Overview

The Regulations Under the Naval Defence Act 1910-1952 were enacted in 1963 by the Governor-General in Council. This legislation aimed to amend the Naval Financial Regulations to address the need for updated and fair remuneration structures for various categories of officers and personnel within the Royal Australian Navy. The changes included adjustments to the rates of active pay and special allowances for medical, dental, and chaplain officers, as well as cadet midshipmen. Additionally, the regulations repealed certain sections of the previous regulations and replaced them with new schedules that more accurately reflected the changes in rank and pay seniority. This was done to ensure that the financial compensation provided to personnel in the Royal Australian Navy was aligned with the duties and responsibilities associated with their roles. The purpose of these amendments was to provide equitable compensation to naval personnel and maintain their morale and efficiency, thereby supporting the overarching policy objective of maintaining a well-equipped and capable defence force. The regulations were made under the authority of the Governor-General in Council, reflecting the legislative power of the Australian federal government to enact laws and regulations for the governance of the nation's defence forces.

Scope and Application

The Naval Defence Act 1910-1952 provides the legislative basis for the Regulations under which these amendments to the Naval Financial Regulations are made. The Regulations primarily apply to members of the Australian Defence Force, specifically those in the Naval Force, including officers and personnel who are receiving or entitled to receive active pay. The application extends to various categories of officers, including medical and dental officers, chaplains, and cadet midshipmen, among others. The Regulations are applicable nationally, as they govern financial matters across the Commonwealth of Australia. There are no specific exclusions or exemptions mentioned in the text, though the applicability of the amended rates of pay and allowances would be contingent on the specific conditions and periods outlined within the Regulations themselves. The scope of the Regulations is further extended through subordinate instruments, which may provide additional details and specifications regarding the implementation and enforcement of the amended financial regulations.

Key Provisions

The primary operative sections of these Regulations amend the Naval Financial Regulations, which govern the financial entitlements of personnel within the naval forces of Australia. These amendments pertain specifically to the active pay and special allowances for various ranks and categories of naval personnel. Regulation 3 removes Part IIIA concerning variations of active pay for officers and men, while Regulation 9 modifies the reference to the appropriate division in the Third Schedule for determining active pay. Regulation 10 revises the pay rates for medical and dental officers, and Regulation 11 adjusts the rates for chaplains, based on their years of service. Regulation 12 updates the rates for Cadet Midshipmen according to their training stage and age. Regulation 251 introduces a new table for officers' active pay rates based on their rank and seniority, and Regulation 252A repeals the variation of active pay for officers. The Third and Fourth Schedules are also repealed and replaced with updated rates of active pay for different categories of officers. These Regulations impose specific obligations and requirements on the relevant parties, ensuring that all personnel receive the correct active pay and allowances as per the updated schedules. The amendments require the updating of pay records to reflect the new rates and the proper calculation of any retroactive increases in active pay for personnel who were in service before the Regulations took effect. The updated rates must be applied consistently across all ranks and categories to ensure fairness and accuracy in financial entitlements. The Regulations do not explicitly outline offences, penalties, or civil/criminal consequences for breaches. However, any failure to comply with the updated financial regulations could potentially lead to disputes over pay, which might be subject to resolution through the established internal grievance and dispute resolution mechanisms within the naval forces. Any significant non-compliance could also result in administrative actions, such as audits and financial reviews, to ensure adherence to the legislative requirements.
