Overview

The Statutory Rules 1925, No. 222, titled "Regulations Under the Naval Defence Act 1910-1918," was enacted to amend various regulations under the Naval Defence Act, providing the necessary adjustments to ensure the smooth operation and administration of the naval forces. This legislative instrument was introduced to address administrative discrepancies and to update the financial regulations governing the personnel within the Royal Australian Navy, thereby ensuring that the compensation and allowances were aligned with the evolving needs of the service and its personnel. The regulations were made by the Governor-General in Council under the authority granted by the Naval Defence Act 1910-1918, with the aim of providing a structured framework for the remuneration and allowances of naval officers and ratings, thereby maintaining the efficiency and effectiveness of the naval operations. These amendments were intended to bring about necessary changes to the financial provisions for various ranks within the Navy, including adjustments to pay rates, eligibility for pensions, and other allowances, thereby reflecting the policy objective of ensuring fair and equitable compensation within the naval service. The changes were intended to streamline and clarify the administrative processes, thereby enhancing the overall operational readiness and morale of the naval personnel.

Scope and Application

The Regulations under the Naval Defence Act 1910-1918, as amended by Statutory Rules 1925, No. 222, primarily apply to the personnel and administrative operations of the Australian Naval Defence Force, ensuring that their financial regulations are updated to reflect changes in service roles, pay scales, and eligibility criteria for various allowances and benefits. These regulations govern the pay and conditions for various ranks and roles within the naval service, including the amendment of pay rates for positions such as Leading Printer, P.O. Printer, and C.P.O. Printer, with specific increments tied to years of service. They also modify the eligibility criteria for pension payments, stipulating that members who retired prior to a certain date must have completed ten years of continuous service to be eligible, excluding those who retired under specific acts or receive pensions from other sources. These regulations are binding within the Commonwealth of Australia and extend to all naval personnel affected by the changes outlined, with specific dates noted for the implementation of new rates and eligibility conditions.

Key Provisions

The primary operative sections of these regulations concern amendments to the Naval Financial Regulations, which are detailed in Regulation 23. This section introduces new pay rates for various ranks of printers within the naval service, including Leading Printer, Petty Officer Printer, and Chief Petty Officer Printer, with incremental increases based on years of service (Regulation 23). Additionally, Regulation 33, sub-regulation (1), revises the pay rates for Paymaster Midshipman and Paymaster Sub-Lieutenant, establishing their respective salaries upon promotion and confirmation (Regulation 33(1)). Regulation 37 modifies the rates for certain classes of rations, while Regulation 38 adjusts the specified amount for a particular allowance from £14 to £12 (Regulation 38(1)(d)). Regulation 52 revises the per diem rates for shorthand typists, increasing the higher grade rate to 16 shillings and introducing a new lower grade rate of 9 shillings (Regulation 52(32), (50)). Regulation 69 removes sub-regulations (3) and (4), while Regulation 78b introduces eligibility criteria for retirement payments, specifying that only those who have completed ten years of continuous service and did not retire before 5 December 1924 are eligible, among other exclusions (Regulation 78b(1), (6)). Lastly, Regulation 164 increases the specified amounts in paragraphs (i) and (iv) from £2 to £5 (Regulation 164(1)). These regulations impose specific obligations on various personnel within the naval service. For instance, they mandate the updated pay rates for different ranks and positions as specified. These changes are effective from specified dates, such as 1 April 1925 for Paymaster Midshipman and Paymaster Sub-Lieutenant, and 1 September 1925 for shorthand typists (Regulations 33(1), 52(32)). Additionally, Regulation 78b outlines stringent eligibility criteria for retirement payments, which must be met by service members to qualify for any payments under this regulation (Regulation 78b(1), (6)). The regulations also delineate the penalties and consequences for non-compliance. While specific penalties are not detailed in the text, breaches of these financial regulations may result in disciplinary action, as outlined in the broader Naval Defence Act 1910-1918. Furthermore, failure to adhere to the specified pay rates and allowances could lead to financial discrepancies and potential legal repercussions for both the service members and the naval administration. The omission of certain sub-regulations, such as in Regulation 69, may also imply that any previous allowances or provisions covered by those sub-regulations are no longer applicable.
