Overview

The Statutory Rules 1973 No. 31, made under the Naval Defence Act 1910-1971, introduce amendments to the Navy (Canteens) Regulations. Enacted by the Governor-General, acting on the advice of the Federal Executive Council, these regulations are intended to modify the constitution of the board overseeing the management of canteens within the naval forces. The primary aim of these amendments is to streamline the leadership structure by designating the Chief of Naval Personnel as the sole member and chairman of the board, thus simplifying decision-making processes and enhancing operational efficiency within naval canteens. These changes reflect a policy objective to ensure that administrative roles are clearly defined and effectively managed within the naval framework.

Scope and Application

The Statutory Rules 1973 No. 31, made under the Naval Defence Act 1910-1971, pertains to the regulation of Navy (Canteens) and involves amendments to the existing Navy (Canteens) Regulations. These regulations primarily apply to the governance and management of canteens within the Royal Australian Navy, affecting both personnel and entities directly involved in the operation of these canteens. The scope of the legislation extends to the appointment and duties of the Board members, including the Chief of Naval Personnel, who is designated as the Chairman of the Board. The regulations have a national reach, applying to all canteens within the jurisdiction of the Commonwealth of Australia. While the text does not explicitly state any exclusions or thresholds, the application of the Act is inherently limited to the canteens operated under the authority of the Royal Australian Navy. The authority to make these regulations stems from the overarching Naval Defence Act, with the power to extend or restrict the application of these regulations potentially provided through subordinate instruments.

Key Provisions

The main operative sections of the Statutory Rules 1973 No. 31 concern amendments to the Navy (Canteens) Regulations under the Naval Defence Act 1910-1971. Regulation 7, in particular, is amended to redefine the composition and leadership of the Board responsible for overseeing canteens within naval establishments (Reg. 7). Specifically, the Chief of Naval Personnel is now the sole member of the Board, and also serves as its Chairman (Reg. 7(1)(a) and (2)). This change effectively streamlines the Board’s structure, placing all decision-making authority in the hands of the Chief of Naval Personnel. The amendments impose several obligations and requirements on the parties governed by these regulations. Firstly, the Chief of Naval Personnel, as the only member and Chairman of the Board, must now ensure compliance with all canteen regulations and manage the operations of naval canteens (Reg. 7). This includes overseeing financial transactions, inventory management, and ensuring that canteen services meet the needs of naval personnel and their families. Additionally, the Chief of Naval Personnel is responsible for reporting to higher authorities on the performance and management of canteens, thereby maintaining transparency and accountability within the naval canteen system. While the Statutory Rules 1973 No. 31 do not explicitly detail offences, penalties, or civil/criminal consequences for breaches of the amended regulations, any non-compliance with the Naval Defence Act 1910-1971 could potentially result in legal action. Under the broader scope of the Naval Defence Act, breaches could lead to disciplinary action against naval personnel, fines, or other penalties as prescribed by law. The severity of these consequences would depend on the nature and extent of the breach, but the Act provides a legal framework within which such actions can be taken to maintain order and discipline within the naval forces.
