Overview

Statutory Rules 1979 No. 191, the Regulations under the Navigation Act 1912, were enacted to make amendments to the Navigation (Dangerous Goods) Regulations, providing updated fee structures for various dangerous goods transportation activities. This legislative instrument was introduced to address the need for revised fee schedules to reflect current economic conditions and the evolving nature of dangerous goods transportation. The Regulations were made by the Governor-General of the Commonwealth of Australia, acting on the advice of the Federal Executive Council, and aim to ensure the fees for dangerous goods transportation are appropriately set to cover the administrative costs associated with the oversight and regulation of such activities. The Regulations came into effect on 1 October 1979.

Scope and Application

The Statutory Rules 1979 No. 191, made under the Navigation Act 1912, amend the Navigation (Dangerous Goods) Regulations, which came into operation on 1 October 1979. These regulations pertain to the fees associated with the transportation of dangerous goods in Australian waters and apply to entities and individuals involved in the transport of such goods. The regulations cover all dangerous goods transported on vessels operating within Australian territorial waters and are applicable nationwide, reflecting the Commonwealth's jurisdiction over maritime activities. The amendments primarily revise the fee structure for various categories of dangerous goods transport, as detailed in the regulations. While the primary focus is on adjusting financial obligations, the overarching aim is to ensure safe and compliant transport practices. The application of these regulations extends through subordinate instruments that may further specify or modify the rules as necessary to meet evolving safety standards and requirements.

Key Provisions

The main operative sections of these regulations primarily focus on amending the fees associated with dangerous goods under the Navigation Act 1912. Specifically, section 2 of the regulations revises the fee structure outlined in Regulation 8 of the Navigation (Dangerous Goods) Regulations. The changes involve the substitution of new fee amounts for various categories of dangerous goods and related services. For instance, the fee for certain types of dangerous goods is amended from $24 to $120 (sub-paragraph (a)(i) of sub-regulation (1)). Similarly, the fee for other categories is adjusted from $12 to $60 (sub-paragraph (ii) of paragraph (a) of sub-regulation (1)), and so forth. These amendments aim to update the financial obligations associated with the transportation of dangerous goods, ensuring that the fees reflect current economic conditions and the costs involved. The regulations impose obligations on parties involved in the transportation of dangerous goods. These obligations include compliance with the updated fee structure as specified in section 2. Parties must ensure that they pay the correct fees when transporting dangerous goods, as outlined in the amended Regulation 8. This involves adhering to the new fee amounts for various categories of dangerous goods and services, which are detailed in sub-regulation (1) through sub-regulation (5). By complying with these fee amendments, parties demonstrate adherence to the regulatory requirements governing the transportation of dangerous goods, ensuring that they meet their financial obligations under the Navigation Act 1912. In terms of offences, penalties, or consequences for breach, the regulations themselves do not explicitly state the penalties for non-compliance with the updated fee structure. However, non-compliance with the Navigation Act 1912 and its regulations could lead to various civil or criminal consequences, depending on the severity of the breach. Generally, breaches of the Navigation Act 1912 may result in fines and, in more serious cases, criminal charges. The maximum penalties for such offences can vary widely, depending on the specific circumstances and the discretion of the court. It is important for parties to ensure strict compliance with the amended fee structure to avoid potential legal repercussions.
