Overview
The Naval Financial Regulations 1956 (Amendment) Statutory Rules 1981 No. 400 were introduced to address gaps in the financial provisions for members of the Citizen Naval Forces, specifically regarding outfit allowances and uniform provisions. Enacted by the Minister of State for Administrative Services on behalf of the Minister of State for Defence, the amendments sought to ensure that members of the Citizen Naval Forces who undertake continuous full-time service for more than 12 months receive the same benefits as their counterparts in the Permanent Naval Forces. This legislative instrument was designed to provide clarity and equity in financial support for all naval service members, aligning their entitlements with their period of service. The policy objective was to standardise and update financial regulations to reflect the evolving nature of service commitments within the Citizen Naval Forces.
Scope and Application
The Interim Determination under section 12 of the Defence Amendment Act 1979, made by the Minister of State for Administrative Services on behalf of the Minister of State for Defence, specifically applies to the Citizen Naval Forces and members of the Permanent Naval Forces who have rendered continuous full-time service of more than 12 months. The amendments to the Naval Financial Regulations 1956, as detailed in Statutory Rules 1981 No. 4001, modify the provisions concerning outfit allowances and uniforms for these categories of service personnel. This legislative instrument adjusts the eligibility criteria for outfit allowances to include members of the Citizen Naval Forces who serve for more than 12 months, while simultaneously excluding officers in the Permanent Naval Forces who exceed the same service duration from certain uniform entitlements. The regulations are intended to clarify and update the financial and uniform provisions applicable to different categories of naval service members, thereby ensuring consistency and fairness in the application of these allowances and entitlements.
Key Provisions
The main operative sections of the Interim Determination amend the Naval Financial Regulations in two key areas. Firstly, under Regulation 168, an outfit allowance is now extended to a member of the Citizen Naval Forces who begins a period of continuous full-time service exceeding 12 months. Secondly, under Regulation 295, the provision of a uniform is amended to exclude officers who have rendered a period of continuous full-time service exceeding 12 months. These amendments clarify the eligibility criteria for outfit allowances and uniform provisions within the Citizen Naval Forces.
The obligations and requirements imposed by the Interim Determination pertain primarily to the administration of financial allowances and uniform provisions for members of the Citizen Naval Forces. The amendment to Regulation 168 ensures that any member of the Citizen Naval Forces who commits to a continuous full-time service period of over 12 months is eligible for the outfit allowance. Conversely, the amendment to Regulation 295 specifies that officers who have served continuously for more than 12 months are not entitled to a uniform. These changes necessitate that administrative processes are updated to reflect the new eligibility criteria for financial and uniform benefits.
In terms of consequences for breach, the Interim Determination itself does not explicitly outline offences, penalties, or civil/criminal consequences for non-compliance. However, given that these amendments are made under the Defence Amendment Act 1979, any failure to adhere to these regulations could potentially lead to disciplinary actions or other administrative penalties as prescribed under the broader Defence Act framework. The precise penalties would depend on the nature and severity of the breach, as well as the specific rules governing the enforcement of the Defence Act and its associated regulations.
