Overview
Statutory Rules 1978 No. 131, the Regulations under the Navigation Act 1912, were enacted to address issues related to the administration and enforcement of life-saving appliance regulations on ships, specifically amending the Navigation (Life-saving Appliances) Regulations. The Regulations were made by the Governor-General of the Commonwealth of Australia, acting on the advice of the Federal Executive Council, and were notified in the Commonwealth of Australia Gazette on 13 July 1978. The policy objective of these amendments was to streamline the administrative process by introducing the concept of an "authorized officer" within the Department of Transport, thereby replacing the previous role of the "Regional Controller" and ensuring continuity and efficacy of existing exemptions granted under the older regulations.
Scope and Application
The Legislative instrument, Statutory Rules 1978 No. 131, amends the Navigation (Life-saving Appliances) Regulations under the Navigation Act 1912. These Regulations apply to individuals and entities involved in maritime navigation within Australian waters, specifically focusing on the requirements for life-saving appliances on ships. The amendments define "authorized officer" as a person from the Department of Transport specified by the Minister, replacing the previous definition of "Regional Controller." The changes also replace references to "Regional Controller" with "authorized officer" in Regulation 79. The regulations ensure continuity for existing exemptions granted before these amendments by interpreting references to "Regional Controller" as referring to "authorized officer." The amendments extend to all maritime operations within Australian jurisdiction, including territorial waters and the internal waters of the states and territories, thereby impacting ship operators, maritime authorities, and other relevant stakeholders.
Key Provisions
The primary operative sections of these Regulations concern amendments to the Navigation (Life-saving Appliances) Regulations, as referenced in the Statutory Rules of 1978 No. 131. Specifically, Regulation 5 is amended to insert a definition of "authorized officer" (section 1(a)) and to omit the definition of "Regional Controller" (section 1(b)). Regulation 79 is further amended to replace references to "Regional Controller" with "authorized officer" in paragraph (c) and elsewhere (section 2). These changes are intended to update the regulatory framework governing life-saving appliances on ships, ensuring that responsibilities and duties are clearly defined in line with current administrative structures within the Department of Transport.
The Regulations impose several obligations on the parties and entities they govern. Firstly, they necessitate the redefinition of key terms to reflect current roles and responsibilities within the Department of Transport. The term "authorized officer" is introduced to replace the previously used term "Regional Controller," ensuring clarity and consistency in regulatory enforcement and compliance. Furthermore, any exemptions granted under the previous regulations must be interpreted with these amendments in mind, particularly in how references to "Regional Controller" are now understood as references to "authorized officer" (section 3). This ensures that existing exemptions remain valid and applicable under the new regulatory framework.
Breaching the provisions of these Regulations can lead to various civil and criminal consequences. While the specific penalties are not detailed within the text of the Regulations themselves, it is implied that non-compliance with life-saving appliance requirements could result in legal action under the Navigation Act 1912. The penalties for such breaches could include fines or other sanctions as prescribed by the Act, depending on the severity and nature of the violation. It is essential for governed entities to adhere strictly to these regulations to avoid potential legal repercussions.
