Overview

The Statutory Rules 1970 No. 19, made under the authority of the Governor-General of Australia, amended the existing Naval Forces (Papua and New Guinea Division) Regulations to revise the rates of pay for officers, sailors, and artificers in the Naval Defence Act 1910–1968. This legislative instrument was enacted to ensure that the remuneration of naval personnel was updated in line with the current pay standards, addressing any discrepancies that may have existed from the previous regulations. The regulations were designed to reflect the changes in rank and pay seniority, providing a clear and structured pay scale for all naval ranks. The policy objective behind these amendments was to maintain fair and equitable compensation for naval personnel, reflecting their service and rank.

Scope and Application

The Naval Defence Act 1910–1968 Regulations, made under the authority of the Governor-General, pertain specifically to the naval forces of Papua and New Guinea, regulating various aspects including rates of pay for officers, sailors, and artificers. The regulations apply to all members of the Naval Forces in Papua and New Guinea, encompassing both officers and enlisted personnel, as well as artificers. The geographic reach of these regulations is confined to the jurisdictions of Papua and New Guinea, reflecting the legislative framework established under the Naval Defence Act. The scope of these regulations includes the amendment of pay rates for different ranks and pay seniority levels, as outlined in the schedules attached to the regulations. Additionally, the regulations provide for transitional payments to ensure that members are compensated appropriately for the period prior to the commencement of these regulations. The application of these regulations is further extended and specified through subordinate instruments, ensuring detailed compliance and enforcement within the designated naval divisions.

Key Provisions

The statutory rules under the Naval Defence Act 1910–1968, made on December 7, 1970, and effective from the same date, amend the Naval Forces (Papua and New Guinea Division) Regulations. The primary changes involve the replacement of the Second, Third, and Fifth Schedules of the existing regulations, which specify rates of pay for officers, sailors, and artificers within the Naval Forces (Papua and New Guinea Division). The new schedules detail updated rates of pay based on rank and seniority, and include provisions for transitional payments to compensate for differences in pay rates prior to the regulations' amendment. The obligations imposed by these regulations include adherence to the updated pay rates for members of the Naval Forces (Papua and New Guinea Division), ensuring that payments are calculated and disbursed in accordance with the new schedules. This encompasses adjustments to pay scales for officers, sailors, and artificers, reflecting their rank and years of service. Personnel are required to meet the criteria outlined in the new schedules to receive the appropriate rates of pay, and employers must ensure compliance with these provisions to maintain fair and consistent remuneration practices within the division. Failure to comply with the provisions of these regulations could result in various consequences. While the specific offences and penalties are not detailed in the text, it is reasonable to infer that breaches of the regulations, such as underpayment or misclassification of pay, could lead to disciplinary actions, administrative penalties, or legal consequences. The regulations are designed to ensure that all members receive fair compensation for their service, and any non-compliance may be subject to review by relevant authorities to rectify discrepancies and uphold the integrity of the pay system.
