Application.

8.—(1.) This regulation applies in a case where a member has received or is entitled to receive active pay in accordance with regulation 31, 32, 33, 34, 35, 36 or 37, or sub-regulation (3.) of regulation 252, of the Naval

Financial Regulations in respect of a day in the period from and including the third day of May, 1963, to and including the day immediately preceding the commencement of these Regulations.

(2.) The rate of active pay applicable under the Naval Financial Regulations during the period referred to in the last preceding sub-regulation shall, in a case to which this regulation applies, be increased by an amount equal to the amount by which that rate is less than the rate of active pay that would have been applicable if the amendments made by these Regulations had taken effect on the third day of May, 1963.

By Authority: A. J. Arthur, Commonwealth Government Printer, Canberra.

Overview

The Statutory Rules of 1963, No. 61, titled "Regulations Under the Naval Defence Act 1910-1952," was enacted to address the need for amendments to the existing Naval Financial Regulations. The regulations were made under the authority of the Governor-General in Council, acting on the advice of the Minister of State for the Navy. These amendments primarily aimed to update the active pay rates for various ranks and roles within the Naval Dockyard Police, apprentices, and servicewomen. The objective was to ensure that the compensation structure remained fair and competitive, reflecting the changes in the economic environment and the increasing cost of living. The regulations introduced adjustments to daily and weekly pay rates, taking into consideration factors such as seniority, age, and specific roles within the Navy.

Scope and Application

The Regulations under the Naval Defence Act 1910-1952, made on 16th July 1963, pertain to the financial regulations governing the remuneration of personnel within the Royal Australian Navy. These regulations apply to all members of the Naval Dockyard Police, including those who joined on or after 28th March 1951, as well as other ranks such as Sergeants, Constables, and various ratings within the Navy. The amendments cover active pay for apprentices, servicewomen, and specific roles such as Artificers, Mechanics, and Artisans, with variations based on seniority and service length. The financial adjustments apply nationally, across all Commonwealth naval jurisdictions, and retroactively from 3rd May 1963, ensuring backdated pay adjustments for eligible personnel. The regulations include detailed tables that specify pay rates based on rank, seniority, and other qualifying factors. This legislative instrument provides a comprehensive framework for updating and standardising naval personnel pay scales within the specified parameters.

Key Provisions

The Regulations, under the Naval Defence Act 1910-1952, primarily amend the Naval Financial Regulations. Specifically, Regulation 36 (section 1) adjusts the pay rates for members based on their years of seniority, while Regulation 37 (section 2) does the same for Sergeants and Constables. Regulation 79 (section 3) modifies the rates of active pay for apprentices based on their stage of training and age. Furthermore, Regulation 79a (section 4) increases the rate of active pay for members and Cadet Midshipmen. Regulation 252 (section 5) updates the pay rates for servicewomen, and Regulation 252a (section 6) increases the pay for officers of the Women’s Service. The Fifth, Sixth, Seventh, Eighth, and Tenth Schedules (section 7) are replaced with new tables detailing pay rates for various ratings and seniority levels across different categories. These Regulations impose clear obligations on the parties they govern, particularly on the members of the Naval Dockyard Police and the apprentices. They must ensure their pay is aligned with the updated rates based on their seniority and role. Servicewomen and officers of the Women’s Service must also be compensated according to the new rates set forth. The amendments require these entities to review and possibly adjust their payroll systems to reflect the new financial regulations. Failure to comply with these updated pay scales could result in underpayment of wages, which might lead to disputes and legal challenges. The Regulations do not explicitly outline specific offences, penalties, or consequences for breaches. However, failure to comply with the updated pay scales could be seen as a breach of employment terms, potentially leading to disciplinary actions under the Naval Defence Act. In severe cases, this could result in termination of service or other penalties as deemed appropriate by the relevant authorities. The precise consequences would depend on the specific circumstances and the internal policies of the Naval Dockyard Police.
