Overview

The Statutory Rules 1964, No. 60, made under the Naval Defence Act 1910-1952, address several amendments to the Naval Financial Regulations, which were enacted to refine the financial entitlements and allowances for naval officers and cadets. This legislative instrument, issued on 4 May 1964 and notified in the Commonwealth Gazette on 8 May 1964, primarily aims to update and enhance the existing regulations concerning furlough, extended leave, and pay in lieu of leave. The policy objective is to provide clarity and structured benefits for naval personnel, ensuring that allowances are accurately defined and entitlements are fairly administered. These amendments include the introduction of a Chief Cadet Captain’s allowance, the regulation of presentation to Chief Cadet Captains upon their passing out, and the specification of uniform allowances, thereby improving the overall administrative efficiency and fairness within the naval financial system.

Scope and Application

The Statutory Rules 1964, No. 60 made under the Naval Defence Act 1910-1952 primarily focus on amendments to the Naval Financial Regulations, impacting various allowances and provisions for members of the naval service, particularly those in leadership roles such as the Chief Cadet Captain. The regulations apply to all members of the naval forces and specifically address financial allowances and benefits. For example, the insertion of a new regulation regarding the Chief Cadet Captain’s allowance stipulates an additional weekly allowance of Five shillings. Furthermore, the regulations provide for a presentation allowance at the Chief Cadet Captain's passing out, subject to Naval Board approval and a cost limit set by the Minister. Additionally, the regulations introduce provisions for pay in lieu of leave for members whose service terminates, excluding furlough and extended leave. These regulations are applicable nationwide as they are promulgated under Commonwealth legislation, thereby extending their reach across all states and territories of Australia. The exclusions and thresholds are implicitly defined within the text, focusing on specific roles and conditions under which allowances and benefits are applicable.

Key Provisions

The statutory rules introduced under the Naval Defence Act 1910-1952 primarily amend the Naval Financial Regulations. Section 1 modifies Part XIII of these regulations by replacing the heading “Furlough and Extended Leave” with “Furlough, Extended Leave and Pay in Lieu of Leave” (Regulation 3). Furthermore, it introduces a new regulation 250a, which allows the Naval Board to authorize payment to a member equivalent to the amount of pay for any leave accrued but not taken by the member before the termination of their service (Regulation 250a). Section 2 replaces Regulation 30 with a new regulation that introduces a ‘Chief Cadet Captain’s allowance’ of Five shillings per week, payable to a Chief Cadet Captain in addition to any active pay and allowances (Regulation 30). Section 3 repeals Regulation 145 and replaces it with a new regulation that allows a Chief Cadet Captain, upon officially passing out of the College, to be presented, with the approval of the Naval Board, with a token of appreciation of their services at departmental expense, the cost of which does not exceed an amount determined by the Minister (Regulation 145). Section 4 amends Regulation 178 by adding the words “under the age of seventeen years” at the end of paragraph (aa) (Regulation 178). Finally, section 5 repeals the heading to Part XIII of the Naval Financial Regulations and replaces it with the heading “Furlough, Extended Leave and Pay in Lieu of Leave” (Part XIII heading). These regulations impose specific financial obligations on the Naval Board, including the payment of a Chief Cadet Captain’s allowance and the authorization of payment in lieu of leave for terminated members. The regulations also provide a mechanism for the presentation of a token of appreciation to a Chief Cadet Captain upon their official passing out of the College, subject to approval by the Naval Board and within a cost limit determined by the Minister. The inclusion of the words “under the age of seventeen years” in Regulation 178 suggests additional considerations or limitations for individuals under that age. Breaching the provisions of these regulations could lead to various consequences. For example, failure to adhere to the allowance payment or leave payment regulations could result in financial discrepancies or disputes over entitlements. Non-compliance with the presentation regulation could lead to unauthorized expenditures or gifts, potentially affecting the integrity of the approval process. The maximum penalties for such breaches are not explicitly stated in the provided text, but they could potentially include financial penalties or disciplinary actions against the parties involved, depending on the severity and nature of the breach.
