Application.

3. The rates of pay provided for under the Naval Forces (Papua New Guinea Division) Regulations as amended by these Regulations apply to and in relation to service in the Naval Forces on or after 4 July 1974.

Overview

The Regulations under the Naval Defence Act 1910-1973, enacted in 1974 by the Governor-General of Australia, address the need to update and amend existing pay rates for personnel within the Naval Forces, specifically focusing on the Papua New Guinea Division. This legislative instrument aims to ensure that remuneration aligns with the evolving nature of service and pay seniority, reflecting the changing economic conditions and the importance of fair compensation for military personnel. The regulations were developed by the Australian Government to adjust the financial compensation for various ranks and stages of service, ensuring that the remuneration reflects the skills and experience of the sailors and officers involved. These amendments are intended to provide clarity and consistency in pay structures, thereby addressing any discrepancies that may have existed under the previous framework.

Scope and Application

Statutory Rules 1974 No. 252, made under the Naval Defence Act 1910-1973, amends the Naval Forces (Papua New Guinea Division) Regulations by updating the rates of pay for officers and sailors within the Naval Forces, specifically the Papua New Guinea Division. These regulations apply to all personnel serving in the Naval Forces, including officers and sailors, and are effective for service on or after 4 July 1974. The amendments focus on adjusting the pay rates based on rank and years of service, with specific tables provided for various ranks and skill levels. The scope of the legislation is confined to the pay adjustments for personnel in the Naval Forces, specifically within the Papua New Guinea Division. There are no stated exclusions or exemptions in these regulations; they comprehensively cover the pay adjustments for the specified personnel. The application of these regulations is extended to all relevant personnel within the defined scope, without any additional thresholds or conditions outlined in the text.

Key Provisions

The main sections of these Regulations (Statutory Rules 1974 No. 252) amend the Naval Forces (Papua New Guinea Division) Regulations, primarily by updating the rates of pay for officers and sailors in the Naval Forces. Regulation 1 amends Regulation 8, which outlines the rates of pay for sailors based on their stage of studies and pay seniority, replacing the existing table with new figures. Additionally, it modifies the pay rates for officers, as detailed in the Second and Third Schedules, to reflect updated rates for different ranks and seniority levels. These new rates apply to service in the Naval Forces from 4 July 1974 onwards. These Regulations impose obligations on the Australian government to ensure that officers and sailors within the Naval Forces are compensated according to the updated pay rates specified in the amended Regulations. The government is responsible for implementing these changes in pay rates to reflect the new figures provided, ensuring that all personnel are appropriately remunerated for their service in accordance with their rank and pay seniority. The Regulations do not explicitly outline specific offences, penalties, or consequences for breach within the text. However, any failure to adhere to these updated pay rates could potentially result in legal challenges or disputes regarding compensation, which could lead to civil actions for breach of contract or claims for underpayment. The exact legal and financial consequences would depend on the specific circumstances and applicable laws at the time of any such dispute.
