Overview

The New South Wales Class 1 Agricultural Cotton Vehicle Exemption for Permitted Heavy Vehicles (Notice) 2016 (No. 1) was enacted to provide exemptions from certain mass and dimension requirements of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation for class 1 vehicles transporting agricultural cotton vehicles during specific times and routes in New South Wales. This notice, made under section 117 of the Heavy Vehicle National Law as in force in each participating jurisdiction, aims to facilitate the efficient transportation of agricultural cotton vehicles during the Easter period, thereby addressing logistical challenges faced by the agricultural sector. The notice specifies the routes and hours during which these exemptions apply, allowing for greater flexibility while ensuring compliance with overall regulatory frameworks. The notice was authorised by the National Heavy Vehicle Regulator and it outlines specific conditions under which the exemptions are applicable, including adherence to the Class 1 permit issued under the Heavy Vehicle National Law and other relevant conditions stipulated in the NSW Class 1 Load Carrying Vehicles Notice 2014. This legislative instrument seeks to balance the needs of the agricultural industry with road safety and infrastructure considerations, thereby contributing to the efficient movement of goods and services across the participating jurisdictions.

Scope and Application

This notice pertains to the exemption of class 1 vehicles that are transporting Agricultural Cotton Vehicles from certain mass and dimension requirements as stipulated in the Heavy Vehicle (Mass, Dimension and Loading) National Regulation (the National Regulation). The notice applies specifically to such vehicles when they are travelling on designated routes in New South Wales during daylight hours on Easter Saturday and Easter Sunday. The exemption from prescribed mass and dimension requirements applies to the class 1 vehicles specified in the notice, and the exemption is valid only on the stated routes and during the specified hours. The notice is made under section 117 of the Heavy Vehicle National Law as in force in each participating jurisdiction (HVNL) and it applies to the whole of New South Wales. This notice is effective from the date of its publication in the Commonwealth Gazette and it will remain in force for a period of five years from that date. The notice sets out specific routes and hours during which the exemption applies and it specifies the types of vehicles and conditions to which the exemption applies. The notice also provides for the maximum permissible mass and dimensions for vehicles subject to the exemption, as specified in a Class 1 permit issued under section 122 of the HVNL. The notice may be extended or restricted through subordinate instruments.

Key Provisions

The notice (Clause 13) requires the driver and operator of a class 1 vehicle transporting an Agricultural Cotton Vehicle to comply with several conditions, including the applicable Class 1 permit issued under section 122 of the HVNL, the NSW Class 1 Load Carrying Vehicles Notice 2014, and the notice itself. This means that the vehicle must adhere to specific permit conditions related to the transport of Agricultural Cotton Vehicles, as well as any other conditions specified in the NSW Class 1 Load Carrying Vehicles Notice 2014, except where the notice provides different provisions for the stated routes and period. The notice also imposes the requirement that the maximum permissible mass of the vehicle and its load must be as provided in a Class 1 permit applying to a vehicle transporting an Agricultural Cotton Vehicle issued under section 122 of the HVNL (Clause 14). Similarly, the maximum permissible dimensions of the vehicle must be as specified in the same permit (Clause 15). The obligations and requirements imposed by this notice are primarily aimed at ensuring that the transportation of Agricultural Cotton Vehicles by class 1 vehicles on specified routes and days complies with certain safety and operational standards. The notice exempts these vehicles from certain mass and dimension requirements of the National Regulation (Clauses 11 and 12), but only under the specific conditions outlined in the notice. This includes adherence to the conditions set out in the applicable Class 1 permit and the NSW Class 1 Load Carrying Vehicles Notice 2014, and compliance with the maximum permissible mass and dimensions specified in the permit. The notice does not explicitly state any offences or penalties for breach, but it is reasonable to infer that any breach of the conditions set out in the notice, or the applicable Class 1 permit, or the NSW Class 1 Load Carrying Vehicles Notice 2014 could lead to enforcement action under the HVNL. The HVNL provides for various offences and penalties, including fines and imprisonment, for breaches of its provisions. The specific penalties would depend on the nature and severity of the breach, as well as any other relevant laws and regulations.
