REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1918.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910-1918, to come into operation forthwith.

Naval Financial Regulations.

PART I.

PRELIMINARY.

Citation.

1. These Regulations may be cited as the Naval Financial Regulations.

Repeal.

2. The Naval Financial Regulations (Statutory Rules 1920, No. 248, as amended to present date) are hereby repealed, save as to any right, privilege, obligation, or liability acquired, accrued, or incurred thereunder.

Definitions.

4. In these Regulations, unless the contrary intention appears—

“Naval Board” means the Board of Administration for the Naval Forces.

“Secretary” means the Officer appointed to be Secretary to the Naval Board, or such other official as the Naval Board may authorize to act for him.

“Commanding Officer” means the Officer in actual command of one of H.M.A. Ships or Naval Establishments.

“Officer-in-Charge” means the Officer in charge of a Naval Establishment or Office or District Naval Officer appointed to command a District.

“Director of Navy Accounts” means the Officer appointed to be Director of Navy Accounts in the Office of the Naval Administration, or such person as may be appointed by the Naval Board to perform the duties of the position during his absence.

“Accountant Officer” means the Officer in charge under the Commanding Officer of cash, victualling, and clothing duties.

“Certifying Officer” means the Officer appointed by the Naval Board to certify accounts and approve the payment thereof.

“Accounts Officer” means the Officer responsible for the receipt and payment of Public Moneys in Naval Establishment or Office.

“Executive Officer” means an Officer of the Executive Branch of the Forces.

“Minister” means the Minister of State administering the Naval Defence Act 1910-1918.

PART II.

GENERAL.

5. Officers-in-Charge and Commanding Officers shall be responsible for enforcing due economy on all Officers and others charged with any expenditure of public money, or with the care, use, or expenditure of stores.

6. It is the duty of every member of the Naval Forces to assist in carrying out these Regulations.

7. (1) The King’s Regulations und Admiralty Instructions shall constitute no authority for expenditure in the Royal Australian Navy.

(2) References in these Regulations to the King’s Regulations and Admiralty Instructions refer to the 1913 edition.

8. Commanding Officer and Officers-in-Charge shall not vary any payments provided for under Regulations.

Advances.

9. The Director of Navy Accounts or the Accountant Officer of one of H.M.A. Ships or the Certifying Officer at an Establishment or Office on whose books a member is borne for pay, may authorize any other Certifying Officer to make an advance to such member on account of pay or travelling expenses, provided that the amount advanced does not exceed the total amount due to the member at date of the advance.


Disallowances.

10. An Accountant Officer or Certifying Officer shall be liable for the amount of disallowances arising from errors or over issues made by him, in disregard of regulations or in the absence of proper authority.

Charges for use of furniture and mess traps.

11. (1) A charge at the rate of 7½ per cent. per annum shall be made on the value of furniture supplied to an official residence and on the value of a billiard table provided for the use of an Officers’ Mess.

(2) A charge at the rate of 8 per cent. per annum shall be made on the value of mess traps supplied to an official residence.

(3) Similar charges may also be made on the value of furniture and mess traps supplied to Government quarters.

(4) The Minister may waive or vary any of the charges referred to in this regulation.

(5) The percentage charges on furniture and mess traps shall be made on the official valuation. A revaluation may be made at intervals not exceeding five years and also at the time of a change in tenancy.

Rent chargeable for quarters.

12. (1) When any person to receipt of consolidated rates of pay occupies for purpose of residence, the whole or part of a building belonging to or occupied by the Commonwealth, a deduction of 10 per centum from such person’s salary or wages shall be made as rent therefor, except as provided in sub-regulation (2).

(2) The Minister may fix the rent to be charged to any person on a basis other than the foregoing, or may waive altogether the charge for rent.

(3) In calculating for any purpose the rate of salary or wages of such person, the amount so deducted for rent shall be deemed and taken to be part of his salary.

(4) An officer or a man on sea-going rates of pay, in occupation of official married quarters, shall pay such rent for the premises as is approved by the Minister.

(5) The Officer-in-Charge shall be responsible, in all cases, for the abatement from salary or wages of the necessary charges for rent of quarters.

Fuel and light.

13. A person in receipt of consolidated rates of pay, who is in occupation of official quarters, shall not be provided with fuel or light at Government expense, unless the Order in Council appointing such person expressly provides that one or more of such services are to be allowed, or unless the Minister approves of one or mort of such services being supplied.

PART III.

PAY AND ALLOWANCES.

Rates of Pay—Officers (Sea-going).

14. (1) The daily rates of active pay prescribed in regulations 15 to 23 inclusive, the rates of allowances prescribed in regulations 33 to 54, and the rates of deferred pay as prescribed in regulation 56 shall apply, where not otherwise stated, to Officers serving in the Permanent Naval Forces (Sea-going).

(2) Rank or relative rank specified shall be as defined in the King’s Regulations and Admiralty Instructions.

(2) A Probationary Engineer Sub-Lieutenant shall receive pay and allowances as laid down for Engineer Sub-Lieutenants on promotion.

(3) An allowance for Engineer duties is included in the scale of pay for officers of the Engineering Branch up to Commander’s rank inclusive. The rates prescribed in sub-regulation (1) for the Engineering Branch will be paid continuously while an officer is employed on Engineering duties. A Lieutenant (E) or Lieut.-Commander (E) who reverts to Deck duties shall, whilst employed on such duties, receive pay on the scale of the Executive Branch.

(4) The conditions regarding the commencement of (E) pay for Sub-Lieutenants (E) and Lieutenants (E) shall be as approved by the Naval Board.

(3) A Warrant Officer whose total emoluments as a rating on the date immediately preceding his promotion to Warrant Rank, exceeded the amount to which he would be entitled as a Warrant Officer may, on the approval of the Naval Board, be paid a special rate of pay. Such a case shall be dealt with in accordance with the conditions governing similar cases in the Royal Navy.

(4) The Mechanical Branch (column “A”) shall include the ranks of Warrant Engineer, Commissioned Engineer, Engineer-Lieutenant, Engineer-Lieutenant-Commander, Warrant Mechanician, Commissioned Mechanician, Warrant Shipwright, Commissioned Shipwright, and Shipwright-Lieutenant, Warrant Electrician, Commissioned Electrician, Warrant Ordnance Officer, Commissioned Ordnance Officer, and Officers promoted to the ranks of Lieutenant and Lieutenant-Commander in their respective branches from the foregoing ranks.

(5) The Non-Mechanical Branch (column “B”) shall include the ranks of Gunner, Commissioned Gunner, Gunner (T), Boatswain, Commissioned Boatswain, Signal Boatswain, Commissioned Signal Boatswain, Warrant Telegraphist, Commissioned Telegraphist, Warrant Wardmaster, Commissioned Wardmaster, Warrant Master-at-Arms, Commissioned Master-at-Arms, Warrant Writer, Commissioned Writer, Warrant Supply Officer, Commissioned Supply Officer, Warrant Instructor in Cookery, Commissioned Instructor in Cookery, Head Schoolmaster and Chief Schoolmaster (old system), and Officers promoted to the ranks of Lieutenant and Lieutenant-Commander in their respective branches from the foregoing ranks.

Definition of service

24. (1) Service in rank on the Active List, for the purpose of increments in pay, shall include all time actually served on full pay in that rank by an Officer on the Active List of the Royal Navy, Royal Australian Navy, or Navy of any of His Majesty’s Dominions.

(2) All previous service in the Royal Navy, Royal Marines, or in the Navy of any of His Majesty’s Dominions shall be allowed to count as if served by a rating in the Royal Australian Navy towards “Service” for seniority, pay, good conduct badges, and allowances. Ratings re-entering the service shall not count their former service towards progressive pay when the period of absence has exceed five years, except in such special cases as may be approved by the Naval Board.

Increments

25. (1) Increments of pay shall be subject to such condition as may be approved by the Naval Board.

