Overview

The Net Zero Economy Authority (Collie Power Station Geographic Area) Instrument 2026I was introduced to address the need for a specific geographic area to be designated in relation to the Collie Power Station, as required under the Net Zero Economy Authority Act 2024. This notifiable instrument, created by David Shankey, the Chief Executive Officer of the Net Zero Economy Authority, aims to specify Bunbury Statistical Area Level 4 as the relevant geographic area for the Collie Power Station facility. The instrument was made under subsection 8(1) of the aforementioned Act and will commence on the day after its registration. This initiative is a crucial step towards achieving the overarching policy objective of the Net Zero Economy Authority Act 2024, which is to facilitate the transition towards a net-zero economy by ensuring that the Collie Power Station is appropriately integrated within the designated geographic area.

Scope and Application

The Net Zero Economy Authority (Collie Power Station Geographic Area) Instrument 2026 applies to entities involved in the electricity industry within the specified geographic area, namely Bunbury Statistical Area Level 4, as defined under the Australian Statistical Geography Standard (ASGS) Edition 3. This includes facilities governed by the Electricity System and Market Rules under the Electricity Industry Act 2004 (WA). The instrument is made under subsection 8(1) of the Net Zero Economy Authority Act 2024 and comes into effect on the day after its registration. It is intended to facilitate the transition to a net-zero economy by specifically addressing the Collie Power Station (COLLIE_G1) within the designated area. The instrument may be extended or restricted through subordinate instruments, which would provide further details on the specific requirements and obligations for entities operating in this geographic area.

Key Provisions

The main operative sections of the Net Zero Economy Authority (Collie Power Station Geographic Area) Instrument 2026 specify the geographic area for the Collie Power Station, which is Bunbury Statistical Area Level 4 (section 5). These obligations are crucial for maintaining clarity and compliance within the regulatory framework. Failure to comply with the provisions of the Net Zero Economy Authority (Collie Power Station Geographic Area) Instrument 2026 could result in significant legal consequences. While the specific offences and penalties are not detailed in the provided text, breaches of similar legislative instruments typically incur fines or other penalties as stipulated in the primary Act or related legislation.
