislation regulating the use of heavy vehicles, including but not limited to—
- compliance with mass and other dimension requirements in the HVNL;
- compliance with traffic signs, including those indicating mass limits or dimension limits;
- compliance with vehicle standards in the HVNL; and
- compliance with lawful directions of authorised officers.
Declaration
I, Richard Hancock, delegate of the National Heavy Vehicle Regulator declare that a cotton module chain bed semitrailer combination is exempt from the requirements of subsections 5(1)(a) and 8(d) of Schedule 6 of the Regulation, provided the combination complies with the conditions in this Notice.

NEW SOUTH WALES CLASS 3 HEAVY VEHICLE CONVERTER DOLLY COMBINATION EXEMPTION NOTICE 2014 (No. 1)
Purpose
- The purpose of this notice is to exempt Class 3 heavy vehicles towing an unladen converter dolly from the mass limit in Schedule 1, Part 1, Clause2 (1)(a)(iv), and the dimension limit in Schedule 6, Part 2, Clauses 3 (1) (a) of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation (the Regulation).
Authorising Provision
2. This Notice is made under section 117 of the Heavy Vehicle National Law as in force in each participating jurisdiction (HVNL).
Title
3. This Notice may be cited as the New South Wales Class 3 Heavy Vehicle Converter Dolly Combination Exemption Notice 2014 (No. 1).
Commencement
4. This Notice commences on 10 February 2014.
Expiry
5. This Notice expires on 9 February 2019.

6. Unless otherwise stated, words and expressions used in this notice have the same meanings as those defined in the HVNL.
7. In this Notice “converter dolly combination” means—
a) a combination consisting of a prime mover, semitrailer and converter dolly; or
b) a combination consisting of a B-double towing a converter dolly.
Application
8. This Notice applies to—
a) a combination comprising of a prime mover and semi-trailer not exceeding 19 metres in length, towing an unladen converter dolly; and
b) a combination comprising of a B-Double towing an unladen converter dolly.
9. This Notice applies in New South Wales.
Exemption from prescribed mass requirement
10. A converter dolly combination is exempt from the mass requirement set out in section 2(1)(a)(iv) of part 1 Schedule 1 to the Regulation.
Mass requirements - conditions
11. Subject to clause 13, the total mass of a converter dolly combination comprising of a prime mover and semi-trailer towing an unladen converter dolly, must not exceed 45.5 tonnes.
12. Subject to clause 13, the total mass of a converter dolly combination comprising of a B-Double towing an unladen converter dolly, must not exceed 65.5 tonnes.
13. The total mass of a converter dolly combination may exceed the limit specified in clauses 11 and 12 by—
a) 0.5t if the prime mover of the converter dolly combination is eligible for the steer axle mass exception;
b) 1.0t if converter dolly combination comprising of a prime mover and semi-trailer towing an unladen converter dolly, is eligible for the concessional mass limits;
c) 2.0t if converter dolly combination comprising of a B-Double towing an unladen converter dolly, is eligible for the concessional mass limits;
Exemption from prescribed dimension requirement
14. A converter dolly combination is exempt from the dimension requirement set out in section 3(1)(a) of Part 2 of Schedule 6 to the Regulation.
Length of combination - condition
15. A converter dolly combination comprising of a prime mover and semi-trailer towing an unladen converter dolly, must not exceed 25 metres in length.
16. A converter dolly combination comprising of a B-Double towing an unladen converter dolly, must not exceed 36.5 metres in length.
Additional conditions
17. A converter dolly that forms part of a converter dolly combination must not carry a load.
Areas or routes
18. A converter dolly combination comprising of a prime mover and semi-trailer towing an unladen converter dolly, may use routes and areas approved for use by B-Doubles up to 25 metres in length, as stipulated in the National Class 2 Heavy Vehicle B-Double Authorisation (Notice) 2014 (No.1).
19. A converter dolly combination comprising a B-Double towing an unladen converter dolly, may use routes and areas approved for use by roads trains not exceeding 36.5 metres in length, as stipulated in the National Class 2 Heavy Vehicle Road Train Authorisation (Notice) 2014 (No.1).
Declaration
20. I, Richard Hancock, delegate of the National Heavy Vehicle Regulator declare that Class 3 heavy vehicles towing an unladen converter dolly are exempt from the mass and dimension limits stated in the Regulation, provided the vehicle complies with the conditions in this notice.

Schedule 3
NEW SOUTH WALES CLASS 3 HEAVY VEHICLE LIVESTOCK TRI-AXLE GROUP MASS LIMIT EXEMPTION (NOTICE) 2014 (No. 1)
Purpose
- The purpose of this notice is to exempt the stated categories of Class 3 heavy vehicles transporting livestock from the mass limit for a tri-axle group with single tyres with section widths of at least 375mm, or dual tyres, in Table 1 (Axle mass limits table) of Part 2 of Schedule 1 of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation (the National Regulation) and to specify the conditions of the exemption under this notice.
Note— This notice replaces the NSW Class 3 Livestock Load (Tri-Axle Group Floating Mass Concession) Notice 2011.

2. This Notice is issued under section 117 of the Heavy Vehicle National Law (HVNL) as in force in each participating jurisdiction.

3. This notice may be cited as the New South Wales Class 3 Livestock Tri-axle Group Mass Limit Exemption (Notice) 2014 (No. 1).

