Overview

The Statutory Rules of 1946, No. 5, constitute Regulations under the Navigation Act 1912-1942, enacted by the Governor-General in Council to address specific issues related to maritime navigation and seamanship training. These regulations were designed to refine the existing framework by modifying the fines for misconduct and updating the apprentice indenture form for the sea service, aiming to enhance the safety and professionalism of maritime operations. The policy objective behind these amendments is to ensure that maritime practices adhere to safety standards and that apprentices receive proper training, thereby promoting efficiency and safety within the maritime industry. The Regulations, made under the authority of the Commonwealth Parliament, provide a structured approach to managing misconduct on board vessels and formalising apprenticeship agreements. By amending the Navigation (Master and Seamen) Regulations, the legislation aims to clarify and strengthen the disciplinary measures for misconduct, while also updating the formal apprenticeship agreements to better reflect the responsibilities and protections for both apprentices and their masters. These amendments are essential to maintaining high standards in maritime training and operations.

Scope and Application

The Navigation Act 1912-1942, as amended by Statutory Rules 1946 No. 5, governs maritime conduct in Australian waters, affecting masters, seamen, and apprentices within the sea service. These Regulations specifically amend the Navigation (Master and Seamen) Regulations by revising the fines for misconduct and the form of the apprenticeship indenture. The regulations apply to all persons involved in maritime activities within Australian jurisdiction, including ships registered under the Act. The geographic reach of these regulations is nationwide, covering all Commonwealth waters and maritime activities conducted within them. Exclusions or exemptions are not explicitly stated in the legislative instrument, but it is understood that the regulations apply broadly to all maritime personnel unless otherwise specified by higher law. The Act's application can be further extended or restricted through subordinate instruments, allowing for more detailed and specific regulations to be implemented as needed.

Key Provisions

The key operative sections of the Statutory Rules 1946, No. 5, which amends the Navigation (Master and Seamen) Regulations, primarily concern fines for misconduct and the modification of apprenticeship indentures (sections 1 and 2). Specifically, section 1 removes a specific fine for exposing lights between sunset and sunrise, as well as the penalty for failing to comply with lawful commands regarding the screening of lights on board. Section 2 replaces an existing form with a new form for the Indenture of Apprenticeship to the Sea Service, detailing the terms and conditions of apprenticeship agreements between masters, apprentices, and sureties. The amended regulations impose several obligations and requirements on the parties involved. Masters must ensure they provide the apprentice with necessary training in navigation and seamanship, as well as sufficient provisions including food, lodging, and medical assistance. They must also pay the apprentice a specified sum, minus any deductions for provided apparel. Apprentices are required to faithfully serve their masters, adhere to lawful commands, and avoid misconduct that could lead to the termination of their indenture. If a surety is involved, they must also bind themselves to the terms of the indenture, providing a financial guarantee for the apprentice's performance. The legislation also outlines potential consequences for breach of the indenture agreements. The master has the right to cancel the indenture if the apprentice is convicted of an offence punishable by imprisonment, commits gross misconduct, or is deemed unfit for service due to illness or injury. Additionally, the master can cancel the indenture if the apprentice is not considered suitable or promising as a future ship's officer. These provisions allow for a flexible approach to managing apprenticeship agreements while ensuring that both parties adhere to their contractual obligations.
