Overview

Statutory Rules 1965 No. 193, issued under the Naval Defence Act 1910-1965, was enacted to update and revise the Naval Financial Regulations. This legislative instrument, promulgated by the Governor-General on behalf of the Federal Executive Council, addresses the need to modernise and standardise the financial compensation for naval officers, particularly focusing on adjustments to pay rates and benefits. The amendments aim to ensure that the remuneration for officers within the Naval Emergency Reserve Forces and the Citizen Naval Forces, including those of the Medical and Dental Branches, is appropriately aligned with their ranks and service duration. By specifying new rates of active pay and updating the financial structures, the regulations seek to maintain the efficiency and morale of the naval forces, ensuring that the compensation is fair and reflective of the officers' seniority and responsibilities.

Scope and Application

The Naval Defence Act 1910-1965, as amended by these Regulations, applies to officers in the various branches of the Australian Navy, including the Medical and Dental Branches. The Regulations specifically address the amendment of the Naval Financial Regulations concerning consolidated rates of pay, medical and dental treatment, and rates of active pay for service women and officers in the Medical and Dental Branches. These amendments apply to service performed on and after specified dates, with certain provisions retroactively affecting service from July 9, 1965. The Regulations cover personnel in the Permanent Naval Forces, the Naval Emergency Reserve Forces, and the Citizen Naval Forces, thereby encompassing a broad spectrum of military personnel within the Australian Navy. The application of these Regulations is nationwide, as they are enacted under the authority of the Commonwealth of Australia, thus extending across all states and territories. Any exclusions or exemptions are not explicitly stated in the text provided, and the scope of the application is further extended or restricted through the subordinate instruments mentioned, such as the Fourth and Seventeenth Schedules to the Naval Financial Regulations.

Key Provisions

The regulations under the Naval Defence Act 1910-1965, as specified in Statutory Rules 1965 No. 193, primarily amend the Naval Financial Regulations. Regulation 15 of these financial regulations is modified to adjust the consolidated rates of pay for officers in the rank of Rear Admiral or Commodore, effective from July 9, 1965. Specifically, the new rates are £5,709 for Rear Admirals and £4,857 for Commodores, replacing the previous rates of £5,625 and £4,785, respectively. Regulation 244 has been updated to replace references to "the Department" with "the Commonwealth", signifying a change in the entity responsible for medical and dental treatments. Additionally, Regulation 252 has been revised to standardize the daily rate of active pay for service women holding the rating of Recruit Wran, aligning it with the rate for Wran in Group I. Furthermore, Regulation 254 has been repealed, and the Fourth Schedule has been replaced with a new table detailing pay rates for officers in the Medical and Dental Branches. The amendments impose clear obligations on the relevant parties. The revised pay rates must be applied to officers in the specified ranks from the effective dates mentioned. The updated reference to "the Commonwealth" for medical and dental treatments indicates that the responsibility for such treatments has shifted to the Commonwealth government. The standardised pay rate for service women in certain roles ensures uniformity in compensation across relevant ranks. The repeal of Regulation 254 and the replacement of the Fourth Schedule reflect administrative updates necessary to maintain accurate and current financial regulations for the Naval Forces. Breach of these regulations could result in non-compliance with the updated financial standards, potentially leading to disputes over pay and entitlements. While the regulations themselves do not explicitly state penalties for non-compliance, such breaches could result in legal challenges or administrative actions under the broader Naval Defence Act 1910-1965 or other relevant legislation. The maximum penalties for such breaches would depend on the specific context and the applicable laws at the time of the breach.
