REGULATIONS UNDER THE NAVIGATION ACT 1912*
I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Navigation Act 1912.

AMENDMENTS OF THE NAVIGATION (RADIO) REGULATIONS†
Interpretation
1. Regulation 4 of the Navigation (Radio) Regulations is amended—
(a) by inserting before the definition of “ radio surveyor ” in sub-regulation (1) the following definition:
“ ‘ prescribed officer ’ means a person holding, or for the time being performing the duties of, an office in the Department of Transport that is specified for the purposes of this definition by the Minister by instrument in writing;”; and
(b) by omitting from sub-regulation (1) the definition of “ Regional Controller ”.
Exemptions
2. Regulation 5 of the Navigation (Radio) Regulations is amended—
(a) by omitting from sub-regulation (3) “ Regional Controller ” (wherever occurring) and substituting “ prescribed officer ”, and
(b) by omitting from sub-regulation (4) “ Regional Controller ” and substituting “ prescribed officer ”.

Savings
3. Nothing in these Regulations affects the validity or efficacy of an exemption, or of a condition to which the exemption is subject, under the Navigation (Radio) Regulations as in force before the commencement of these Regulations, and, for the purposes of the application to such an exemption, or to such a condition, of the Navigation (Radio) Regulations as amended by these Regulations, a reference to “ Regional Controller ” in the exemption or condition shall be read as a reference to “ prescribed officer ” as defined by those Regulations as so amended.
