Overview
The Statutory Rules 1964 No. 164, issued under the Navigation Act 1912-1961, aims to amend the Navigation (Fees and Allowances of Members of Committees) Regulations by aligning the allowances paid to committee members with those specified in the Public Service Regulations. This legislative instrument was introduced to address the need for regular updates to fees and allowances in line with broader public service standards, ensuring consistency and fairness in remuneration practices. Enacted by the Governor-General in Council, the policy objective is to maintain equitable compensation structures for committee members involved in navigation-related matters, reflecting the current economic conditions and public service guidelines. These regulations underscore the importance of keeping statutory allowances current to support the effective functioning of maritime regulatory committees.
Scope and Application
The Regulations under the Navigation Act 1912-1961, made by the Governor-General on 24 December 1964, specifically target amendments to the Navigation (Fees and Allowances of Members of Committees) Regulations. These Regulations apply to members of committees established under the Navigation Act, whose allowances and fees are subject to modification as per the new provisions. The amendments focus on updating the travelling allowance and meal allowances for these committee members, aligning them with the rates specified in the Public Service Regulations. The changes are aimed at ensuring that the allowances remain consistent with the broader public service standards. These Regulations have a national reach, applying throughout the Commonwealth of Australia, and are integral to maintaining equitable compensation for committee members involved in navigation-related matters. Notably, the Regulations do not introduce any exclusions, exemptions, or thresholds; they simply revise existing allowances within the framework of the overarching Navigation Act.
Key Provisions
The Regulations under the Navigation Act 1912-1961, specifically amending the Navigation (Fees and Allowances of Members of Committees) Regulations, introduce several key changes as outlined in the statutory rules. Regulation 7 is amended to adjust the travelling allowance for committee members, replacing the previous rate of four pounds ten shillings per day with the rate specified in sub-regulation (2.) of regulation 75a of the Public Service Regulations (section 1). Similarly, Regulation 9 is amended to adjust meal allowances. The meal allowances are revised by changing the rates from six shillings and six pence, eight shillings, and twelve shillings and six pence to seven shillings and six pence, seven shillings and six pence, and fifteen shillings respectively (section 2).
These amendments impose specific obligations on the parties involved, primarily the committee members who are entitled to allowances under the Navigation Act. The changes necessitate compliance with the new rates as set out in the Public Service Regulations. Committee members must ensure their travel and meal expenses are calculated according to these updated rates, which may impact their financial claims and reimbursements. The Regulations mandate that any claims for allowances must be substantiated with appropriate documentation and evidence to align with the specified rates.
Failure to comply with the amended provisions can result in civil or administrative consequences. If committee members or their employers submit claims based on outdated rates, these claims may be rejected, leading to potential financial discrepancies. Furthermore, if the non-compliance is deemed to be deliberate or fraudulent, it could result in penalties under the Navigation Act or related statutes. Although the specific penalties are not detailed in the provided excerpt, breaches of legislative requirements typically incur fines or other sanctions as determined by the relevant authorities.
