Overview
The Statutory Rules 1961, No. 55, introduced by the Administrator of the Government of the Commonwealth of Australia, constitutes a legislative instrument under the Navigation Act 1912-1958. This regulation was enacted to amend the existing Navigation (Fees and Allowances of Members of Committees) Regulations, specifically adjusting the travelling allowance for members involved in navigation-related committees. The objective of this amendment is to update the financial allowances to reflect changes in economic conditions since the original regulations were set. These regulations were introduced to address the need for a fair and updated compensation structure for committee members, ensuring their work remains adequately incentivised and sustainable.
The regulation was made by the Administrator of the Government of the Commonwealth of Australia, acting on the advice of the Federal Executive Council. The policy objective behind these amendments is to ensure that the allowances provided to committee members are reflective of the current economic environment, thus maintaining the efficacy and efficiency of the committees established under the Navigation Act 1912-1958. This legislative instrument was published in the Commonwealth Gazette on the 20th of April, 1961, and came into effect on the 4th of November, 1960.
Scope and Application
The Regulations under the Navigation Act 1912-1958, specifically amending the Navigation (Fees and Allowances of Members of Committees) Regulations, apply to members of committees established under the Act. This legislation primarily impacts individuals who serve on committees related to navigation, such as those involved in maritime safety, vessel inspections, or other maritime-related governance functions. The Regulations adjust the travelling allowance for these committee members, reflecting the updated financial compensation for their services. The geographic reach of these Regulations is national, given they pertain to the administration of maritime law across Australia. The changes to the allowances are effective from the specified commencement date of 4 November 1960, ensuring that the updated rates are applied retroactively from that date. While the primary focus is on financial adjustments, these Regulations underscore the ongoing administrative oversight under the Navigation Act to ensure proper resourcing and compensation for maritime oversight functions.
Key Provisions
The primary operative section of these regulations (Regulation 6) concerns the amendment of the travelling allowance for members of committees under the Navigation (Fees and Allowances of Members of Committees) Regulations. Specifically, it alters the amount of the travelling allowance from "Three pounds six shillings" to "Four pounds ten shillings." This adjustment ensures that the compensation for travel expenses is updated to reflect changes in economic conditions or cost of living. The regulation specifies that this amendment shall come into operation on the fourth day of November, 1960, which is prior to the date of the Statutory Rules themselves, indicating an intent to backdate the effective date of the allowance change.
The Act imposes obligations on the parties it governs by ensuring that members of committees involved in navigation-related activities receive appropriate financial compensation for travel expenses. This is intended to facilitate the effective functioning of these committees, enabling them to perform their duties without undue financial burden. The updated allowance aims to provide a fair and adequate reimbursement for the costs incurred by committee members in carrying out their responsibilities, thereby supporting the broader objectives of the Navigation Act 1912-1958.
Regarding penalties and consequences for breaches, the Statutory Rules do not explicitly detail any offences or penalties within the text provided. However, it is generally understood that failure to adhere to the regulations or to provide the correct allowances as stipulated could lead to administrative or legal repercussions under the broader framework of the Navigation Act 1912-1958. The penalties for such breaches would typically be determined by the specific provisions of the overarching Act, which may include fines, administrative sanctions, or other enforcement actions deemed necessary to ensure compliance.
