REGULATIONS UNDER THE NAVIGATION ACT 1912*
I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Navigation Act 1912.

AMENDMENTS OF THE NAVIGATION (DECK CARGO AND LIVE STOCK) REGULATIONS †
Parts
1. Regulation 2 of the Navigation (Deck Cargo and Live Stock) Regulations is repealed.
Interpretation
2. Regulation 3 of the Navigation (Deck Cargo and Live Stock Regulations is amended—
(a) by inserting before the definition of “Passenger ship” the following definition:
“ ‘ authorized officer ’ means a person holding, or for the time being performing the duties of, an office in the Department of Transport that is specified for the purposes of this definition by the Minister by instrument in writing;”; and
(b) by omitting the definition of “ Regional Controller ”.
Application
3. Regulation 4 of the Navigation (Deck Cargo and Live Stock) Regulations is amended by omitting from paragraphs (c) and (d) of sub-regulation (2) “ a Regional Controller ” and substituting “ an authorized officer ”.

Notice of intention to load live stock or deck cargo
4. Regulation 6 of the Navigation (Deck Cargo and Live Stock) Regulations is amended—
(a) by omitting from sub-regulation (1) “ a Regional Controller ” and substituting “ an authorized officer ”;
(b) by omitting from sub-regulation (2) “ a Regional Controller ” (wherever occurring) and substituting “an authorized officer”;
(c) by omitting from sub-regulation (6) “ Regional Controller’s ” (wherever occurring) and substituting “authorized officer’s”; and
(d) by omitting from sub-regulation (7) “ Regional Controller’s ” and substituting “ authorized officer’s ”.

5. Regulation 7 of the Navigation (Deck Cargo and Live Stock) Regulations is amended by omitting “ a Regional Controller ” and substituting “ an authorized officer ”.
Projection of deck cargo over side
6. Regulation 17 of the Navigation (Deck Cargo and Live Stock) Regulations is amended by omitting “ a Regional Controller ” and substituting “ an authorized officer ”.
Horses and cattle not to be carried on hatchways
7. Regulation 23 of the Navigation (Deck Cargo and Live Stock) Regulations is amended by omitting “ a Regional Controller ” and substituting “ an authorized officer ”.
Restriction on carriage of dogs, male goats and pigs
8. Regulation 27 of the Navigation (Deck Cargo and Live Stock) Regulations is amended by omitting from sub-paragraph (i) of paragraph (c) “ a Regional Controller ” and substituting “ an authorized officer ”.
Separate stalls for horses, &c.
9. Regulation 30 of the Navigation (Deck Cargo and Live Stock) Regulations is amended by omitting “ a Regional Controller ” and substituting “ an authorized officer ”.
Savings
10. Nothing in these Regulations affects the validity or efficacy of an approval, or a notice, notification, permission or statement, given, furnished or extended under the Navigation (Deck Cargo and Live Stock) Regulations as in force before the commencement of these Regulations and, for the purposes of the application to such an approval or such a notice, notification, permission or statement of the Navigation (Deck Cargo and Live Stock) Regulations as amended by these Regulations, a reference in the approval, notice, notification, permission or statement to “ Regional Controller ” shall be read as a reference to “ authorized officer ” as defined by those Regulations as so amended.
