Overview

The Heavy Vehicle National Law (HVNL) was enacted to provide a uniform national framework for the regulation of heavy vehicles. The HVNL was introduced to address the need for a coordinated approach to heavy vehicle regulation across Australia, ensuring safety, efficiency, and consistency in the operation of heavy vehicles. This notice, the New England Highway Diversion Class 2 Heavy Vehicle Authorisation and Class 3 Heavy Vehicle Mass or Dimension Exemption (Notice) 2014 (No. 1), was made under the authority of sections 117 and 138 of the HVNL by Angus Draheim, a delegate of the National Heavy Vehicle Regulator, with the purpose of authorising specific classes of heavy vehicles for use on designated routes during specified hours and exempting certain classes of heavy vehicles from prescribed mass and dimension requirements under the Heavy Vehicle (Mass, Dimension and Loading) National Regulation. This notice was designed to streamline the movement of heavy vehicles and ensure compliance with necessary conditions and exemptions within the specified timeframe, from 29 April 2014 until 1 May 2014.

Scope and Application

The New England Highway Diversion Class 2 Heavy Vehicle Authorisation and Class 3 Heavy Vehicle Mass or Dimension Exemption (Notice) 2014 (No. 1) is an instrument made under sections 117 and 138 of the Heavy Vehicle National Law (HVNL), applicable across the states and territories of Australia. It aims to authorize the use of certain class 2 heavy vehicles on specific routes within New South Wales and exempts certain class 3 heavy vehicles from prescribed mass and dimension requirements of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation. This notice applies to B-double vehicles that are not higher than 4.3m, vehicles or combinations that are higher than 4.3m but not higher than 4.6m, B-double vehicles that are either B-double vehicle carriers or livestock carriers, and vehicle carriers. It applies specifically within the area of Scone 2337, allowing vehicles to use Guernsey Street from the New England Highway to Liverpool Street, and Liverpool Street from Guernsey Street to the New England Highway. The notice is in force from 29 April 2014 until 1 May 2014, and the exemption from mass and dimension requirements applies under the conditions set forth in the primary notices referenced within the document.

Key Provisions

The key provisions of the New England Highway Diversion Class 2 Heavy Vehicle Authorisation and Class 3 Heavy Vehicle Mass or Dimension Exemption (Notice) 2014 (No. 1) primarily revolve around the authorisation of certain types of vehicles and exemptions from specific mass and dimension requirements. Section 10 of the Notice mandates that the driver and operator of a vehicle to which this notice applies must adhere to conditions outlined in a primary notice relevant to the vehicle, and also follow the directions of any authorised traffic controllers or traffic control devices. This is intended to ensure that vehicles are operated in a manner that complies with broader regulatory standards and any specific conditions set by traffic authorities. The obligations imposed by the Notice include ensuring that vehicles are used in compliance with the conditions of the primary notices relevant to them, and that drivers and operators follow traffic control directions. The Notice also requires vehicles to be operated within the specified routes and times, and that they meet the defined categories and characteristics, such as the B-double vehicle carrier or livestock carrier, as outlined in the Notice. In terms of consequences for non-compliance, the Notice does not explicitly state penalties for breaches. However, given the overarching framework of the Heavy Vehicle National Law (HVNL), it is likely that breaches of the Notice could result in civil or criminal penalties. Under the HVNL, unauthorised use of heavy vehicles can lead to penalties such as fines and potential disqualification from driving. Additionally, non-compliance with traffic control devices can also incur fines and other penalties as per the relevant state or territory laws. The Notice’s reliance on the primary notices, which themselves are subject to the HVNL, implies that penalties would align with those prescribed by the broader legislative framework.