(2) In the case of an officer “Provisional” time shall count for increments of pay, but “Acting” time shall not so count. Temporary Acting Warrant Officers will, however, be allowed the same increments of full pay as authorized for confirmed Warrant Officers, R. A. N., of similar rank.


(3) Time prior to and in desertion shall, under no circumstances, count as service for purposes of increment, but time served prior to disrating may count towards progressive pay on restoration to rating,

Retention of Old Rates of Pay.

26. Leading Seamen who, on the date these Regulations come into force are in receipt of progressive pay, under special Naval Board authority, although not passed professional examination for Petty Officer, may continue to be paid as such, but progressive pay is not to be paid in such circumstances in any further cases.

Excess Numbers.

27. Officers or ratings in excess of the authorized number of any rank or rating may be carried on the strength, provided there are vacancies in the higher rank or rating and that the total establishment is not exceeded.

Officers of the Royal Navy.

28. (1) Officers of the Royal Navy serving in the Permanent Naval Forces (Sea-going) prior to 1st October, 1922, may elect to receive either the rates of active pay and allowances prescribed for their relative ranks in the Royal Navy or these prescribed in these Regulations. The following Royal Australian Navy allowances shall be payable, at the rates and under the conditions set forth in these Regulations, in lieu of the corresponding Royal Navy allowances, where such Officers elect to receive Royal Navy rates of pay:—

(a) Ration Allowance.

(b) Lodging Allowance.

(c) Travelling Allowance.

(2) Officers of the Royal Navy appointed to the Royal Australian Navy on and after 1st October, 1922, shall receive the rates of Active Pay and Allowances prescribed for their respective ranks in these Regulations.

(3) Deferred pay shall not be credited to Officers of the Royal Navy whether in receipt of Royal Navy or Royal Australian Navy rates of pay.

Half-pay List.

29. Officers placed on the half-pay list shall receive pay at the daily rate of one-half of the active pay prescribed for their rank, but shall not be entitled to deferred pay or allowances of any nature whatsoever.

Officers on the Retired and Emergency Lists.

30. (1) An Officer on the Retired or Emergency List called up for duty in time of war or emergency shall receive pay and allowances at the rates prescribed for an Officer of corresponding rank in the Permanent Naval Forces (Sea-going), including Deferred Pay, provided that—

(a) an Officer who has been promoted after being placed on the Emergency List shall receive the full pay and allowances prescribed for the higher rank; and

(b) unemployed time on the Retired or Emergency List shall not count towards increments in full pay governed by seniority.

(2) An Officer on the Emergency List voluntarily re-employed in time of peace in the Permanent Naval Forces (Sea-going) shall receive pay and allowances at the rates prescribed for an Officer of corresponding rank in the Seagoing Forces, provided that—

(a) unemployed time on the Emergency List shall not count towards increments in pay; and

(b) deferred pay shall not be credited.

(3) An Officer on the Emergency List called upon to undergo a course of instruction shall be paid at the rates prescribed for such Officers voluntarily re-employed in peace time.


Medical Officers Serving in Civil Hospitals and Undergoing Courses of Study.

31. (1) Pay shall not be made from Naval Funds to Surgeon Lieutenants who, at the time of entry into the Medical Branch, are permitted to serve for a period not exceeding one year in a civil appointment at a recognised civil hospital, but the time so served shall count for purposes of increments in active and deferred pay, if approved by the Naval Board.

(2) Medical Officers undergoing courses of study in approved Medical Schools may be credited with the pay and allowances of their respective ranks in the Permanent Naval Forces (Sea-going).

Appointment as Aide-de-camp.

32. The appointment of an Officer as an Aide-de-camp shall not entitle him to any pay or allowances in respect of the appointment.

ALLOWANCES—GENERAL.

Outfit Gratuities on Entry and Promotion.

33. (1) An Outfit Gratuity may be paid to an Officer on first joining, or on promotion to Officer rank, or on confirmation of appointment, in accordance with the following scale:—

(2) Officers transferred from another branch of the Royal Australian Navy, or from the Royal Navy direct or appointed within twelve months of the date of their retirement from the Royal Navy shall receive no gratuity on transfer or appointment.

Officers discharged within twelve months of entry—Recoveries to be made on monthly basis.

(3) In the event of discharge except by invaliding within twelve months of grant of clothing gratuity, a proportionate part of gratuity for the unexpired period is to be recovered from the Officer concerned, on a monthly basis. Recovery will be made on the basis of one-twelfth for each full month of the unexpired period.


Equipment Allowance to officers on the Emergency List.

34. An Officer on the Emergency List voluntarily re-employed in the Permanent Naval Forces (Sea-going) will be granted an Equipment Allowance at a rate prescribed in the subjoined scale, provided that no such Officer shall receive any such allowance if less than three years shall have elapsed between the date of his resignation from the Active List and the date of his re-employment, and that an Officer may be paid equipment allowance only once in any period of five years—

Outfit Gratuity to Officers on the Emergency List.

35. When called up for service in time of war or national emergency, an Officer on the Emergency List shall receive the Outfit Gratuity of £30 under the conditions prescribed in this regulation for Officers appointed for temporary service in the Permanent Naval Forces (Sea-going).

Free issue of Kit.

36. (1) Every rating engaging for more than three years’ service shall, on first entry, be supplied at Government expense with a full uniform kit applicable to his rating.

(2) A rating whose engagement in the Royal Navy expires whilst on loan to the Royal Australian Navy, and who engages for a period in the Royal Australian Navy, Service being continuous, shall not receive any free issue of kit on effecting such engagement.

(3) A former rating of the Royal Navy, Royal Australian Navy, or Royal Fleet Reserve, who engages in the Royal Australian Navy within six months of discharge, shall not receive any free issue of kit on engagement except in special circumstances, with the approval of the Naval Board.

(4) A former rating of the Royal Navy, Royal Australian Navy, or Royal Fleet Reserve, who engages in the Royal Australian Navy, after an interval of not less than six months, for a period of more than three years, shall be supplied, on engagement, with the full free kit as approved by the Naval Board.

(5) A person entered from shore for three years or less, including a former rating of the Royal Navy, Royal Australian Navy, or Royal Fleet Reserve, discharged more than six months prior to re-entry, shall receive a gratuity or a free issue of articles of kit not exceeding half the value of a full kit, as may be approved by the Naval Board.

Kit Upkeep Allowance.

37. (1) Kit Upkeep Allowance Shall be granted to ratings as follows:—

Class I.—1s. per diem commencing from date of entry.

Class II.—10d. per diem commencing from date of entry.

Class III.—1s. per diem commencing from date of entry.

(2) Kit Upkeep Allowance shall continue to be credited during periods of detention. In all other cases where deferred pay is not credited, vide sub-regulation 7 of regulation 55, Kit Upkeep Allowance shall also be stopped for the same period.

Ratings on Loan from Royal Navy.

(3) Kit Upkeep Allowance, at the rates prescribed in sub-regulation (1). shall be credited to ratings lent from the Royal Navy, commencing from the date of entry for service in the Royal Australian Navy.


Outfit gratuities on Change of Class, of Uniform

38. (1) The following Outfit Gratuities shall be paid, in addition to the Kit Upkeep Allowance, to all ratings, including these lent from the R.N., who are obliged to change their uniform from Class II. to Class I. or Class III., or from Class III. to Class II.:—

In addition to the gratuity payable under the sub-paragraph (a) above a further gratuity of £10 towards the cost of frock coat and sword shall be paid to Master-at-Arms on promotion.

Change in class of Uniform consequent, upon transfer in Rating

(2) When a man or boy is transferred, owing to unsuitability for the rating held to another rating involving change in class of uniform, he shall be paid an Outfit Gratuity, as prescribed in sub-paragraphs (c) or (d) above, but the articles in the compulsory kit of his former rating no longer required in the rating to which he is transferred shall be sold. No Outfit Gratuity shall be paid when the transfer in rating is attributable to misconduct.

Members on Loan from Royal Navy not entitled to Gratuity or Free Kit.

(3) Uniform gratuities shall not be payable to Officers and men lent from the Royal Navy, nor will a free kit be issued in such cases, except as provided in sub-regulation (1).

