Overview
Statutory Rules 1976 No. 14, made under the Naval Defence Act 1910-1975, introduces amendments to the Naval Reserve Cadets Regulations, addressing specific issues related to allowances and pay for naval reserve cadets. Enacted by the Administrator of the Government of Australia, with the advice of the Executive Council, these regulations aim to update and streamline the financial provisions for naval reserve cadets. The policy objective behind these amendments is to ensure that the allowances and pay for officers and instructors are accurately reflected and aligned with their rank and duties, while also making necessary adjustments to the marriage allowance and efficiency standards. This legislative instrument was designed to provide clarity and consistency in the financial aspects of the Naval Reserve Cadets, thereby supporting the operational effectiveness and morale of the naval reserve forces.
Scope and Application
The Naval Defence Act 1910-1975 forms the legislative foundation upon which the Naval Reserve Cadets Regulations, as amended by Statutory Rules 1976 No. 14, are based. This particular legislative instrument amends and repeals sections of the existing regulations to provide updated provisions for pay, allowances, and efficiency standards for officers and instructors within the Naval Reserve Cadets. The amendments apply to officers and instructors who are members of the Naval Reserve Cadets, a subset of the broader Defence Force, and who participate in continuous training camps or receive specific allowances. The regulations also extend to changes in pay rates for different ranks and adjustments to marriage allowances, which now align with amendments declared in the Defence Force (Reserves) (Financial) Regulations. The efficiency standard for cadets has been revised, reducing the required attendance from sixty to fifty days. The application of these regulations is confined to the Commonwealth of Australia, impacting entities and individuals involved in the Naval Reserve Cadets directly. No specific exclusions, exemptions, or thresholds are stated in these regulations, which may be further defined or extended through subordinate instruments or additional legislative amendments.
Key Provisions
The main operative sections of these Regulations primarily focus on amending the Naval Reserve Cadets Regulations. Section 1 removes sub-regulations (4) to (8) of Regulation 18, which likely pertains to allowances. Section 2 repeals Regulations 19 and 20 and substitutes them with a new regulation that specifies the rates of pay for officers and instructors attending a continuous training camp based on their rank. Section 3 modifies Regulation 21, altering the conditions for the payment of a marriage allowance. Lastly, Section 4 amends Regulation 26, reducing the number of days required for a cadet to be considered efficient from sixty to fifty.
These Regulations impose specific obligations and requirements on officers and instructors within the Naval Reserve Cadets. They must now receive pay at specified rates if they attend a continuous training camp, as outlined in the newly substituted Regulation 19. Additionally, the changes in Regulation 21 mean that the conditions under which marriage allowances are payable have been altered. Furthermore, the amendment in Regulation 26 reduces the attendance threshold for a cadet to be deemed efficient from sixty to fifty days.
Breach of these Regulations can result in various consequences, although the specific legal ramifications are not detailed within the text of the Regulations themselves. Generally, non-compliance with statutory instruments can lead to administrative, civil, or even criminal penalties, depending on the nature and severity of the breach. For instance, failure to adhere to the financial regulations concerning allowances and pay could potentially lead to financial penalties or disciplinary actions within the Naval Reserve Cadets.
