STATUTORY RULES.

1961. No. 33.

REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1952.*

I, THE ADMINISTRATOR of the Government of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910-1952.

Amendments of the Naval Financial Regulations.†

Cadet Midshipman, normal entry, in first year of training.

1. Regulation 28 of the Naval Financial Regulations is amended—

(a) by omitting from sub-regulation (3.) the words “Five shillings” and inserting in their stead the words “Ten shillings”; and

(b) by omitting from sub-regulation (4.) the word “Sixpence” and inserting in its stead the words “One shilling”.

Cadet Captains allowance.

2. Regulation 30 of the Naval Financial Regulations is amended by omitting the words—

“Cadet Captain—One shilling and sixpence per week.

Senior Cadet Captain—Two shillings per week.

Chief Cadet Captain—Two shillings and sixpence per week.” and inserting in their stead the words—

“Cadet Captain—Three shillings per week.

Senior Cadet Captain—Four shillings per week.

Chief Cadet Captain—Five shillings per week.”.

Men—General Scale of active pay.

3. Regulation 31 of the Naval Financial Regulations is amended by inserting after sub-regulation (1.) the following sub-regulation:—

“(1a.) A Junior Recruit under the age of seventeen years shall be allowed to draw only such part of his pay as his Commanding Officer approves and the remainder of the pay shall be credited to him in his pay account until he attains the age of seventeen years.”.

4. Regulation 43 of the Naval Financial Regulations is repealed and the following regulation inserted in its stead:—

Engineroom Watchkeeping Certificate allowance.

“43. An allowance, called ‘Engineroom Watchkeeping Certificate allowance’, is payable at the rate of One shilling per day—

(a) to a man holding the rating of Engineroom Artificer, Fourth Class, Mechanician, First Class, or a higher rating, who is qualified to take charge of a watch in the engineroom of a ship;

(b) to a man holding the rating of Aircraft Artificer, Third Class, or a higher rating, who was transferred from the rating of Engineroom Artificer, Third Class, or a higher rating, before the thirtieth day of May, 1952, and who was qualified for an Engineroom Watchkeeping Certificate or a Unit Watchkeeping Certificate before the date of his transfer; and

(c) to a Petty Officer Engineering Mechanic in possession of an Engineroom Watchkeeping Certificate or a Unit Watchkeeping Certificate, for any period, not being a period for which he is in hospital or sick on shore, during which he is allocated for Watchkeeping duties.”.

Higher qualification allowance.

5. Regulation 70 of the Naval Financial Regulations is amended by omitting sub-paragraphs (v) and (vi) of paragraph (a) and inserting in their stead the following sub-paragraphs:—

“(v) Tactical Communication Instructor;

(vi) Radio Communication Instructor; or

(vii) Radio (Special) Instructor; and”.

Prizes for Cadet Midshipmen, Junior Recruits, Junior Musicians and Apprentices.

6. Regulation 144 of the Naval Financial Regulations is amended by inserting after sub-regulation (1.) the following sub-regulation:—

“(1a.) Prizes of such value as the Naval Board determines shall be awarded each year to the Junior Recruits who respectively qualify for those prizes in competition at the passing out examinations of the Royal Australian Navy Junior Recruits Training Establishment.”.

Uniform allowance.

7. Regulation 178 of the Naval Financial Regulations is amended by inserting after paragraph (a) the following paragraph:—

“(aa) a Junior Recruit;”.

Replacement of uniform kit— Junior Recruit, Recruit (Junior Musician), Junior Musician and Apprentice.

8. Regulation 180 of the Naval Financial Regulations is amended by inserting after the word “being” the words “a Junior Recruit under the age of seventeen years,”.

Travel on termination of service.

9. Regulation 193 of the Naval Financial Regulations is amended—

(a) by omitting from sub-regulations (1.) and (2.) the words “Subject to sub-regulation (3a.)” and inserting in their stead the words “Subject to the succeeding provisions”;

(b) by omitting from sub-regulations (1.), (2.) and (3a.) the words “otherwise than at his own request”; and

“(5.) A member shall not be transported at the expense of the Department under this regulation where he—

(a) is discharged at his own request before he has completed 20 years continuous service;

(b) is discharged ‘fraudulent entry’;

(d) is invalided from the Service for causes within his own control.”.

10. Regulation 233 of the Naval Financial Regulations is repealed and the following regulation inserted in its stead:—

Provision of passages for families of certain married members appointed or drafted for oversea service.

“233. Subject to the succeeding provisions of this Division, where a married member is appointed or drafted for shore service or general service oversea, and it is intended that the duration of that service at the oversea destination—

(a) if the destination is Malaya, Singapore or Hong Kong—will be not less than two years; or

(b) in any other case—will be not less than twelve months, his family shall, if the Minister approves, be provided, at the expense of the Department, with passages to and from the oversea destination of the member.

11. The Fifth Schedule to the Naval Financial Regulations is amended Fifth by omitting from the Table the words and figures—