Recoveries from Men Discharged within Two Years of Entry

39. (1) In the event of discharge of men at own request within two years of entry, a charge shall be made against deferred pay of £1 10s. per month in the case of Ratings Classes I. and III., and of £1 5s. per month in the case of Ratings Class II., for each full month of the unexpired portion of two years. A similar charge shall be made in all cases of discharge within two years where deferred pay is not forfeited, except that in the case of men invalided no charge is to be made. In the case of ratings discharged within two years of entry, other than by invaliding, being in debt or having insufficient credit of deferred pay to cover the charge referred to in the foregoing, the kit, or portion thereof, shall be recovered and sold, except such as is necessary to meet immediate requirements. Any balance received for sale of kit shall be paid to the rating.

(2) In the event of the amount of deferred pay and the sum realized from the sale of kit being insufficient to meet the charge to be recovered in accordance with the foregoing, no deduction shall be made from active pay on that account.

Compensation for Losses of Uniform, &c

40. (1) The Naval Board may approve of the payment of compensation to an Officer or man who, being on duty may lose, in action with the enemy, by fire, shipwreck, or other casualty of the Service, any necessary articles of clothing or equipment, or any books, instruments, or tools used in connexion with his duties.

(2) No claim shall be admitted for losses sustained when proceeding on or returning from leave of absence, nor for the loss of money or civilian clothing, the property of the individual.


Deserters’ Uniforms.

41. Recovered deserters are not to be treated as new entries. The kit of a deserter if not sold before his recovery may be restored to him. If his kit has been sold, he should be supplied with a reduced kit (as laid down in the Uniform Regulations), to be charged against his pay and allowances.

Issue of Civilian Suit.

42. (1) Ratings about to be discharged from the Sea-going Forces—

(a) Dismissed with disgrace;

(b) Dismissed; and

(c) Services no longer required on account of misconduct, who, at date of discharge, are in debt to the Crown, may be supplied gratuitously with a civilian suit, the cost of which shall not exceed 32s. 6d.

(2) Where the pay account of the rating about to be discharged in the manner stated in the preceding paragraph is in credit, such rating may be supplied with a civilian suit on repayment, the cost of which, not exceeding 32s. 6d., shall be recovered from the pay due on discharge.

Lodging Allowance—Daily Rate.

Lodging allowance payable when residing at home.

(2) In cases where Lodging Allowance is paid owing to quarters not being available and the officer or man resides at his own home, the rates of Lodging Allowance shall be the foregoing rates, less the amount of Married Allowance, if any, drawn.

(3) Lodging Allowance shall not be credited when a member is on leave for periods exceeding four days.

Lodging Allowance—Annual Rate.

44. (1) Officers (Sea-going) of the Royal Australian Navy, who are appointed to positions on shore, and are not provided with accommodation, shall be paid Lodging Allowance at the following rates provided that, where the period of service ashore does not exceed one month, Officers shall be paid the difference between the daily and annual rates of Lodging Allowance prescribed in this sub-regulation:—

(2) Payment of Lodging Allowance at the annual rate shall continue to be made when an Officer proceeds on recreation leave, or on sick leave, provided the Officer is not accommodated in hospital.


(3) Payment of Lodging Allowance at the annual rate shall also continue to be made.

(а) for the first seven days whilst an Officer is accommodated in hospital; and

(b) for the first seven days only when temporarily absent from Head-Quarters and travelling allowance is drawn under the conditions prescribed in Sub-regulation (7) of regulation 97.

Provided, always, that the lodgings are retained and paid for during the period.

(4) In calculating Lodging Allowance at the annual rate, the amount payable shall be ascertained by multiplying the annual rate by the number of days in the period of calculation and dividing the result by 365.

(5) Married Allowance shall not be payable concurrently with the annual rate of Lodging Allowance to an officer who resides, or is able to reside, at his own home.

Married Allowance—Rate of.

(3) Commissioned Officers from Warrant rank in receipt of “on promotion” rates of pay shall receive 2s. per diem Married Allowance. Married Allowance—Condition of payment.

(5) The conditions as set forth in the following sub-paragraphs shall govern payment of Married Allowance.

(а) In the case of an Officer, an allotment must be declared in favour of his wife of not less than one-third of his active pay (excluding allowances) plus full amount of Married Allowance payable.

(b) In the case of a Chief Petty Officer, Petty Officer, or man an allotment must be declared in favour of his wife of not less than one-half of his active pay (excluding allowances) plus full amount of Married Allowance payable.

(c) For the purposes of determining the amount of monthly allotment to be declared in each case in respect of Married Allowance, a month shall be reckoned as 30 days.

The necessary allotment should commence from the first day of the month following credit of Married Allowance.

(d) Married Allowance may be paid to widowers with children subject to an allotment in favour of a guardian of not less than one-quarter active pay (excluding allowances) plus full amount of Married Allowance payable. If the children are in the care of more than one guardian, a separate allotment in favour of each guardian shall be made, and the total amount of such allotments shall equal or exceed one quarter of active pay (excluding allowances) plus the full amount of Married Allowance.

(e) Married Allowance will be payable irrespective of place of residence of wife, or of guardian in the case of a widower, provided the necessary allotment is made.

(f) Married Allowance may be paid in regard to step-children and adopted children under sixteen years of age, provided that the member claiming the allowance maintains such children and that they are not in receipt of endowment from any other source.

(g) During periods of detention or imprisonment not exceeding 90 days, the allotment should be continued at a rate not less than the amount of Married Allowance which would have been payable to the rating the debt accumulated by such allotment may be recovered in easy instalments, or in the event of discharge communicated to Navy Office for recovery from deferred pay.

(h) The payment of Married Allowance shall be entirely subject to the pleasure of the Naval Board, who may withhold the whole or part of the allowance as may be considered desirable.

Dependant Allowance.

46. (1) When Married Allowance is not drawn, Dependant Allowance at the rate of 2s. per diem may be paid to—

(i) Commissioned Officers from Warrant rank in receipt of “on promotion” rates of pay.

(ii) Warrant Officers irrespective of the rate of pay received.

(iii) Ratings.

in respect of a dependant residing in Australia requiring support, subject to an allotment of one-half of the active pay (excluding allowances) of the Officer or man, plus the amount of Dependant Allowance credited.

(2) Commissioned Officers from Warrant rank in receipt of pay as Commissioned Officer from Warrant rank “after three years’ seniority” or Commissioned Officer from Warrant rank “after six years’ seniority” may be paid Dependant Allowance under similar conditions at the rate of 1s. per diem only.


(3) Commissioned Officers from Warrant rank in receipt of pay as Commissioned Officer “after nine years’ seniority,” shall not be entitled to this allowance.

(4) Dependant Allowance shall not be credited without the prior approval of the Naval Board and shall, generally, be limited to cases of mothers being widows or of the father being permanently incapacitated by age or infirmity from earning wages exceeding £2 per week. Such Allowance shall not be payable where there are unmarried sons not serving in the Naval or Military Forces, or daughters in receipt of wages exceeding £2 per week, or where the allottee possesses income of like amount. An Allowance at the minimum rate may also be approved by the Naval Board in any other special case where Married Allowance is not already paid and dependence upon the member of the Permanent Naval Forces (Sea-going) is clearly established, subject to residence in Australia and to the above limitation as to private income.

(5) A War Pension may be disregarded as income for the purpose of the foregoing, and Dependant Allowance may be paid to a widow or other female relative provided she does not possess other income exceeding £2 per week.

(6) Payment of Dependant Allowance shall be entirely subject to the pleasure of the Naval Board, who may withhold the whole or part of the Allowance as may be considered desirable.

(7) Dependant Allowance shall not be included in the daily rate of pay for the purposes of mulcts, being regarded for that purpose similarly to Lodging, Ration, and Married Allowances. Payment of Dependant Allowance shall not, however, be made when a rating is in cells, civil prison, or undergoing detention.

