Overview

Statutory Rules 1960 No. 65, titled "Regulations under the Navigation Act 1912-1958," was enacted to address gaps in the administrative and financial provisions of maritime committees established under the Navigation Act 1912-1958. This legislative instrument was made by the Governor-General in Council, reflecting the authority of the Commonwealth Government to implement regulations necessary for the effective governance of maritime affairs. The primary policy objective of these regulations was to clarify the scope of application and the remuneration of committee members, ensuring that the financial and operational aspects of these committees align with the broader maritime regulatory framework. This amendment aimed to streamline the administrative processes related to the fees and allowances of members of maritime committees, thereby enhancing the efficiency and effectiveness of maritime governance in Australia.

Scope and Application

The Statutory Rules 1960, No. 65, made under the Navigation Act 1912-1958, specify amendments to the Navigation (Fees and Allowances of Members of Committees) Regulations. These regulations pertain to the financial entitlements of members serving on various committees within the scope of maritime governance, specifically those formed under the auspices of the Navigation Act. The amendments clarify and redefine key terms such as "Committee of Advice," "the Act," and "the Marine Council" to ensure precision and alignment with the legislative framework established by the Navigation Act 1912-1958. Moreover, the regulations introduce exceptions to the application of these financial entitlements, excluding certain members who are affiliated with the Commonwealth Conciliation and Arbitration Commission, the Public Service of the Commonwealth, or any other Commonwealth authority. These amendments reflect an effort to streamline the administrative and financial governance of maritime-related committees while accommodating the roles of key governmental bodies and their officers.

Key Provisions

The key operative sections of the Statutory Rules 1960 No. 65, which amend the Navigation (Fees and Allowances of Members of Committees) Regulations under the Navigation Act 1912-1958, primarily involve amending definitions and regulations related to the applicability of certain fees and allowances. Specifically, Regulation 2 is amended to redefine key terms such as "Committee of Advice" and "the Act," and to introduce a new definition for "the Marine Council" (Regulation 1(a)-(c)). Additionally, Regulation 3 is repealed and replaced with a new regulation that excludes certain members from the applicability of these fees and allowances (Regulation 1(b)). These regulations impose specific obligations on the parties governed by them, namely the members of committees under the Navigation Act. The amendments clarify who is eligible to receive certain fees and allowances, specifically excluding members who are part of the Commonwealth Conciliation and Arbitration Commission, officers of the Public Service of the Commonwealth, or officers of a Commonwealth authority (Regulation 3). By doing so, the regulations ensure that only eligible members are entitled to the fees and allowances stipulated in the Navigation Act. Failure to comply with these regulations can lead to legal consequences. Although the specific penalties are not detailed within the text, breaches of regulations under the Navigation Act 1912-1958 can generally result in fines or other sanctions as prescribed by the Act. The maximum penalties can vary depending on the severity of the breach, and may include both civil and criminal liabilities, as stipulated by the overarching legislation. It is important for those governed by these regulations to adhere strictly to the defined terms and conditions to avoid any potential repercussions.
