Overview
The Statutory Rules 1970 No. 24, issued under the Naval Defence Act 1910-1968, were enacted to amend the Navy (Canteens) Regulations, thereby addressing the need to update certain administrative roles and responsibilities within the Royal Australian Navy. The problem this legislation sought to resolve was the outdated structure of the Navy Central Canteens Committee, which required modernising to reflect changes in the Navy's administrative framework. The enacting body responsible for these regulations is the Governor-General in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council. The policy objective is to ensure that the management and administration of Navy canteens are aligned with contemporary organisational structures and roles within the Navy. These regulations specifically modify the composition of the Royal Australian Navy Central Canteens Committee by replacing outdated titles with current positions, thereby improving the efficiency and effectiveness of the canteen services provided to Navy personnel.
Scope and Application
The Naval Defence Act 1910-1968, through the Regulations issued under it, applies to the operations and administration of canteens within the Royal Australian Navy. These regulations pertain specifically to the personnel and entities involved in the management and oversight of naval canteens, ensuring that the services provided are efficient and aligned with the Navy's standards. The scope of the Act encompasses the geographic and jurisdictional reach of the Commonwealth of Australia, with particular focus on the Royal Australian Navy's operations both domestically and internationally. The Act does not explicitly outline exclusions or exemptions but implies that its provisions apply universally within the scope of naval canteens unless otherwise specified through subordinate instruments. These subordinate instruments may further extend or restrict the application of the Act by detailing specific operational guidelines or procedural amendments, thereby ensuring that the canteens function in accordance with the overarching objectives of the Naval Defence Act 1910-1968.
Key Provisions
The key operative sections of these regulations pertain to the amendment of the Navy (Canteens) Regulations under the Naval Defence Act 1910-1968. Regulation 7, concerning the constitution of the board, now requires the inclusion of the Director of Personal Services (Administration) (Reg. 1(1)), while Regulation 14 modifies the composition of the Royal Australian Navy Central Canteens Committee by replacing the reference to the Director of Personal Services with the Director-General of Personal Services (Reg. 2). These amendments ensure that the governing bodies of the Navy canteens are updated to reflect current administrative roles and responsibilities within the Royal Australian Navy.
These regulations impose specific obligations on the parties involved. The Director of Personal Services (Administration) is now required to be part of the board constituted under Regulation 7 (Reg. 1(1)), implying that this individual must fulfil any duties and responsibilities associated with this role. Similarly, the Director-General of Personal Services must be a member of the Royal Australian Navy Central Canteens Committee, as per the amendment in Regulation 14 (Reg. 2). These changes necessitate that these officials participate in the governance and oversight of Navy canteens, ensuring that administrative and logistical matters are managed effectively.
There are no specific offences, penalties, or consequences outlined within these regulations for non-compliance with the amendments. The regulations do not mention any civil or criminal penalties for failure to adhere to the new roles and responsibilities established. However, non-compliance with the Naval Defence Act 1910-1968 or related regulations could potentially lead to broader legal consequences under the principal Act, depending on the nature and severity of the breach. It is essential for the involved parties to ensure that they meet their obligations as specified in these regulations to avoid any potential repercussions.