(8) During periods of detention or imprisonment not exceeding 90 days, the allotment shall be continued at a rate not loss than the rate of Dependant Allowance. As allotment will be continued in such circumstances at the rate of, at least, £3 per month, when the ordinary allotment is stopped on discharge of a man to cells, civil prison, or detention quarters, a charge shall be made against his pay in respect of an allotment at the reduced rate.

(9) The debt accumulated by payment of the allotment as proscribed in sub-regulation (8) may be recovered by easy instalments from the pay of the rating. In the event of discharge, the debt incurred shall be communicated to the Director of Navy Accounts for recovery from deferred pay.

General Condition.

47 All allowances shall be subject to such conditions as may be approved by the Naval Board.

ALLOWANCES TO OFFICERS.

Table Money.

48. (1) The Officer appointed to command H. M. A. Fleet shall be entitled to Table Allowance at such rate as may be approved by the Minister, on the recommendation of the Naval Board, not exceeding £4 10s. per diem.

(2) Payment of Table Allowance to this Officer shall be subject to the conditions, where such can be applied, prescribed in the King’s Regulations and Admiralty Instructions for payment of such allowance in the Royal Navy.

49. (1) The rates of Allowances to Officers shall be as prescribed in the following sub-regulations, but these Allowances shall be paid only during the actual employment specified, or under the special circumstances set forth, and no increase shall be made in deferred pay on account of same. The conditions governing payment of the undermentioned Allowances contained


in King’s Regulations and Admiralty Instructions or in Admiralty Fleet Orders shall apply in the Royal Australian Navy unless otherwise specified:—

51. When the Accountant Officer (the rank allowed by complement being not below Paymaster Lieutenant-Commander) is absent from the ship continuously for upwards of three months otherwise than on leave, the Paymaster Lieutenant, Paymaster Sub-Lieutenant, or Paymaster Midshipman performing his duty, although not holding an acting order as Paymaster Lieutenant-Commander, may, on the approval of the Naval Board, be granted additional pay ; but the special remuneration thus granted shall not exceed the difference between the Officer’s own rate of pay and the lowest rate of pay for a. Paymaster Lieutenant-Commander. A full report of the circumstances shall be made to the Naval Board in order that the rate payable may be decided.

52. (i) The rates of allowances to Petty Officers and men shall be as prescribed in the following sub-regulations, but these allowances shall only be paid during the actual employment or whilst the qualification specified is held and under the special circumstances set forth, and no increase will be made in deferred pay on account of same. (a) The period for which payment is made is to count only from the time of entering to that of leaving the water; and should the work be subsequently found to be improperly done, the Captain, at his discretion, may cancel the whole or any portion of the payment.

(b) Artificer Divers, when actually employed at their trade under water on repair or construction work, and when not paid a bonus or gratuity, are to be paid half a day’s pay of their substantive rating for every hour, and proportionately for parts of an hour, in addition to the Diving Pay to which they may be entitled for the several depths.

(c) For recovery of articles, a bonus not exceeding £1 or one-fourth the value of the article may be given in lieu of payment by scale, of which bonus one-tenth is to be paid to the Attendant.

(d) A gratuity, not exceeding £5, may be given in lieu of payment by scale, in exceptional circumstances requiring dispatch, and for important skilled work satisfactorily performed, of which gratuity one-eighth is to be paid to the Attendant.

(e) Only one first hour rate is to be paid for any one day, but in cases of diving at two different depths payment may be made at whichever first hour rate is more advantageous to the Diver.

Pay for performing higher duties—Petty Officers and other rating.

53. Where a senior rating allowed by the complement is not borne, or if borne, is absent on duty or on account of sickness, or for any other reason except leave of absence, for a period of fourteen or more consecutive days, and the consequent vacancy cannot be filled by drafting, a junior rating whilst performing the duties of the absent senior rating, may receive extra pay for the higher duties provided real and definite responsibilities are involved. The amount of such extra pay shall be made up of the total difference between the rate of Active and Deferred Pay received in the lower rating and the minimum rate of Active and Deferred Pay of the higher rating.

(5) To any Officer or man, when acting as shorthand writer at Courts Martial, Courts of Inquiry, &c., under competent authority, and other important investigations as defined in Admiralty Orders—for each folio of 100 words, 9d. (to cover both notes and transcription), but with a minimum payment of 5s.

Good Shooting and Torpedo Proficiency Prizes.

(8) In every ship not supplied with stationery in kind, in which a Naval Schoolmaster is borne or a competent person detailed to perform the duties of Schoolmaster, expenditure within the following limits may be approved by the Commanding Officer for the purpose of supplying slates, paper, and school necessaries for the use of the men and boys attending the school, and for supplying the requirements of the Schoolmaster:—

DEFERRED PAY OF PERMANENT NAVAL FORCES (SEA-GOING).

Payment of deferred pay

55. (1) Deferred pay in accordance with the scale prescribed in regulation 56 shall be allowed to accumulate to the credit of every officer and man entered for service in the Permanent Naval Forces (Sea-going); provided that deferred pay shall not be credited to any officer on the Active List of the Royal Navy serving in the Permanent Naval Forces (Sea-going).

(2) Interest at the rate of 3½ per cent. shall be credited annually on the 30th June in each year on the amount of accumulated Deferred Pay standing at credit of each member on 30th June of the previous year, provided that a full year’s interest shall be allowed only on amounts which have stood to the credit of the member for a full year. Interest added to Deferred Pay Account shall be considered as part of accumulated Deferred Pay and shall bear interest accordingly.

In the event of any member or his estate becoming entitled to receive Deferred Pay on account of discharge, expiration of engagement, resignation, death, or for any other reason as provided in these Regulations, interest on the amount of accumulated Deferred Pay standing at credit on 30th June prior to the date on which he or his estate became entitled to payment of Deferred Pay in the circumstances aforementioned shall be allowed from 1st July to the end of the month in which payment of Deferred Pay becomes due.

The Deferred Pay Account of an Officer or man shall be closed when payment is made in full of the amount accumulated, or when payment is made on expiration of an engagement. In the event of an officer or man re-entering the Service or continuing in the Service after drawing Deferred Pay, no interest shall be allowed in respect of any amount at credit prior to the closing of the account.

(3) Payment of Deferred Pay and accumulated interest will become payable in the following circumstances:—

(i) Officers—

(a) Upon final discharge from the Active List of the Sea-going Forces, except as provided in sub-regulation (4), provided that officers placed on half-pay prior to termination of their services may be paid accumulated Deferred Pay at any time after the date of their ceasing to draw full pay.

(b) Upon being invalided from the service for causes beyond the officer’s control.

(c) Upon the death of the officer whilst serving.


(ii) Petty Officers and Men

(a) Upon completion of the engagement into which entered.

(b) Upon completion of each period of re-engagement.

(c) Upon transfer to the R.A.N. Auxiliary Services.

(d) Upon discharge to Shore, excepting as provided in sub regulation (4).

(e) Upon being invalided from the Service for causes beyond the rating’s control.

(f) Upon the death of the rating whilst serving.

(4) No person who is—

(i) discharged “Run”;

(ii) dismissed from His Majesty’s Service with disgrace;

(iii) dismissed from His Majesty’s Service;

(iv) discharged from the Service as “Services no longer required” or whose services are dispensed with on account of misconduct; or

(v) discharged at own request whether by voluntary retirement or resignation,

shall be entitled to any payment under this regulation.

(5) No payments in respect of accumulated Deferred Pay shall be made other than in the circumstances prescribed in sections (i) and (ii) of sub-regulation (3) of this regulation, but the Naval Board may, in special circumstances, restore the whole or any portion of the Deferred Pay which, but for the reasons set out in sub-regulation (4) of this regulation, would have been payable. Such cases under section (i) of sub-regulation (4) shall generally be limited to cases where “Run” has been removed.

(6) Contributions by the Commonwealth towards pension rights of men lent from the Royal Navy shall be deducted from amounts credited to these men on account of Deferred Pay.

