This amendment was introduced to correct an error in the contact information for the police, as listed in the New South Wales Class 1 Agricultural Vehicles Notice 2015. This correction was deemed necessary to ensure that operators and relevant stakeholders had access to the most accurate and up-to-date contact details for law enforcement authorities responsible for overseeing agricultural vehicle compliance. The Notice was authorised under Section 117, and Section 23 of Schedule 1, of the Heavy Vehicle National Law and commenced on the date of publication, 23 October 2015. The purpose of the amendment was to ensure the effective enforcement of vehicle regulations by providing correct contact information for police, thereby maintaining the integrity of the regulatory framework.
Scope and Application
The New South Wales Class 1 Agricultural Vehicles Notice Amendment Notice 2015 (No. 1) serves to update the contact details for the relevant police department responsible for handling Class 1 agricultural vehicles within New South Wales. This amendment applies to the entities operating such vehicles, ensuring they have accurate information for regulatory compliance. The amendment is geographically limited to New South Wales and does not extend to other states or territories, maintaining its specific jurisdictional reach within the state. The Notice is effective from the date of publication, immediately correcting the contact information for improved operational efficiency and compliance among agricultural vehicle operators in New South Wales. This amendment is made under the authority of the Heavy Vehicle National Law, specifically Sections 117 and 23 of Schedule 1, and does not introduce any exclusions, exemptions, or thresholds beyond what is stipulated in the primary legislation.
Key Provisions
The New South Wales Class 1 Agricultural Vehicles Notice Amendment Notice 2015 (No. 1) amends APPENDIX 2 of the New South Wales Class 1 Agricultural Vehicles Notice 2015 (No. 1) which was published in the New South Wales Government Gazette on 23 March 2015. The primary operative section of this Notice is section 4(1)(a), which specifies the amendment to be made to the table under clause 3.1 in APPENDIX 2. The amendment involves changing a contact number for the Police from ‘(02) 8882 1219’ to ‘(02) 8882 1436’. This change is intended to ensure that the contact information provided in the Notice is accurate and up-to-date, facilitating easier communication for those needing to contact the Police regarding Class 1 agricultural vehicles.
The obligations and requirements imposed by this Notice are primarily administrative in nature. It requires the New South Wales authorities to update the contact information in the table under clause 3.1 in APPENDIX 2 to reflect the new number, ensuring that the Notice accurately represents the current contact details. This amendment is straightforward and focuses on maintaining the integrity and accuracy of the information provided in the Notice.
Regarding potential consequences, the Notice does not explicitly outline any specific offences, penalties, or civil/criminal consequences for non-compliance with the amendment. However, the importance of accurate information in regulatory notices generally suggests that any failure to update and maintain such information could potentially lead to difficulties in communication and enforcement actions. While the Notice itself does not specify penalties, any broader non-compliance with the Heavy Vehicle National Law, of which this Notice forms a part, could result in legal consequences including fines and other penalties as prescribed by the overarching legislation. The exact penalties would depend on the specific provisions of the Heavy Vehicle National Law and any relevant regulations or subsidiary legislation.
