Overview

The Net Zero Economy Authority (Muja D Power Station Geographic Area) Instrument 2026 was enacted to address the need for a specific geographic area to be designated for the purposes of implementing policies under the Net Zero Economy Authority Act 2024. This notifiable instrument was made by David Shankey, the Chief Executive Officer of the Net Zero Economy Authority, and it specifies Bunbury Statistical Area Level 4 as the geographic area relevant to the facilities MUJA_G7 and MUJA_G8. The policy objective of this instrument is to ensure that the geographic area is clearly defined, facilitating the effective implementation of the authority's initiatives aimed at achieving net-zero emissions. The instrument comes into effect on the day after it is registered, following the authority granted under subsection 8(1) of the Net Zero Economy Authority Act 2024.

Scope and Application

The Net Zero Economy Authority (Muja D Power Station Geographic Area) Instrument 2026 applies to the entities and facilities specified within the geographic area defined by Bunbury Statistical Area Level 4. This geographic area encompasses the facilities MUJA_G7 and MUJA_G8, thereby affecting the operations of entities and individuals involved in activities within these boundaries. The instrument is made under the authority of the Net Zero Economy Authority Act 2024, ensuring compliance with national standards and objectives aimed at achieving a net-zero economy. The application of this instrument is limited to the specified geographic area, and it does not extend beyond the defined Statistical Area Level 4 unless otherwise amended through subordinate instruments. Exclusions or exemptions are not explicitly stated in the text provided, but any such provisions would likely be detailed in the parent Act or subsequent amendments.

Key Provisions

The Net Zero Economy Authority (Muja D Power Station Geographic Area) Instrument 2026I sets out the geographic area for the purposes of the Net Zero Economy Authority Act 2024, specifically identifying Bunbury Statistical Area Level 4 as the location for facilities MUJA_G7 and MUJA_G8. This instrument, which is made under subsection 8(1) of the Act, specifies the geographic area in relation to these facilities (section 5). It is important to note that this instrument comes into effect on the day after it is registered (section 2). The obligations and requirements imposed by this instrument pertain primarily to the identification and specification of the geographic area for the mentioned facilities. The Net Zero Economy Authority, through this instrument, establishes Bunbury Statistical Area Level 4 as the area where facilities MUJA_G7 and MUJA_G8 are located, which is critical for compliance with the Act and for the implementation of any subsequent regulations or policies related to these facilities (section 5). The definitions provided in section 4 clarify terms such as "Act," "Statistical Area Level 4," "facility," and "Electricity System and Market Rules," ensuring there is no ambiguity in the interpretation of the instrument. The Act itself does not explicitly state any offences, penalties, or consequences for breach in this particular instrument. However, it is implied that failure to comply with the geographic area specification could lead to legal consequences as per the broader provisions of the Net Zero Economy Authority Act 2024. This could potentially include enforcement actions or penalties as stipulated in other sections of the Act, although the specific penalties are not detailed within this instrument. It is essential for parties governed by this Act to adhere to the specified geographic area to avoid any potential legal repercussions.