(7) Deferred Pay shall not be credited in any of the following circumstances:—

(a) During imprisonment or detention (either summarily or by Court Martial);

(b) during imprisonment following conviction by a Civil Court;

(c) during confinement in cells; or

(d) during sick leave granted without pay.

(e) Officers placed on the Half-pay List shall not be credited with Deferred Pay.

(8) In every case where Active Pay is drawn by ratings, Deferred Pay allowed shall be credited. Mulcts for leave-breaking or deductions on account of being in 2nd Class for conduct, and Sick leave on reduced pay shall not affect Deferred Pay.

57. The allowances provided in regulations 33 to 54 inclusive shall not be applicable to Officers, Petty Officers and men of the Permanent Naval Forces in receipt of consolidated rates of pay.

Hospital Courses.

58. Where Medical Officers of the Permanent Naval Forces (Sea-going) are required to undergo a six months’ course of study at an approved Medical school prior to presenting themselves for examination for the rank of Surgeon Lieutenant-Commander, or where Senior Medical Officers of over fourteen years’ seniority are permitted to undergo a special three months’ course in approved subjects, the Naval Board may approve of payment, from Commonwealth Funds, of the whole or a portion only of the fees for such courses.

Second Class Conduct.

59. A deduction of one-sixth shall be made from the active pay and substantive allowances of men in the second class for conduct.

Cells, Detention.

60. Ratings undergoing the punishments of Cells or Detention shall not be borne for pay, but during periods of detention, kit upkeep allowance shall continue to be credited.


Concealment of Contagious Disease.

61. Any person guilty of concealment of a contagious disease may be subjected to stoppage of the whole of his pay during such period as he may be under medical treatment and absent from duty.

Gratuity and Allowance for Good Conduct Medal.

62. (1) A gratuity of £20 shall be payable to members of the permanent Naval Forces (Sea-going), including Royal Navy ratings, who become entitled to the award of the Long Service and Good Conduct Medal under the conditions laid down in the King’s Regulations and Admiralty Instructions.

(2) An Allowance of £1 per annum, in addition to the gratuity, may also be paid at the end of each engagement or upon discharge for each completed year of service assessed as “Very Good” subsequent to the date of award of the medal, but payment shall not be made in respect of uncompleted years, nor for more than a period of seven years.

(3) Royal Navy ratings serving in the Royal Australian Navy who become eligible for the Royal Navy Medal and Gratuity shall not be entitled to the Royal Australian Navy Gratuity and Allowance in addition to the award provided in King’s Regulations and Admiralty Instructions, nor shall any rating be eligible for the gratuity and allowance who would have become entitled to the Long Service and Good Conduct Medal prior to 1st January, 1920, but for the fact that his character had not been continuously assessed as “Very Good.”

Recruits—Capitation and Medical Fees.

63. (1) A Capitation Allowance of £1 may be granted in respect of each recruit finally entered in the Permanent Naval Forces (Sea-going) to the person who has been responsible for the recruit’s application for entry. Provided that no payment shall be made to a Commissioned Officer of the Defence Forces. Capitation Allowance shall be paid only to such classes of persons, or individuals, as the Minister may approve.

(2) A fixed fee of 10s. 6d. per capita shall be paid to Military Area Medical Officers for the examination of Naval Recruits at places where there is no Naval Medical Officer available.

Deserters—Forfeiture of Pay. &c.

64. (1) A person who deserts from the Royal Australian Navy shall forfeit all active pay, allowances, and deferred pay due to him to the date of his desertion, and shall forfeit all past service for the purposes of furlough, of Good Conduct Badges, and Long Service and Good Conduct Medal.

(2) The Naval Board may, in the case of recovered deserters in special circumstances, approve of the restoration of any portion of the pay, allowances, deferred pay, or service forfeited by the act of desertion.

Deserter’s effects.

65. (1) The Captain shall cause the clothes and effects of a deserter to be delivered into the charge of the Accountant Officer, together with an inventory signed by two or more persons.

(2) After the expiration of three months from the date of desertion the Captain shall authorize the clothes and effects of a deserter to be sold on board by auction.

(3) The proceeds of such sale shall be credited by the Accountant Officer to revenue.

Rewards for recovery of deserters.

66. (1) Rewards for arrest of absentees and deserters may be paid as follows:—

Up to a limit of £1 for a straggler.

Up to a limit of £3 for a deserter or presumed deserter.

(2) The amount of the reward, within above limits, shall be at the discretion of the officer issuing the warrant, and shall, together with cost of his own passage to his Ship or Depôt be charged against the pay of the deserter or straggler earned subsequent to arrest.


Purchase of Discharge.

67. (1) Petty Officers and other ratings may, in peace time, be permitted, subject to the approval of the Naval Board, to purchase their discharge on the following terms:—

(a) Up to, but not exceeding one month from date of first entry, £10.

(b) After one month, but not exceeding three months from date of first entry, £20.

(c) After three months from date of first entry:—

Boys under eighteen years of age, £40.

Men—

Up to four years’ service since date of engagement, £48.

Over four years and up to six years’ service since date of engagement, £36.

Over six years’ service since date of engagement, £24.

Time served as boy shall not be allowed to count as “service.”

(d) After re-engagement, £20, and refund of any re-engagement gratuity paid.

Service must be actual service in receipt of wages, as recorded on the Service Certificate.

(2) In special circumstances, the Naval Board may approve of the discharge of a rating without payment of purchase money, or may reduce the amount of purchase money required in the above scale.

Re-entry after Discharge by Purchase.

68. Ratings, except boys, discharged by purchase from the Royal Australian Navy, and subsequently allowed to re-engage in the service within a period of two years from date of their discharge, may, on the approval of the Naval Board, be refunded one-half of the amount paid for discharge in each case, or the full amount paid when deferred pay has been forfeited, provided an engagement to serve for five years is executed on re-entry of the rating concerned.

R. A. N. AUXILIARY SERVICES (NON-SEA-GOING).—PAY AND ALLOWANCES.

Rates of pay.

69. (1) the following consolidated rates of pay, inclusive of maintenance of uniform and of all allowances except travelling and other allowances specially provided shall apply to—

Rates on Appointment.

(2) The commencing rate of pay on appointment to the Auxiliary Services shall be determined according to the rank or rating and the seniority last held in the Permanent Naval Forces (Sea-going), provided that a Petty Officer of four or more years’ seniority in the Sea-going Force who is granted the rating of Chief Petty Officer on the Royal Australian Naval Reserve Staff shall receive the minimum pay of that rating.

(3) General Workmen and Workmen, on appointment to the Auxiliary Services, shall be graded in accordance with the scale set forth below, and salary within a grade shall be determined by the seniority in rating last held in the Permanent Naval Forces (Sea-going), provided that former Chief Petty Officers shall be appointed at the maximum salary of Grade II.:—

High Cost of Living Allowance

70. (1) In addition to salary, a High Cost of Living, Allowance may to paid to members of the Auxiliary Services of and below the rank of Warrant Officer, who are in receipt of consolidated rates of pay not exceeding £500 per annum, at the following rates:—

provided that in the case of a widower with children under the age of 16 years who maintains his own home and employs a paid housekeeper or a person other than a daughter or sister to act in that capacity, the allowance for an adult dependant, under sub-paragraph (a), may be paid in respect of the eldest dependent child under 16 years of age in lieu of Children’s Allowance under sub-paragraph (c) and (e).

(2) Payment of the High Cost of Living Allowance shall be approved subject to the following conditions:—

(a) The total salary inclusive of High Cost of Living Allowance payable must not exceed £500 per annum. Where the annual salary plus the High Cost of Living Allowance would exceed £500 per annum, the High Cost of Living Allowance is to be reduced so that the total amount payable will not exceed £500 per annum.

(b) To Married Members—For wife provided that the member is maintaining her and that no legal or mutual separation exists.

(c) To Married Members and Widowers with Children

(i) For each child (including step-children) under the age of 14 years, provided that each child is not contributing to its own support and is wholly and solely dependent upon the member.

