Overview

The Net Zero Economy Authority (Gladstone Power Station Geographic Area) Notifiable Instrument 2026, issued by David Shankey, Chief Executive Officer of the Net Zero Economy Authority, was enacted to address the need for a specific geographic area designation within the framework of the Net Zero Economy Authority Act 2024. This notifiable instrument aims to clarify and specify the geographic area relevant to the Gladstone Power Station's Dispatchable Unit Identifiers under the legislative requirements of the Act. It was introduced to ensure precise demarcation and regulation of the specified area for the purpose of achieving net zero emissions goals. The instrument is made under the authority granted by subsection 8(1) of the Act and commenced on the day after its registration. The policy objective underlying this notifiable instrument is to facilitate the targeted implementation of the net zero economy strategy in the Gladstone Power Station's geographic area, ensuring alignment with the broader objectives of the Net Zero Economy Authority Act 2024.

Scope and Application

The Net Zero Economy Authority (Gladstone Power Station Geographic Area) Notifiable Instrument 2026 applies to the Central Queensland Statistical Area Level 4, specifically in relation to the Dispatchable Unit Identifiers GSTONE1, GSTONE2, GSTONE3, GSTONE4, GSTONE5, and GSTONE6. This instrument operates within the framework established by the Net Zero Economy Authority Act 2024, which was enacted to oversee the transition towards a net-zero emissions economy in Australia. The specified geographic area is defined by the Australian Statistical Geography Standard (ASGS) Edition 3, providing a clear boundary for the application of the Act within the Central Queensland region. The instrument commences on the day following its registration and is made under the authority granted by subsection 8(1) of the Act. While the Act aims to facilitate the transition to a sustainable energy future, it is important to note that the instrument does not specify any exclusions, exemptions, or thresholds, thereby applying uniformly within the designated geographic area.

Key Provisions

The main operative sections of the Net Zero Economy Authority (Gladstone Power Station Geographic Area) Notifiable Instrument 2026 (sections 1-5) establish the name, commencement, authority, definitions, and geographic area specification of the instrument. Specifically, section 1 identifies the instrument as the Net Zero Economy Authority (Gladstone Power Station Geographic Area) Notifiable Instrument 2026. Section 2 states that the instrument will commence on the day after it is registered. Section 3 confirms that the instrument is made under subsection 8(1) of the Net Zero Economy Authority Act 2024. Section 4 provides definitions for terms used in the instrument, including 'Act', 'Statistical Area Level 4', and 'Dispatchable Unit Identifier'. Finally, section 5 specifies Central Queensland Statistical Area 4 as the geographic area in relation to the Dispatchable Unit Identifiers GSTONE1, GSTONE2, GSTONE3, GSTONE4, GSTONE5, GSTONE6. The Act imposes obligations and requirements on the Net Zero Economy Authority to specify the geographic area relevant to the Gladstone Power Station Dispatchable Units. This includes the responsibility of defining the geographic area and the Dispatchable Unit Identifiers involved, as specified in section 5 of the instrument. The definitions provided in section 4 are integral to understanding and implementing the provisions of the instrument effectively. The instrument does not explicitly outline offences, penalties, or consequences for breach within its text. However, any breach of the provisions of the Net Zero Economy Authority Act 2024, under which this instrument is made, could potentially lead to civil or criminal consequences. The specific penalties for such breaches would be detailed within the Act itself, rather than the notifiable instrument. Given the nature of the authority and the focus on geographic specification, non-compliance might lead to regulatory actions or fines as prescribed by the overarching Act.
