REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1918

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910-1918, to come into operation forthwith unless otherwise stated therein.

AMENDMENT OF NAVAL FINANCIAL REGULATIONS.

(Statutory Rules 1920, No. 248.)

1. Regulation 30 is amended by adding at the end of sub-regulation (3), the words “unless otherwise approved by the Minister.”

2. Regulation 35 is amended as follows:—

(1) By omitting sub-regulation (1), and inserting the following sub-regulation in its stead:—

“(1) Kit Upkeep Allowance—

Kit Upkeep Allowance shall be granted as follows:—

Kit Upkeep Allowance shall be credited on the Ship’s Ledger in cash and be payable—

(a) as from 1st December, 1920, to all ratings who had not completed twelve months’ service on that date; and

(b) as from date of entry, to all ratings entered subsequent to 1st December, 1920.

Kit Upkeep Allowance shall continue to be credited during periods of detention. In all other cases where Deferred Pay is stopped, Kit Upkeep Allowance shall also be stopped for the same period.”

(2) By omitting sub-regulation (6), as from 1st July, 1920, and inserting the following sub-regulation in its stead:—

“(6) Gratuities to Petty Officers and Men.—Petty Officers dressed as seamen shall, on promotion to Chief Petty Officers, be paid a gratuity of £16 in addition to Kit Upkeep Allowance, towards the cost of change of uniform. Petty Officers over four years’ seniority required to change their uniform from Class II. to Class III. shall also be paid a gratuity of £16 toward cost of change of uniform.

A gratuity of £15 shall be paid, in addition to Kit Upkeep Allowance, to—

(a) Petty Officers dressed as Seamen, on transfer to the rating of Regulating Petty Officer; and

(b) Other men and boys, on transfer to a rating for which a change of uniform from Class II. to Class III. or from Class III. to Class II. is required, provided that no gratuity shall be paid when the transfer is made on account of misconduct.

In addition to the gratuity payable under the first paragraph of this sub-regulation, a further gratuity of £10 towards the cost of frock coat and sword shall be paid to Master at Arms promoted on and after 1st December, 1920.”

(3) By omitting from sub-regulation (7), as from 1st December, 1920, the second paragraph thereof and inserting in its stead the following paragraph:—

“Kit Upkeep Allowance, at the rates prescribed in sub-regulation (1), shall be credited to ratings lent from the Royal Navy commencing from the date of entry for service in the Royal Australian Navy.”

3. Regulation 38 is amended as from 1st December, 1920, as follows:—

(1) By omitting sub-regulation (18) and inserting the following sub-regulation in its stead:—

“(18) Physical Training Instructor*—

(2) By omitting sub-regulation (25) and inserting the following sub-regulation in its stead:—

“(25) Tropical Pay—

(3) By omitting sub-regulation (38) and inserting the following sub-regulation in its stead:—

“(38) Writer—

(4) By omitting from sub-regulation (39) the present rates of “2d.” and “4d.” and inserting in their stead the rates “6d.” and “9d.” respectively.

4. Regulation 39 is amended as from 1st December, 1920, by adding at the end of sub-regulation (7) the following paragraph:—

“Allowances may at the discretion of the Commanding Officer be paid at the rates specified in the following scale when the ratings employed in the bakery are engaged in addition to their ordinary duties in making bread for issue to other ships; the number of persons in receipt of bread-making allowance shall not exceed three for any one day, and no payment shall be made if the extra quantity baked is less than 120 lbs.:—

The vouchers for payment shall give full particulars in accordance with the above provisions.”

5. Sub-regulation (3) of regulation 40 is amended as from 1st December, 1920, as follows:—

(1) By omitting from sub-paragraph (a) the words—

”; or

(v) discharged at own request’ whether ‘free’, ‘by purchase’, ‘by resignation’, or ‘voluntary retirement’.”

(2) By adding at the end of sub-paragraph (a) (iii.) the word “or”.

(3) By adding at the end of sub-paragraph (d) the following:—

“The provisions of this sub-paragraph shall not apply to persons discharged ‘at own request’ whether ‘free’ ‘by purchase’, ‘by resignation’ or ‘by voluntary retirement’.”

6. Regulation 44 is amended as from 1st December, 1920:—

(1) By adding at the end of sub-regulation (3) the following:—

“, but during periods of detention Kit Upkeep Allowance only shall continue to be credited.”

