EXPLANATORY STATEMENT

STATUTORY RULES 1984 NO. 72

ISSUED BY THE AUTHORITY OF THE MINISTER FOR DEFENCE

AMENDMENT OF THE NAVAL FINANCIAL REGULATIONS

Section 12 of the Defence Amendment Act 1979 allows the Minister to make interim determinations amending or repealing regulations. The Act also deems such interim determinations to be Statutory Rules.

Regulation 168 of the Naval Financial Regulations provides for the payment of Outfit allowance to officers and sailors of the Australian Naval Reserve and the Naval Emergency Reserve Forces rendering a period of continuous full-time service of more than twelve months and to members of the Permanent Naval Forces for the purchase of or alterations to their uniforms. Regulation 176 of the Naval Financial Regulations provides for an allowance to members of the Permanent Naval Forces employed on special duties. Sub-regulation 295(1) of the Naval Financial Regulations applies the provisions of regulation 168 to other members of the Australian Naval Reserve and the Naval Emergency Reserve Forces.

As part of the consolidation of legislation covering conditions of service for members of the Defence Force, Outfit Allowance is now given legal effect by Determinations 0602, Outfit Allowance, and 0698, Outfit (Relacing of Uniform) Allowance, made under section 58B of the Defence Act 1903. The provisions of regulation 176 are no longer required.

These Statutory Rules repeal regulations 168 and 176 and omit sub-regulation 295(1) of the Naval Financial Regulations.

The date of effect is the date Determination 0602 is made.
