EXPLANATORY STATEMENT

STATUTORY RULES 1983 NO. 301

ISSUED BY THE AUTHORITY OF THE MINISTER FOR DEFENCE

AMENDMENT OF THE NAVAL FINANCIAL REGULATIONS

Section 12 of the Defence Amendment Act 1979 allows the Minister to make interim determinations amending or repealing regulations. The Act also deems such interim determinations to be Statutory Rules.

Regulation 108 of the Naval Financial Regulations provides for payment of Woomera Allowance to members of the Navy posted for duty to the Woomera locality.

Determinations 0302 Woomera Allowance and 0306 Broken Hill Allowance, two tri-Service determinations, have been made under section 58B of the Defence Act 1903 as part of a program of consolidating legislation concerning conditions of service for members of the Defence Force. Determination 0302 replaces regulation 108 of the Naval Financial Regulations. Navy did not have any previous requirement for Broken Hill Allowance.

These Statutory Rules repeal regulation 108 with effect from the date Determination 0302 is made. Some minor consequential amendments have also been made to regulation 111 of the Naval Financial Regulations by including references to Determinations 0302 and 0306.

Overview

The Statutory Rules 1983 No. 301, issued under the authority of the Minister for Defence, represents an amendment to the Naval Financial Regulations, reflecting the consolidation of conditions of service for members of the Defence Force. Enacted in 1983, these rules address the need to streamline and update the financial regulations governing allowances for Defence personnel, specifically those posted to unique duty locations such as Woomera and Broken Hill. This initiative was undertaken to ensure that the regulations remain relevant and effective in addressing the evolving needs of service members. The policy objective is to maintain equitable and updated financial support systems for Defence Force members, ensuring they receive appropriate allowances based on their duty locations.

Scope and Application

The Statutory Rules 1983 No. 301 issued under the authority of the Minister for Defence pertain to the amendment of the Naval Financial Regulations, specifically concerning the Woomera Allowance. This Act applies to members of the Australian Navy who are posted for duty in the Woomera locality. The legislation repeals Regulation 108 of the Naval Financial Regulations, which previously governed the payment of Woomera Allowance to these service members, and replaces it with Determination 0302, which was made under section 58B of the Defence Act 1903 as part of a legislative consolidation program for Defence Force service conditions. The Woomera Allowance is thus now subject to the new determination, which is a tri-Service determination alongside Determination 0306 for Broken Hill Allowance. The scope of this Act is limited to the financial regulations of the Navy, and it does not extend to the broader Defence Force unless explicitly mentioned. The Act's application is confined to the Commonwealth level, aligning with the authority and jurisdiction of the Minister for Defence. The Act does not detail any exclusions or exemptions beyond what is specified within the determinations themselves, which govern the specific allowances and conditions of service.

Key Provisions

The primary sections of these Statutory Rules concern the amendment of the Naval Financial Regulations, particularly focusing on the Woomera Allowance for Navy members posted to the Woomera locality (Regulation 108). According to these rules, Regulation 108 is repealed and replaced by Determination 0302 Woomera Allowance, which is part of a broader initiative to consolidate legislation concerning service conditions for Defence Force members (Section 12 of the Defence Amendment Act 1979). This consolidation is intended to streamline the legislative framework governing allowances and benefits for Defence personnel. These Statutory Rules impose specific obligations on the Defence Force, primarily ensuring that the Woomera Allowance is correctly administered to eligible Navy members posted to Woomera. The regulations require that the allowance is paid in accordance with the provisions of Determination 0302, which has now replaced the previous regulation. Additionally, minor amendments to Regulation 111 of the Naval Financial Regulations have been made to include references to both Determinations 0302 and 0306, thereby integrating the new allowances structure into the broader financial regulatory framework. The Statutory Rules do not explicitly outline offences, penalties, or civil/criminal consequences for breaches. However, it is implied that non-compliance with these regulations could result in legal repercussions under the Defence Act 1903 and other relevant legislation. Failure to adhere to the updated allowances structure could lead to financial discrepancies or administrative penalties. Although specific penalties are not detailed within these rules, the overarching legislative framework provides for enforcement mechanisms to address non-compliance.
