Overview

The Navigation (Manning and Coasting Trade) Regulations 1978 are a legislative instrument that amends existing regulations under the Navigation Act 1912. Enacted by the Governor-General, acting on advice from the Federal Executive Council, these regulations aim to streamline the administration of the coasting trade by updating the roles and responsibilities within the Department of Transport. The primary objective of these amendments is to replace the term "Regional Controller" with "authorized officer," thereby clarifying the duties and authorities of personnel involved in the coasting trade. This change is intended to enhance the efficiency of the regulatory process while ensuring that the administration of coasting trade remains robust and compliant with the overarching legislative framework. These amendments were made to ensure that the regulatory process remains relevant and effective, particularly in the context of evolving maritime practices and administrative requirements. The policy objective is to facilitate smoother operations within the coasting trade by providing clear definitions and responsibilities for those handling applications, permits, and licenses. This approach helps maintain the integrity of maritime safety and operational standards while adapting to the changing needs of the industry.

Scope and Application

The Navigation (Manning and Coasting Trade) Regulations 1978, made under the Navigation Act 1912, apply to individuals and entities involved in the coasting trade within Australian waters. These regulations govern the manning and licensing of ships, specifying the roles and duties of authorised officers within the Department of Transport, who replace the previously defined Regional Controllers. The Regulations affect various maritime activities, including the issuing of permits for unlicensed ships, applications for exemptions, refunds of fees, and evidence of payment of Australian rates of wages. The geographic reach of these regulations is national, applying across all Australian states and territories. Notably, the Regulations include amendments that substitute references to Regional Controllers with authorised officers, thereby streamlining the administrative process and ensuring consistency in the application of maritime laws across the country.

Key Provisions

The primary operative sections of these Regulations (F1996B04218) under the Navigation Act 1912 involve amendments to the Navigation (Manning and Coasting Trade) Regulations, specifically concerning the definition and substitution of certain roles and responsibilities. Regulation 2 repeals the previous definition of "Regional Controller" and introduces the term "authorized officer," defined as a person specified by the Minister in writing as holding or performing duties in the Department of Transport (Reg. 2(a)). Furthermore, Regulation 4 modifies various sub-regulations to replace references to "Regional Controller" with "authorized officer" across several provisions, including applications for exemption under section 422a of the Act (Reg. 26), refund of fees (Reg. 27), applications for licences to engage in coasting trade (Reg. 28), and applications for renewal of licences (Reg. 29). Additionally, Regulation 35 adjusts the requirement for evidence of payment of Australian rate of wages to be submitted to an "authorized officer" (Reg. 35). These changes are reflected in the First Schedule, where forms M.A.C.T.—6 and M.A.C.T.—9 are amended to reflect these substitutions (Reg. 9). Importantly, the Regulations include a savings provision to ensure that any certificates, applications, or statements made under the old regulations remain valid (Reg. 10). The Regulations impose several obligations on the parties governed by them, primarily focusing on the substitution of roles within the Department of Transport. The primary obligation is the requirement for those engaging in coasting trade to submit applications, evidence, and other documentation to an "authorized officer" rather than a "Regional Controller." This shift necessitates that those involved in the coasting trade familiarize themselves with the new definitions and ensure that all interactions and submissions are directed to the appropriate authorized officers as specified by the Minister. Furthermore, the Regulations require authorized officers to perform duties previously assigned to Regional Controllers, including processing applications for licences, exemptions, refunds, and other related matters. This includes ensuring that all documentation submitted is complete and compliant with the requirements set out in the amended regulations. In terms of penalties and consequences for breach, the Regulations themselves do not explicitly state any specific offences, penalties, or consequences. However, given that they are made under the Navigation Act 1912, any failure to comply with the provisions of the Act or the Regulations could result in enforcement actions under that Act. The Navigation Act 1912 provides for various civil and criminal penalties for breaches, including fines and imprisonment, depending on the severity and nature of the breach. For instance, under section 425 of the Act, a person who contravenes any provision of the Act or the Regulations is liable to a penalty that could extend to significant fines and imprisonment terms, depending on the specific contravention. It is important for those governed by these Regulations to ensure strict compliance to avoid any potential enforcement actions under the broader Navigation Act 1912.