(ii) For each adopted child under 14 years of age, provided that the Deed of Adoption or other satisfactory evidence of adoption is sighted, and that the child is not contributing to its own support and is wholly and solely dependent on the member. In such cases the member must not have received or be in receipt of any payment in respect of such adoption.

(iii) For parents (including step-parents) and brother and sisters under 14 years of age, provided that they are wholly and solely dependent on the member and are not in receipt of any income whatsoever, including War, Old-age, or Invalid Pension.

(iv) For sister keeping house for a member who is a widower with children dependent upon him, provided such sister is wholly and solely dependent on the member.


(d) To Single Members and Widowers without Children

(i) For parents (including step-parents) and brothers and sisters under 14 years of age, provided that they are wholly and solely dependent on the member and are not in receipt of any income whatsoever, including War, Old-age, or Invalid Pension.

(ii) For each adopted child under 14 years of age, provided that the Deed of Adoption or other satisfactory evidence of adoption is sighted, and that the child is not contributing to its own support and is wholly and solely dependent on the member. In such cases the member must not have received or be in receipt of any payment in respect of such adoption.

(e) Payment of High Cost of Living Allowance will be entirely subject to the pleasure of the Naval Board who may withhold the whole or part of this allowance in any case when considered desirable.

(3) Adult single employees ineligible for High Cost of Living Allowance may, if so entitled, receive an Allowance to bring the total salary to £174 per annum, under the conditions approved by the Naval Board.

(4) The High Cost of Living Allowance herein referred to shall be regarded its part of the member’s rate of pay for the purpose of ascertaining the pay for which the member is eligible when granted leave or furlough. When payment of a lump sum gratuity is granted in lieu of extended leave or furlough under regulation 144 or 145, the High Cost of Living Allowance shall be included in the payment in respect of the whole period covered by the gratuity at the rate which the member was entitled to receive at date of termination of appointment.

(5) Members of the Naval Dockyard Police shall be paid Child Endowment prescribed in sub-regulation (1) (c) of this regulation.

Increments.

71. All increments shall be subject to such conditions as may be approved by the Naval Board and to the necessary provision on Estimates being approved. “Acting” time served in a rank or rating shall not count for purposes of increments of pay.

Gratuity and Allowance for Good Conduct Medal.

72. Chief Petty Officers, Petty Officers, and other ratings on the Royal Australian Naval Reserve Staff whose combined service in the Permanent Naval Forces (Sea-going) and on the Royal Australian Naval Reserve Staff entitles them to the award of the Royal Australian Navy Long Service and Good Conduct Medal may be paid the gratuity of £20 and the Allowance of £l per annum, subject to compliance with the conditions prescribed in regulation 89 of these Regulations for ratings in the Permanent Naval Forces (Sea-going).

Officers on Sea-going List.

73. Officers on the Sea-going List of the Permanent Naval Forces lent to the Auxiliary Services shall receive the rates of pay and allowances prescribed for their corresponding ranks in the Permanent Naval Forces (Sea-going).

Leave due on transfer.

74. An officer or man transferred from the Permanent Naval Forces (Sea-going) to the Auxiliary Services, who is permitted to carry forward recreation leave due may, with the approval of the Naval Board, and subject


to the existence of vacancies on the appropriation, continue to be borne on the books of one of H. M. A. Ships or Establishments on Sea-going rates of pay and allowances from the date of his transfer for a period equal to the amount of recreation leave due, and the leave shall subsequently be taken at consolidated rates of pay only.

Men lent from the Sea-going Forces.

75. Chief Petty Officers and Petty Officers of the Permanent Naval Forces (Sea-going) lent for service on the Royal Australian Naval Reserve Staff of the Auxiliary Services shall continue to receive the rates of pay and allowances prescribed for their corresponding ratings in the Permanent Naval Forces (Sea-going).

District Allowances.

76. District Allowances on the same scale as paid to members of the Commonwealth Public Service may be paid to all members of the Permanent Naval Forces in receipt of consolidated rates of pay while residing in any district or locality for which a District Allowance has been approved under Public Service Regulations.

Uniform Gratuities on First Appointment.

77. (1) On first appointment to the Auxiliary Services, direct from the shore, after the expiration of six calendar months from discharge or resignation from the Permanent Naval Forces (Sea-going) or other Naval Forces, the following uniform gratuities will be payable:—

(2) Persons appointed to the Auxiliary Services within six months of their resignation or discharge from the Permanent Naval Forces (Sea-going) or other Naval Forces will be granted uniform gratuities in accordance with the scale set forth in sub-regulation (1) above, subject to deduction therefrom of the value of the necessary articles of uniform in their possession at the date of first appointment to the Auxiliary Services.

(3) Persons permanently transferred to the Auxiliary Services direct from the Permanent Naval Forces (Sea-going) will not normally be eligible for uniform gratuities set forth herein, but when such transfer involves a change in class of uniform, the District Naval Officer or Commanding Officer may approve of the payment of uniform gratuities not exceeding the maximum rates prescribed in sub-regulation (1) of this regulation.

(4) Uniform gratuities prescribed in sub-regulation (I) of this regulation shall not be payable again on re-engagement in the Auxiliary Services.

(5) On first appointment to the Naval Dockyard Police, uniform as approved by the Naval Board shall be provided at Government expense, or a uniform gratuity in lieu may be paid at the following rates:—

(2) No gratuity shall be paid on change of uniform from Class II. to Class III. or from Class III. to Class II. where such change is in consequence of the transfer of a member at his own request or owing to misconduct.

(3) A member of the Permanent Naval Forces (Sea-going) in receipt of sea-going rates of pay who is lent to the Auxiliary Services shall be entitled to Uniform Gratuity and Kit Upkeep Allowance at the rates prescribed in these Regulations for members of the Sea-going Forces.

Allowances to Naval Reserve Chaplains.

79. (1) Allowances for religious ministrations to seamen may be paid to persons appointed as Naval Reserve Chaplains, as prescribed in the following sub-regulations:—

(2) In the case of occasional ministrations, e. g., at ports which are not regularly visited by a ship or squadron, at the rate of 6d. per head per service of these actually attending the services.

(3) At ports where ships are more or less permanently stationed, and the duties performed include visitation of the crews and the sick in hospital in addition to the conduct of Divine Service, at the rate of £1 6s. per head per annum, based on the average number, taken quarterly, of officers and men of the particular denomination present at the port on each Sunday morning during the period the ministrations are given. The numbers shall be communicated by the Senior Officer to the Chaplain on his requisition.

(4) Where it is necessary for the Chaplain to hold a special separate service exclusively for the benefit of seamen, an allowance of £1 for each such service may be paid in addition to the capitation allowance.

(5) Payment of the allowances prescribed in the regulation shall be subject to such conditions as may be approved by the Naval Board.


PART IV.

VICTUALLING.

Rations.

80. Rations shall be supplied to officers and men of Permanent Naval Forces (Sea-going), subject to such conditions as may be determined by the Naval Board.

Victualling Allowance.

81. (1) Except in such cases as may be approved by the Naval Board, Ships and Establishments shall be victualled under the General Messing System at a rate of 1s. 9d. per head per diem. This allowance may also be paid in lieu of the Standard Ration and Messing allowance, subject to such conditions as may be determined by the Naval Board.

(2) Officers shall, subject to such conditions as may be prescribed, draw the Victualling allowance in cash.

(3) The rates to be charged for provisions issued on repayment to the General Mess and to a Repayment Mess shall be as set forth in the Fixed Issuing Price List approved by the Naval Board.

(4) Articles, the price of which is not otherwise provided for by the Naval Board, shall be issued at cost price.

Standard Ration.

82. (1) The daily standard ration for ships not victualled on the General Messing System shall be as follows:—

(3) The Naval Board may approve of the above scale being varied in special circumstances, provided that the total value of the daily Standard Ration is not exceeded.

Messing Allowance.

83. In addition to the daily standard ration prescribed in regulation 82, an allowance of 9d. per diem shall be payable in cash to the Messes of Officers and Men who are victualled in kind on the standard ration.

