Overview

The Naval Reserve (National Service) Regulations were enacted in 1955 under the authority of the Naval Defence Act 1910-1952, as amended, by the Governor-General in Council. These regulations were introduced to establish the framework for the service of individuals deemed to have been enlisted in the Citizen Naval Forces under the National Service Act 1951-1953, within the Royal Australian Naval Reserve (National Service). The regulations outline the service requirements, conditions, and administrative aspects for members of the Royal Australian Naval Reserve (National Service). The policy objective is to ensure that these members fulfil their service obligations effectively and in accordance with the provisions set forth by the Naval Defence Act and the National Service Act, thereby maintaining the operational readiness and strength of the Royal Australian Naval Reserve.

Scope and Application

The Naval Reserve (National Service) Regulations, made under the Naval Defence Act 1910-1952, primarily govern the service of individuals who are deemed to have been enlisted in the Citizen Naval Forces under the National Service Act 1951-1953. These individuals are required to render their service in the Royal Australian Naval Reserve (National Service), which is a specific branch of the Citizen Naval Forces. The regulations set out the terms and conditions under which these members will serve, including the duration and nature of their service, the branches in which they may be required to serve, and their obligations regarding training, reporting, and attendance. The regulations also cover the administration, uniforms, and pay of these members, ensuring that they are supplied with appropriate uniforms and that their pay and allowances are managed in a manner similar to that of permanent naval forces members. The regulations apply nationally across Australia and are enforced by the Director of Naval Reserves, who is responsible for the administration and control of the Royal Australian Naval Reserve (National Service), excluding matters of finance and stores.

Key Provisions

The Naval Reserve (National Service) Regulations (Regulations) primarily outline the service obligations, conditions, and administrative aspects for members of the Royal Australian Naval Reserve (National Service) as per the National Service Act 1951-1953 (Section 3). These members are required to render their service within the Royal Australian Naval Reserve (National Service) as part of the Citizen Naval Forces (Section 3). The service conditions for these members are governed by the conditions set for the Royal Australian Naval Reserve (National Service) (Section 4), and members are liable to serve in any branch of this Reserve and undergo training in the branch they are assigned to (Section 5). The service duration includes full-time continuous service in a ship or naval establishment for 154 days, plus additional training for a total of 22 days (Section 6(1)). However, students and apprentices may serve their full-time continuous service in two periods of 77 days each, subject to approval by the Naval Board (Section 6(2)). If a member has already served less than 154 days prior to these Regulations, they must complete the remaining days (Section 6(3)). These Regulations impose several obligations on the members of the Royal Australian Naval Reserve (National Service). Members must report for further service as directed by the Commanding Officer (Section 7). The Director of Naval Reserves is responsible for the administration and control of all matters related to the Royal Australian Naval Reserve (National Service) (Section 8). Members must wear uniforms and badges similar to those of the Royal Australian Naval Reserve, with a distinguishing badge indicating "R.A.N.R. (N.S.)" (Section 10). Members are supplied with uniforms free of charge, but they must ensure the safe custody and preservation of these items (Section 11). They are also required to notify the Commanding Officer of any change of address within seven days (Section 15). Failure to comply with certain provisions of these Regulations may result in penalties. For instance, members who neglect their uniforms and cause loss or damage may be required to pay for replacements or repairs, subject to an allowance for wear and tear (Section 11). Additionally, members who fail to notify a change of address within the specified timeframe may face a penalty of Twenty Pounds (Section 15). While the Regulations do not explicitly detail other offences or penalties, breaches of service obligations or administrative directives could potentially lead to disciplinary actions as prescribed under the Naval Defence Act 1910-1952 or other relevant legislation.
