Overview
Statutory Rules 1963 No. 12, enacted on 13th February 1963, constitutes a set of regulations under the Naval Defence Act 1910-1952. These regulations were introduced to address the need for amendments to the Naval Financial Regulations, specifically concerning the special allowance for medical and dental officers. Enacted by the Governor-General in Council, the primary objective of these regulations is to adjust the daily rates of special allowances for various ranks of medical and dental officers within the naval forces, effective from 1st December 1960. This legislative instrument ensures that the financial support for these essential roles is updated and accurately reflects their service requirements.
Scope and Application
The Statutory Rules 1963, No. 12, made under the authority of the Naval Defence Act 1910-1952, amend the Naval Financial Regulations to specify the rates of special allowance payable to medical and dental officers in the Australian Navy, effective from the first day of December 1960. These regulations apply to officers within the Medical Branch and Dental Branch of the Navy, determining their remuneration based on their rank. The allowances are set out in a detailed table within the amended regulation 11, ensuring that each rank from Surgeon Lieutenant to Surgeon Commodore receives a specified rate per day. This legislative instrument provides a clear framework for the financial compensation of these officers, reflecting their roles and responsibilities within the naval structure. The application of these regulations is restricted to service performed on or after the specified date, ensuring that all allowances are consistent and appropriately aligned with the effective date of the amendments.
Key Provisions
The key operative sections of these Regulations pertain to the amendment of the Naval Financial Regulations under the Naval Defence Act 1910-1952. Regulation 11 is specifically amended to revise the special allowance rates for medical and dental officers in the Navy. This amendment involves replacing the existing table detailing allowances with a new one, effective from December 1, 1960. The new rates vary depending on the rank of the officer, with amounts ranging from £2 10s. 0d. for a Surgeon Lieutenant or Surgeon Lieutenant (D) to £1 7 6d. for a Surgeon Commodore or Surgeon Commodore (D). The new rates are clearly set out in the table included within the regulation.
These Regulations impose clear obligations on both the Department of Defence and the officers of the Medical and Dental Branches of the Navy. The Department of Defence is responsible for ensuring that these updated allowances are paid to eligible officers in accordance with the revised rates. Officers of the Medical and Dental Branches, in turn, must provide the necessary service to qualify for these allowances. The application of these allowances is explicitly stated to cover service on and after December 1, 1960, as stipulated in Regulation 2.
Should there be any breaches of these Regulations, it is important to note that the consequences would stem from non-compliance with the amended Naval Financial Regulations rather than direct penalties specified in these Regulations themselves. Any failure to correctly implement or adhere to the updated allowance rates could potentially lead to disputes over pay, necessitating resolution through internal Defence mechanisms or other relevant administrative processes. While the Regulations themselves do not explicitly state penalties, any non-compliance with financial regulations could result in administrative or legal consequences, including potential financial recovery actions or disciplinary measures against the responsible officials.