(2) By inserting after sub-regulation (5) the following sub-regulation:—

“(5a) Pay for performing higher duties.—Where a senior rating is absent for a period of fourteen or more consecutive days through sickness, or on duty, and the consequent vacancy cannot be filled by drafting, the rating required to perform the higher duties of the senior rating may be paid the difference between his rate of Active and Deferred Pay received in the lower rating and the corresponding minimum rates for the higher rating.

7. Regulation 51 is amended by omitting from sub-regulation (1) the words—

“is in a civil gaol—

(a) prisoner undergoing sentence.

(b) in civil custody as a deserter or absentee, or

(c) awaiting trial for a civil or naval offence.”

and inserting in their stead the following words:—

“is—

(a) in a civil gaol as prisoner undergoing sentence,

(b) in civil custody as a deserter or absentee, or

(c) in a civil gaol awaiting trial for a civil or naval offence.”

8. Regulation 74 is amended as from 1st December, 1920, as follows:—

(1) By omitting from sub-regulation (1) the scale of Travelling Allowance and inserting in its stead the following scale:—

(2) By omitting from sub-regulation (4) the words “shall draw the rates of Lodging Allowance specified in regulation 35, sub-regulation (11), only, in addition to Ration Allowance” and inserting in their stead the following words:—

“shall, after the expiration of the first fourteen days’ absence from their ship or depôt, become entitled to Ration and Lodging Allowances only, as specified in regulation 35 sub-regulations (10) and (11) respectively.”

(3) By omitting sub-regulation (7) and inserting in its stead the following sub-regulation:—

“(7) Officers and men when absent over forty-eight hours and entitled to Travelling Allowance, shall have deducted there from the amount of Victualling Allowance, if any, credited to them on the Ship’s ledger in respect of such absence.

The number and date of cash voucher on which Travelling Allowance is paid shall be noted in the remarks column of the ledger, and a notation made on the voucher whether or not Victualling Allowance has been credited to the Officer or man concerned.”

(4) By inserting after the words “Naval Board” in the second line of sub-regulation (22) the words” or the Secretary”.

9. Regulation 75 is amended as from 1st December, 1920, as follows:—

(1) By omitting sub-regulation (1) and inserting in its stead the following sub-regulation:—

“(1) The following shall be the rates of Travelling Allowance payable to—

(i) members of the Royal Australian Naval Auxiliary Services;

(ii) Officers holding a rank or relative rank and in receipt of consolidated rates of pay; and

(iii) other persons on consolidated rates of pay not holding a rank or relative rank when travelling on duty and required to be absent from head-quarters or temporary head-quarters over night:—

(2) By adding after the words “numbered (5) to (17) inclusive”, in sub-regulation (4), the words “and regulation 76”.

(3) By omitting sub-regulation (5).

(4) By adding at the end thereof as from 1st July, 1920, the following sub-regulation:—

“Luncheon Allowance (18).—Members of the Royal Australian Naval Reserve Staff detailed to attend Military Courses of Training away from their head-quarters in city or suburban areas and required to obtain their mid-day meal away from their usual place of residence may be paid a luncheon allowance not exceeding 1s. 6d. per diem for each whole-day attendance.”

(5) By omitting sub-regulations (15), (16), and (17) and inserting in their stead the following sub-regulation:—

“Scale of Meal Allowance when Travelling.—(15) Members of the Royal Australian Naval Auxiliary Services, Officers holding rank or relative rank, and persons not holding rank or relative rank in receipt of consolidated rates of pay detached for temporary duty and required to travel for periods which do not necessitate absence over night from their head-quarters or temporary head-quarters, may receive Meal Allowance, as set forth in the following conditions:—

(a) Members absent from their head-quarters or temporary head-quarters during at least two meal periods shall, subject to the provisions of sub-paragraph (c), be paid for meals as under:—

(i) Where a member is absent for at least twelve hours, and such absence covers three meal periods, actual expenses incurred for three meals may be paid.

(ii) Where a member is absent during two meal periods payment of expenses necessarily incurred for one meal only may be paid.

(b) Where a member is absent during one meal period only, no payment will be made.

(c) The amount payable in respect of meals shall be the actual amount necessarily expended, but in no case shall the amount allowable exceed the following rate:—

(d) No payment shall be made to meet expenditure on any meal obtained before the following hours:—

(6) Sub-regulation (18) is renumbered (16).

10. Regulation 78 is amended by omitting the scale in sub-regulation (4) and inserting in its stead the following scale:—
