Overview

The Statutory Rules 1964, No. 50, enacted on 3 April 1964, amends the Naval Financial Regulations to adjust the rates of pay and allowances for various ranks within the Australian Navy. This legislative instrument was made under the authority of the Naval Defence Act 1910–1952, and it was notified in the Commonwealth Gazette on 9 April 1964. The primary objective of this amendment is to update the financial compensation for service personnel, ensuring it reflects current economic conditions and the cost of living. By revising the rates of pay for senior officers and the allowances for travel and residence, the legislation aims to maintain the competitiveness and attractiveness of naval careers within the Australian Defence Force.

Scope and Application

The Statutory Rules 1964, No. 50, applies to the officers of the Royal Australian Navy in the ranks of Rear-Admiral, Commodore, First Class, and other subordinate ranks as listed in the amended regulations. This legislative instrument amends the Naval Financial Regulations to alter the rates of pay and allowances for these officers, effective from 23 December 1963. The changes pertain to the adjustment of specific monetary values for ranks and the introduction of a new table for daily travelling allowances based on the location and rank of the officer. Additionally, the regulations adjust the reduction of allowance amounts when subsistence or accommodation is provided. The Act applies to the Commonwealth of Australia and extends its reach to all members of the Royal Australian Navy affected by these amendments, without any stated exclusions or exemptions. The application of this Act may be further extended or restricted through subordinate instruments as necessary.

Key Provisions

The Statutory Rules 1964, No. 50 primarily amend the Naval Financial Regulations concerning the pay rates and allowances for naval officers and personnel. Under section 1(1), the rate of pay for Rear-Admiral and Commodore, First Class is amended, increasing from £4,800 to £5,153. This new rate applies to service in these ranks from 23 December 1963 onwards. Section 2(1) revises the travelling allowance rates in Australia, introducing a new table that specifies the daily allowance based on rank and location of residence, whether in a capital city or elsewhere. For instance, a Rear-Admiral residing in a capital city receives £4 18s 0d per day for the first twenty-one days, while a Lieutenant residing in a non-capital city location receives £4 50s 300d per day. Furthermore, section 2(2) removes sub-regulation 2a. Section 3 amends Regulation 203 by replacing the table for the reduction of allowances when subsistence or accommodation is provided, detailing the rates per day for various ranks based on their location of residence in a capital city or elsewhere. The obligations imposed by these regulations on the parties concerned include adherence to the specified pay rates and allowances. Naval officers and personnel must ensure their entitlements and obligations are aligned with the updated financial regulations. For example, Rear-Admirals and Commodores, First Class, must now be compensated at the new rate of £5,153, while their travelling allowances must comply with the newly prescribed rates detailed in the amended Regulation 201. These regulations also mandate that any reductions in allowances must be calculated according to the new rates specified in Regulation 203. Any breaches of these financial regulations could result in civil or administrative consequences. While the statutory rules do not explicitly outline penalties for non-compliance, failure to adhere to the amended rates and allowances could potentially lead to disputes over pay and allowances, necessitating resolution through the appropriate naval or legal channels. The seriousness of any breach and the resultant penalties would depend on the context and the specific provisions of the Naval Defence Act 1910–1952, under which these regulations are made.