Leave Allowance.

84. When rations in kind are not supplied during periods on leave exceeding 48 hours, an allowance at the rate of 1s. 9d. per diem shall be paid in lieu of rations. This allowance shall not be paid on account of week-end leave.

Provision Allowance.

85. When rations in kind are not supplied during periods of absence on detached duty, an allowance at the rate of 3s. per diem shall be paid, provided that this allowance shall not be paid to parties of twelve or more persons when working together on detached duty and able to form a mess.


Debit balance in General Mess Account.

86. The Naval Board may in exceptional circumstances, and on production of satisfactory evidence, release an Accountant Officer of a portion or the whole of the liability resulting through a debit balance in the General Mess Account.

Mess savings.

87. Mess savings shall be paid to the Mess Caterer.

Extra Issues.

88. Extra issues other than for ordinary meals shall not be charged against the Messing allowance, but shall be included in the Provision Account, and credit taken for same at the end of each quarter or period of account.

Replacement of excess breakages due to unusual circumstances.

89. Excess breakages of mess utensils, due to stress of weather or circumstances other than neglect, may, at the Captain’s discretion, be replaced free of charge to the messes.

Liability for value of condemned provisions.

90. An Accountant Officer shall be liable to the Crown for any losses resulting from the condemnation of provisions obtained in excess of requirements.

Mess expenses for official visits.

91. Expenses incurred by Officers’ Messes in entertaining official visitors shall not be allowed as a charge against Government funds, except in exceptional circumstances approved by the Naval Board.

Auxiliary Services.

92. (1) A member of the Auxiliary Services shall not be eligible for any issue of rations in kind or to payment in lieu thereof except as provided in sub-regulation (2) hereunder and in regulations 104 and 105.

(2) A member of, or an employee attached to, the Royal Australian Naval Reserve Staff employed in a camp of training or engaged on duty ashore in time of war or emergency on continuous or other duty which necessitates his absence overnight from his usual place of residence, shall be entitled to issue of rations in kind, in accordance with the scale and at the rate approved for a member of the Permanent Naval Forces (Sea-going).

PART V.

COMPENSATION FOR INJURIES.

Assessment.

93. (1) Compensation may be recommended by a Medical Board appointed to inquire into the case of any member of the Permanent Naval Forces who is retired or discharged on account of wounds or injuries received or disease contracted due to service, provided the wound, injury or disease was not due to the member’s default.

(2) the compensation payable under this regulation, which the Naval Board may approve, shall be according to the following scale:—

(a) The maximum amount.

(b) Three-quarters of the maximum amount.

(c) One-half of the maximum amount.

(d) One-quarter of the maximum amount.

(e) One-eighth of the maximum amount.

(f) One-sixteenth of the maximum amount.

(3) the maximum amount of compensation payable under this regulation shall be a sum equivalent to three years’ pay of the member at the date of his retirement or discharge, and shall be awarded only in case of total disability to earn a livelihood.


(4) In case of partial disability, the compensation payable under this regulation shall be less than the maximum amount, and shall be fixed in accordance with the scale, so that the amount awarded shall be proportionate to the degree of disability of the member as may be determined by the Naval Board.

(5) For the purpose of assessing compensation in the case of persons on sea-going rates of pay, the following payments and allowances only shall be considered as pay:—

(a) Active Pay.

(b) Deferred Pay.

(c) Good Conduct Badge Pay.

(d) Allowances for special qualifications.

(e) Victualling Allowance.

(f) Kit Upkeep Allowance.

(g) Married Allowance.

(h) Dependant Allowance.

The Allowance under (d) shall be included only for members actually entitled under Regulations to receive such allowances by reason of qualifications held. Victualling Allowance under (e) shall represent the daily allowance for rations, fixed from time to time, to be allowed under the general messing system.

(6) In the case of members of the Auxiliary Services, the High Cost of Living Allowance paid in accordance with regulation 70 of these Regulations, shall be included as pay for purpose of compensation.

Widows and families.

94. Compensation may be recommended by a Medical Board in the case of the widow and family of any member of the Permanent Forces who is killed when on duty, or dies of any disease contracted due to the service, if the death or disease was not due to the member’s default. The amount of compensation awarded shall not exceed three years’ pay, as defined in sub-regulation (5) of regulation 93, at the rate valued at in these Regulations, or received by, or allowed to, the member at the date of his death. No claim for compensation shall be considered unless it is made within twelve months after the death of the member.

Minor injuries.

95. (1) the Naval Board may authorize payment of a gratuity not exceeding a maximum of £8 in each case, to Chief Petty Officers, Petty Officers, and men invalided or discharged who, at date of discharge are suffering from any disabilities resulting from minor injuries sustained on duty for which a Hurt Certificate (Form A.M. 183) has been granted in accordance with Regulations. Such gratuity shall be payable at the expiration of the rating’s engagement only, and shall be in addition to any compensation awarded under the provisions of regulation 93 of these Regulations in respect of any other disability.

(2) The following condition shall apply generally to payment of the gratuity:—

(i) The injury must be one for which a Hurt Certificate has been granted, but possession of a Hurt Certificate shall not entitle any rating to the gratuity where no disability exists.

(ii) The amount of gratuity shall be assessed by a Board of Survey consisting of, at least, two Medical Officers, due regard being given to the rating’s future occupation.


(iii) The Board of Survey shall assess, separately, the gratuity for any disability arising from any previous minor injury for which a Hurt Certificate is held in any case where the rating is being invalided in consequence of a hurt or sickness attributable to the Service.

(iv) The Naval Board shall determine the amount of gratuity, if any, payable, each case being dealt with on its merits.

Officers on Emergency List.

96. An Officer on the Retired or Emergency List, who may receive hurts or wounds as the result of active service in the Royal Australian Navy, or his wife and children in the event of his being killed or dying of injury whilst so serving, shall be eligible for the award of compensation as if the Officer had been on the Active List of the Permanent Naval Forces (Sea-going).

PART VI.

TRAVELLING AND TRAVELLING ALLOWANCES.

I.—Permanent Naval Forces (Sea-going).

97. (1) The following shall be the rates of travelling allowances which may be drawn by members of the Permanent Naval Forces (Sea-going) when travelling on duty and in receipt of Sea-going rates of pay:—

(2) The scale of allowances applicable shall be increased as follows when a member is on duty in the capital city of a State other than that in which he ordinarily resides or is ordinarily employed:—

Conditions for payment.

(3) The minimum period of absence for which payment may be made is six hours.

(4) Travelling allowance is payable only up to a maximum period of fourteen days, except in such special cases as may be approved by the Naval Board. Members of the Sea-going Forces on duty involving a longer absence than fourteen days shall, after the expiration of the first fourteen days’ absence from their ship or depôt, become entitled to Provision and Lodging Allowances only, as specified in regulations 85 and 43 respectively.

(5) Members of the Sea-going Forces detained at a port waiting to join ship or on appointment to a ship or depôt where service accommodation is not available, shall enter lodgings as soon as possible. Travelling Allowance under sub-regulation (1) hereof may be paid when travelling to the port or


place of duty; the allowance may also be paid for three days, or four, if including a Sunday, while seeking lodgings, and then Lodging and Provision Allowances shall be paid. In cases, however, where it is known definitely that the total period of detention waiting to join a sea-going ship will not exceed seven days, or that service accommodation will be available within seven days, Travelling Allowance at the full rate shall be payable throughout the period. A certificate shall be given in the body of the voucher on which Travelling Allowance is paid to the effect that quarters are not available.

(6) Officers and men when absent over 48 hours and entitled to Travelling Allowance, shall have deducted therefrom the amount of Victualling Allowance, if any, credited to them on the Ship’s ledger in respect of such absence.

(7) Travelling Allowance shall not be payable concurrently with Lodging Allowance or Allowance in lieu of rations, or when quarters are provided at place of duty, except that Officers in receipt of the annual rate of Lodging Allowance may, when absent from head-quarters on duty, draw such Allowance concurrently with Travelling Allowance for a period not exceeding seven days provided lodgings are retained and paid for during the period.

