Overview
Statutory Rules 1976 No. 278, the Regulations under the Navigation Act 1912, were enacted to make specific amendments to the Navigation (Grain) Regulations, which were first established in 1968 and subsequently amended in 1973 and 1975. These regulations were introduced to address issues concerning the inspection fees for grain shipments and the requirements related to plans for navigation, aiming to update the financial parameters to reflect changes in economic conditions and operational costs. The regulations were made by the Governor-General of the Commonwealth of Australia, acting on the advice of the Federal Executive Council, and came into operation on 1 January 1977. The policy objective behind these amendments was to ensure that the fees and requirements were reflective of the current economic context, thus facilitating smoother operations within the maritime sector.
Scope and Application
Statutory Rules 1976 No. 278 amends the Navigation (Grain) Regulations under the Navigation Act 1912, introducing updated inspection fees and plan requirements. These regulations apply to entities involved in the transport of grain via navigation in Australia, ensuring compliance with national standards set by the federal government. The amendments, effective from 1 January 1977, adjust the financial obligations for inspections and plans related to grain transport, reflecting the need for updated regulatory fees. While these regulations specifically cater to grain transportation, broader maritime navigation laws and regulations may further define their scope and application across various maritime industries within Australia.
Key Provisions
The key operative sections of the Regulations under the Navigation Act 1912 primarily pertain to the amendment of inspection fees and requirements in relation to plans under the Navigation (Grain) Regulations (section 2 and 3). These amendments are significant as they update the fees for grain inspections and the costs associated with specific plans required under the regulations. The changes in fees are detailed, specifying the new rates for various categories of inspections and plans. For example, the fee for a Class 1 inspection is now $12, while the fee for a Class 3 inspection is $7 (section 2). Similarly, the cost for certain plans has been updated, with the fee for a particular type of plan now being $45 (section 3).
The Regulations impose specific obligations on parties involved in the inspection and handling of grain under the Navigation (Grain) Regulations. These obligations include the payment of updated inspection fees as specified in the Regulations (section 2). Additionally, entities required to submit plans under the regulations must ensure these plans comply with the new fee structure and are submitted in a timely manner (section 3). Compliance with these requirements is essential for lawful operation within the scope of the Navigation Act 1912 and its subsidiary regulations.
Failure to comply with the updated fees and requirements set out in these Regulations can result in civil consequences. Specifically, the Navigation Act 1912 provides for penalties for non-compliance, although the exact penalties are not detailed in these Regulations. Generally, penalties for breaches of the Navigation Act can include fines and, in severe cases, imprisonment. The maximum penalties can vary depending on the specific breach and the discretion of the court, but they are intended to enforce compliance and ensure the smooth operation of grain inspections and handling under the Act.
