Overview

The Navigation (Master and Seamen) Regulations, introduced as Statutory Rules in 1951, were enacted to amend the existing regulations concerning the engagement and discharge of seamen, the handling of wages, and the issuance of certificates of discharge. These regulations were made under the authority of the Navigation Act 1912-1950 by the Commonwealth Parliament. The primary objective of these amendments was to update the references from the Board of Trade and the British Board of Trade to the Ministry of Transport and the Ministry of Transport of the United Kingdom, respectively, reflecting the changing governmental structures and responsibilities. Additionally, the amendments sought to refine the processes around wage settlements and the finalisation of seamen's accounts, ensuring clarity and efficiency in administrative practices.

Scope and Application

The Navigation (Master and Seamen) Regulations, which are a legislative instrument made under the Navigation Act 1912-1950, apply to the master, officers, and crew of vessels navigating under Australian jurisdiction. The Regulations govern various aspects of maritime employment, including the issuance of certificates of discharge, final settlement of wages, and the use of official forms for recording maritime transactions. The geographic reach of these Regulations extends to all vessels navigating under Australian jurisdiction, as per the provisions of the Navigation Act. The Regulations also detail charges for the use of prescribed forms and services rendered by officials in connection with the engagement or discharge of seamen, specifying different rates for various scenarios such as ordinary working hours, overtime, weekends, and holidays. Certain exclusions and thresholds apply, particularly in relation to the charges for official services and the use of forms. The Regulations may be extended or restricted through subordinate instruments as necessary to adapt to changing maritime practices and requirements.

Key Provisions

The key operative sections of the Navigation (Master and Seamen) Regulations involve amendments to various regulations concerning the final settlement of wages, certificates of discharge, charges for forms, and overtime charges. Regulation 10 (1) is amended to replace references to the "Board of Trade" with the "Ministry of Transport", affecting the certification of discharge for seamen. Regulation 14 (1) changes the final settlement of wages to include Saturdays, Sundays, and holidays, thereby broadening the scope of when wages must be settled. Regulation 19 (b) updates references from "British Board of Trade" to "Ministry of Transport of the United Kingdom", affecting the handling of wages for seamen left behind. Regulation 25a (a) and (b) similarly updates references from "Board of Trade" to "Ministry of Transport", influencing precautions regarding the use of oil fuel. Regulation 28 (2) changes references from "British Board of Trade" to "Ministry of Transport of the United Kingdom", impacting the forms required under the Regulations. These amendments impose certain obligations on parties governed by the Act. Ship owners and masters must ensure that final settlements of wages are made on any Saturday, Sunday, or holiday, as per Regulation 14 (1). They must also update their procedures to reflect the changes in references from "Board of Trade" to "Ministry of Transport" and "Ministry of Transport of the United Kingdom" in various sections. Furthermore, they must comply with the new charges for forms and overtime services as outlined in Regulations 29 and 30 respectively. Breaches of these regulations may lead to various penalties and consequences. While the specific offences and penalties are not detailed in the provided text, it is clear that non-compliance with the stipulated charges and timelines for wage settlement could result in legal repercussions. For example, failure to settle wages on specified days might be considered a breach, potentially leading to fines or other civil penalties. Similarly, not adhering to the updated charges for forms and overtime services could result in financial penalties as outlined in Regulation 30. The exact nature and severity of these penalties would depend on the specific circumstances of the breach and the applicable laws in force at the time.
