Overview

The Statutory Rules 1922 No. 39, which were enacted under the Navigation Act 1912-1920, were introduced to amend the existing Navigation (Marine Council) Regulations. These regulations were made by the Governor-General in Council, in accordance with the powers granted under the Navigation Act, with the objective of regulating the fees and allowances for members of the Marine Council and Committees of Advice. The aim was to ensure that members who were appointed to represent various interests could be adequately compensated for their time and travel expenses, thereby facilitating their participation in the council's activities. This legislative instrument sought to provide clarity and consistency in the remuneration and allowances for Marine Council members, replacing previous provisions and establishing a clear framework for the payment of fees and allowances. This adjustment was designed to support the effective functioning of the Marine Council and its committees, ensuring that members could fulfil their roles without undue financial burden.

Scope and Application

The Regulations under the Navigation Act 1912-1920, specifically amending the Navigation (Marine Council) Regulations, establish the remuneration and allowances for members of the Marine Council and Committees of Advice. These regulations apply to members of the Marine Council and Committees of Advice who are appointed by the Minister to represent interests affected by maritime matters. The scope of the Act encompasses the payment of fees and allowances to these appointed members, ensuring they receive compensation for their time and travel expenses when participating in council meetings. The Act applies across the Commonwealth of Australia, as it is enacted under federal authority, and there are no specified exclusions or exemptions within the text. The remuneration is intended to compensate for their duties, including daily fees and travel allowances, thereby facilitating their active participation in maritime governance.

Key Provisions

The statutory rules primarily focus on the amendment of the Navigation (Marine Council) Regulations, specifically altering Regulation 9 (paragraph 1). This amendment pertains to the fees and allowances for members of the Marine Council and Committees of Advice. Under the new regulation, the Chairman of the Marine Council is entitled to a fee of two guineas per day when sitting, while other members are entitled to one guinea per day (Regulation 9(1)). In addition to these fees, members residing more than 50 miles from the meeting place are eligible for travel reimbursements, including first-class rail fares to and from the meeting location, and a daily travelling allowance of one guinea, which covers all incidental expenses such as meals and cab fares (Regulation 9(2)). The obligations under these regulations require members of the Marine Council and Committees of Advice to be compensated for their time and travel expenses when attending meetings. The regulation ensures that these members receive a fair remuneration for their participation, which includes both a daily sitting fee and travel allowances if they reside at a significant distance from the meeting venue. The regulation also mandates that the fees and allowances be paid in accordance with the stipulated rates and conditions, ensuring transparency and consistency in the compensation process. Breaches of these regulations could potentially lead to disputes regarding the compensation of Marine Council and Committee members, as the specific provisions for fees and allowances are clearly outlined. While the statutory rules do not explicitly state penalties for non-compliance, failure to adhere to these provisions might result in legal challenges or administrative actions to ensure that the compensation is fairly administered as per the established guidelines. The enforcement of these provisions would likely be overseen by the relevant maritime authorities to ensure compliance and proper remuneration of the council and committee members.
