An Act to amend the Navigation Act 1912, and for related purposes

The Parliament of Australia enacts:

1  Short title

  This Act may be cited as the Navigation Amendment Act 2005.

2  Commencement

 (1) Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

  Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.


Schedule 1—Amendment of the Navigation Act 1912

 

1  After subsection 258(3)

Insert:

 (4) An offence against the regulations made by virtue of this section is an indictable offence.

2  Subsections 258(5) and (6)

Repeal the subsections.

3  Subsection 258A(1)

Omit “(1)”.

4  Subsection 258A(1) (penalty)

Repeal the penalty, substitute:

Penalty: Imprisonment for 4 years.

5  Subsection 264(2)

Omit “a fine not exceeding $20,000 or imprisonment for a period not exceeding 10 years, or both”, substitute “imprisonment for a period not exceeding 10 years”.

6  Subsection 265(1) (penalty)

Repeal the penalty, substitute:

Penalty: Imprisonment for 4 years.

7  Subsection 265(2) (penalty)

Repeal the penalty, substitute:

Penalty: Imprisonment for 10 years.

8  Subsection 265(6) (penalty)

Repeal the penalty, substitute:

Penalty: 50 penalty units.
