Overview

The Statutory Rules 1978 No. 130, made under the Navigation Act 1912, were enacted by the Governor-General with the advice of the Federal Executive Council to amend existing regulations concerning the examination of engineers in the maritime sector. These regulations aimed to update and streamline the processes involved in certifying marine engineers, addressing a need to modernise the administrative framework that had been in place since the early 20th century. The changes introduced by these regulations sought to clarify roles and responsibilities within the Department of Transport, ensuring a more efficient and effective system for the certification and oversight of marine engineers. This update reflects a policy objective of enhancing maritime safety and operational efficiency through improved regulatory practices.

Scope and Application

The Navigation (Examination of Engineers) Regulations 1978, which are statutory rules made under the Navigation Act 1912, pertain to the regulation of marine engineers within the Commonwealth of Australia. These regulations specifically apply to individuals and entities involved in the examination and certification of marine engineers, including the issuance of temporary permits and certificates for marine engine-drivers. They define an “authorized officer” as a person specified by the Minister in the Department of Transport, thereby clarifying the roles and responsibilities within the regulatory framework. These regulations amend and replace previous regulations from 1926, ensuring that any existing applications, authorities, endorsements, notices, or reports continue to be valid but with references to “Regional Controller” read as “authorized officer.” The geographic reach of these regulations is national, as they are issued under the Commonwealth's authority, and they extend their application through the specified amendments and definitions.

Key Provisions

The Regulations under the Navigation Act 1912, specifically amending the Navigation (Examination of Engineers) Regulations 1926, introduce several key changes. Firstly, Regulation 2 is repealed, which previously defined "Regional Controller." Regulation 3 is amended to define "authorized officer" as a person holding a specified office in the Department of Transport, as determined by the Minister in writing. Additionally, Regulation 19 is altered to replace references to "Regional Controller" with "authorized officer" concerning the issue of temporary permits. Similarly, Regulation 23 is updated to replace "Regional Controller" with "authorized officer" in the context of issuing certificates. Regulation 89 is modified to substitute "authorized officer" for "Regional Controller" in the marine engine-driver's examination. Lastly, the Tenth Schedule is amended to change "Regional Controller" to "authorized officer" in paragraph (2). These amendments impose several obligations on the parties governed by these Regulations. Firstly, the definition of "authorized officer" specifies the roles within the Department of Transport that are empowered to carry out certain duties previously assigned to "Regional Controller." This includes issuing temporary permits, certificates, and conducting examinations, all now falling under the purview of an "authorized officer." Furthermore, the Regulations clarify that any references to "Regional Controller" in existing applications, authorities, endorsements, notices, or reports will be interpreted as referring to "authorized officer" for the purposes of applying these Regulations. The Regulations do not explicitly state any offences, penalties, or consequences for breaches. However, the enforcement of these Regulations would likely fall under the general provisions of the Navigation Act 1912, which may include administrative penalties or other legal actions for non-compliance. It is essential to note that while specific penalties are not mentioned in these Regulations, any failure to adhere to the requirements set out could result in legal consequences under the broader legislative framework of the Navigation Act 1912.