4. This notice commences on 10 February 2014.

Definitions
6. Unless otherwise stated, words and expressions used in this Notice have the same meaning as the HVNL.
7. In this notice, ‘road train’ means a prime mover with a tandem drive axle group, two semi-trailers with tri-axle groups and a converter dolly with a tandem axle or tri-axle group, where the total length of the road train does not exceed 36.5 metres in length.
Application
8. This Notice applies to the following categories of heavy vehicle when carrying live cattle, sheep, pigs or goats and operating in compliance with the general mass limits set out in Schedule 1 of the National Regulation, or a Class 2 heavy vehicle authorisation (notice)—
(a) a prime mover with a tandem drive axle group and a semi-trailer with a tri-axle group, with single tyres with section widths of at least 375mm, or dual tyres, or a combination of those tyres, fitted on all axle groups, and a maximum length available for the carriage of animals not exceeding 12.5m;
(b) a B-double which consists of a prime mover with a tandem drive axle group and two semi-trailers with tri-axle groups, with single tyres with section widths of at least 375mm, or dual tyres, or a combination of those tyres, fitted on all axle groups, and a deck length available for the carriage of animals not exceeding 18.8m;
(c) a B-triple which consists of a prime mover with a tandem drive axle group and three semi-trailers with tri-axle groups, with single tyres with section widths of at least 375mm, or dual tyres, or a combination of those tyres, fitted on all axle groups, and a combined deck length available for the carriage of animals not exceeding 28.2m;
(d) a road train which consists of a prime mover with a tandem drive axle group, two semi-trailers with tri-axle groups and a converter dolly with a tandem axle or tri-axle group, with single tyres with section widths of at least 375mm, dual tyres, or a combination of those tyres fitted on all axle groups, and a deck length available for the carriage of animals not exceeding 25.0m.
Conditions
9. The mass on a tri-axle group of a semi-trailer must not exceed 21.0t.
10. In the case of a road train, the mass on the tri-axle group of a converter dolly must not exceed—
(a) where the tri-axle group is fitted with certified road friendly suspension - 21.0 t;
(b) where the tri-axle group is not fitted with certified road friendly suspension - 17.0 t.
11. The loaded mass of a heavy vehicle must not exceed the applicable mass limit for the heavy vehicle under the general mass limits specified in Schedule 1 of the National Regulation or any lower mass limit for the heavy vehicle specified in a class 2 heavy vehicle authorisation (notice).
12. A heavy vehicle to which this Notice applies may operate on all roads in New South Wales that are approved under the HVNL for the operation of that heavy vehicle, except where prohibited by a load limit specified for a road, bridge or causeway by a sign or notice.
13. A copy of this Notice must be carried in the driving compartment of a heavy vehicle operating under this Notice, and must be produced in response to a request by an authorised officer.
Declaration and exemption
I, Richard Hancock, delegate of the National Heavy Vehicle Regulator hereby exempt a heavy vehicle to which this Notice applies from the general mass limits for a tri-axle group fitted with single tyres with section widths of at least 375mm, or dual tyres, or a combination of those tyres, as specified in Table 1 of Schedule 1 to the Heavy Vehicle (Mass Dimension and Loading) National Regulation, provided the heavy vehicle complies with the conditions set out in this Notice.

NEW SOUTH WALES CLASS 3 HEAVY VEHICLE REAR OVERHANG LIMIT DIMENSION EXEMPTION (NOTICE) 2014 (No. 1)
Purpose
- The purpose of this notice is to exempt stated class 3 heavy vehicles from the rear overhang length limits set out in section 5 of Schedule 6 of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation and to specify the conditions of the exemption under this notice.
Note— This Notice replaces the NSW Rear Overhang Limit Notice 2013.
Authorising Provision
2. This notice is issued in accordance with section 117 of the Heavy Vehicle National Law (HVNL) as in force in each participating jurisdiction.

3. This notice may be cited as the New South Wales Class 3 Heavy Vehicle Rear Overhang Limit Dimension Exemption (Notice) 2014 (No.1).

Definitions
6. Unless otherwise stated, words and expressions used in this notice have the same meaning as in the Heavy Vehicle National Law.
Application
7. This notice applies to a truck or trailer that exceeds 9.5m in length, excluding any load, and that has a forklift truck attached to the rear of the truck or trailer for the sole purpose of loading and unloading goods on and off the truck or trailer.
8. This notice applies in New South Wales.
Conditions
9. The rear overhang of the truck or trailer (including the forklift truck) must not exceed 4.0m.
10. Any forklift truck attached to the rear of a truck or trailer may project more than 1.2 metres to the rear of the truck or trailer if there is—
(a) During the daytime – a brightly coloured red, red and yellow or yellow flag at least 300 mm by 300 mm is fixed to the extreme back of the load; or
(b) At night – a light showing a clear red light to the back, visible at a distance of at least 200 m, is fixed to the extreme back of the load.
11. A number plate must be clearly visible from the rear of the truck or trailer at all times—
(a) If the number plate on the rear of the truck or trailer is obscured by the fork lift truck, and the fork lift truck is conditionally registered, the number plate of the fork lift truck must be clearly visible from the rear of the vehicle.
(b) If the number plate on the rear of the truck or trailer is obscured by the fork lift truck and the fork lift truck is not conditionally registered, the number plate of the truck or trailer must be relocated so that it is clearly visible from the rear of the vehicle.
Condition – Areas or Routes
12. The truck or trailer may operate on all roads in New South Wales that are approved under the HVNL for the operation of the truck, or for the operation of the combination that includes the trailer, except where prohibited by a load limit specified for a road, bridge or causeway by a sign or notice.
Declaration
I, Richard Hancock, delegate of the National Heavy Vehicle Regulator hereby exempt heavy vehicles specified in this Notice that comply with the conditions set out in this Notice from the rear overhang length limits set out in section 5 of Schedule 6 of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation.
