Scope and Application

The New South Wales Class 2 Safety, Productivity & Environment Construction Transport Authorisation Notice 2021 (No.1) is a legislative instrument that authorises the use of specified categories of class 2 heavy vehicles, which are Performance Based Standards (PBS) vehicles, on the New South Wales SPECT Scheme Network, provided they meet specific conditions. This Notice is applicable to eligible vehicles operating within the state of New South Wales and is designed to work in conjunction with the New South Wales Safety, Productivity & Environment Construction Transport Scheme (SPECT Scheme). A key condition of this Notice is that participating operators must be enrolled in, and comply with, the SPECT Scheme. The Notice authorises the use of eligible vehicles on areas and routes specified in the New South Wales SPECT Scheme Network, subject to compliance with both the PBS vehicle approval and the SPECT Scheme Business Rules, which include operator requirements and conditions maintained and periodically updated by Transport for New South Wales (TfNSW). The New South Wales Class 2 Safety, Productivity & Environment Construction Transport Authorisation Notice 2021 (No.1) (the "Notice") authorises the use of certain categories of class 2 heavy vehicles, which must meet Performance Based Standards (PBS), on the New South Wales SPECT Scheme Network. This authorisation is subject to the vehicle meeting specific conditions outlined in the Notice (section 8). The Notice provides access to the New South Wales SPECT Scheme Network for the transport of specified construction materials, under safety, environmental, and productivity conditions. It is a condition of this Notice that a participating operator must be enrolled in, and comply with, the SPECT Scheme (section 10). An eligible vehicle operating under the Notice must comply with several conditions to ensure it can operate on the network. Additionally, the vehicle must comply with the intelligent access program conditions set out in the Notice (section 11). This includes any condition relating to networks, such as speed or time of travel, and compliance with the eligible vehicle’s PBS vehicle approval or with the SPECT Scheme and its business rules. The vehicle must also be enrolled in and comply with the approved intelligent transport system, Road Infrastructure Management (RIM), approved by Transport Certification Australia. Breaching the conditions of the Notice can result in various consequences. Under section 153 of the Heavy Vehicle National Law (HVNL), a driver of a PBS vehicle must keep a copy of the PBS vehicle approval in their possession. Failure to comply with the Notice’s conditions could result in administrative penalties, fines, or revocation of the vehicle's authorisation to operate on the network. The maximum penalties for breaches of the HVNL can include substantial fines and potential imprisonment, depending on the severity of the breach. These penalties are designed to enforce compliance and ensure the safety and productivity of the transport of construction materials on the New South Wales SPECT Scheme Network.