(8) Travelling Allowance shall not be payable when travelling by steamer or other vessel, or by railway, in which quarters and rations are provided.

(9) Boys and ratings under 18 years of age who are proceeding to their homes on Christmas leave may be paid Travelling Allowance in advance at the rate of 4s. per diem (for a portion of a day, 1s. for the first six hours and 6d. for every subsequent three hours) while actually travelling from ship to home and from home to ship, but no Travelling Allowance is payable when the boys or other ratings are accommodated on trains or ships where meals are provided at the expense of the Department.

Meal allowance when on detached duty for periods under six hours.

98. (1) When detached for duty on shore or in other ships for periods of less than six hours, members of the Permanent Naval Forces (Sea-going) may be paid Meal Allowance at the following rates:—

99. (1) All Officers temporarily loaned to other ships for periods exceeding six, but under 48 hours, who are required to continue their mess subscription in their own ship during the period of loan, may be paid an Allowance of:—

5s. for Commissioned Officers (including Commissioned Officers from Warrant Rank),

4s. for Warrant and Subordinate Officers,


for a whole day’s absence, and Meal Allowance for broken periods, but not to exceed two meals in any one day. Payment shall be made in such cases in the ship from which the officer is loaned.

(2) Ratings belonging to the Permanent Naval Forces lent to vessels or services in which they have to contribute to a higher official rate of messing shall be allowed the difference, subject to the approval of the Naval Board in each case.

Persons lent to Auxiliary Services.

100. Officers and men lent to the Auxiliary Services from the Permanent Naval Forces (Sea-going) who are in receipt of sea-going rates of pay shall not, in any circumstances, be eligible for transfer, removal, or travelling expenses other than as prescribed for the Permanent Naval Forces (Sea-going) in these Regulations.

Recruits.

101. (1) Recruits may receive Travelling Allowance and be provided with accommodation by rail or steamer as per scale prescribed for Seamen and other ratings in sub-regulations (1) of regulations 97 and 107, for the journey from the place where they are recruited to the ship or depôt of final entry.

(2) If rejected at the final examination, Travelling Allowance and accommodation may also be granted for the return journey.

II.—Royal Australian Naval Auxiliary Services, etc.

Scale of travelling allowances (Auxiliary Services).

102. (1) When travelling on duty and required to be absent from Head-Quarters or temporary Head-Quarters over night, the following shall be the rate of Travelling Allowance payable to—

(i) Members of the Royal Australian Naval Auxiliary Services;

(ii) Officers in receipt of consolidated rates of pay; and

(iii) Other persons on consolidated rates of pay—

(3) When members travel by steamer or other vessel, or by railway, and the fare paid includes subsistence, one-quarter of the ordinary rates shall be allowed.

Scale of meal allowance when travelling.

103. Members of the Royal Australian Naval Auxiliary Services, Officers, and other persons in receipt of consolidated rates of pay detached for temporary duty and required to travel for periods which do not necessitate absence over night from their head-quarters or temporary head-quarters, may be paid Meal Allowance at the rates and under the conditions prescribed in the following sub-paragraphs:—

(a) Members absent from their head-quarters or temporary head-quarters during at least two meal periods shall, subject to the provisions of sub-paragraph (c), be paid for meals as under:—

(i) Where a member is absent for at least twelve hours, and such absence covers three meal periods, actual expenses incurred for three meals may be paid.

(ii) Where a member is absent during two meal periods payment of expenses necessarily incurred for one meal only may be paid.

(b) Where a member is absent during one meal period only, no payment will be made.

(c) The amount payable in respect of meals shall be the actual amount necessarily expended, but in no case shall the amount allowable exceed the following rate:—

Luncheon allowance when attending courses.

104. A member of the Royal Australian Naval Reserve Staff detailed to attend a military course of training away from his head-quarters in a city or suburban area and required to obtain his mid-day meal away from his usual place of residence, may be paid a luncheon Allowance not exceeding 1s. 6d. per diem for each whole day attendance.


Meal Allowance in time of war or emergency

105. (1) A member of the Auxiliary Services employed on duty ashore in time of war or emergency, who is entitled to issue of rations in kind, in accordance with the provisions of regulation 92 may be granted meal allowance in lieu of such issue of rations in kind under the conditions approved by the Naval Board.

(2) The amount payable in respect of meals obtained under the foregoing conditions shall be the actual amount necessarily expended, provided that payment for meals shall not exceed the following amounts:—

III.—Travelling Allowance.—General.

Time limit for claim.

106. (1) Claims for travelling Allowance (including any expenses incurred for conveyance of baggage) and for Travelling Expenses shall be submitted for payment not later than one month after the completion of the journey.

Rate on promotion. &c.

(2) Claims for increased rate of travelling or other allowances consequent on promotion to higher rank shall not be admitted for any period prior to date of gazettal or notification of the promotion.

(3) Officers and others holding temporary or acting rank shall draw the allowances of such rank.

Authority for travelling

(4) No Officer shall travel on duty without first obtaining the written instructions of his Commanding Officer, and such Commanding Officer, before issuing such instructions, shall satisfy himself that the travelling is necessary, and shall state the nature of the duty on the written authority.

First appointment.

(5) In exceptional circumstances the Naval Board may approve payment of travelling or other expenses on first appointment, otherwise all persons, on first taking up appointments within the Commonwealth, must join at their own cost, and no travelling or other expenses shall be allowed for themselves, wives, or families.

(6) Notwithstanding the provisions of sub-regulation (5), Officers and men, on first taking up appointment in the Royal Australian Naval Auxiliary Services after long service afloat in the Permanent Naval Forces (Sea-going), may, on the approval of the Naval Board, be paid transfer and removal expenses, as prescribed in sub-regulations (1), (2) and (6) of regulation 116 when they reside in another State than that to which they are appointed, or on taking up first appointment and required to transfer their residence from the capital city to an outport within a State; provided that such appointments are made direct from the Sea-going Forces, or within a period of six months from the date of discharge from the Sea-going Forces.

Naval Reserves.

(7) Members of the Naval Reserves shall become entitled to Travelling Allowance, as prescribed for corresponding ranks and ratings of the Permanent Naval Forces (Sea-going) on Sea-going rates of pay, only when ordered to proceed on special duties outside their ordinary duties at Inspections, Parades, Drills, or Annual Training; except that, when proceeding to or returning from Annual Training and required to travel long distances, payment of Meal Allowance may be made at the rates prescribed in regulation 98. Payment of Meal Allowance under similar conditions may also be made to Naval Cadets proceeding to or returning from Camps.

Chaplains

(8) Chaplains attending camps of training are not entitled to Travelling Allowance.

Gratuities.

(9) Gratuities to railway porters, stewards, &c., are inadmissible, but porterage outside the railway station will be allowed for journeys with baggage of a bulky nature, or over 28 lbs. in weight, when cab hire is not charged.

Times for calculation

(10) The rates of Travelling Allowances are exclusive of any cost of conveyance by rail, coach, of steamer, and, in computing the period, the time shall be counted from the time of departure by train, coach, or steamer, to the time of return by the same.

Variation of rates

(11) Where it is proved to the satisfaction of the Naval Board that the Travelling Allowances a member is entitled to draw under these Regulations do not cover his actual expenses, the Naval Board may authorize payment of an increased rate of Travelling Allowance, or the Naval Board may reduce the rates of Travelling Allowance under this scale where circumstances justify such a course.

Advances.

(12) An advance up to 75 per cent. of the maximum Travelling Allowance to which it is anticipated a member may be entitled may be made where extended absence is probable and cash payments exceeding a total sum of £5 require to be made.

IV. Travelling at Government Expense.

Travelling accommodation, class of.

107. (1) the following shall be the classes of accommodation by rail and sea, except where otherwise stated in this regulation, when travelling at Government expense:—

(2) When travelling by rail, from Port Augusta to Perth, or vice versâ, Chief Petty Officers may be granted sleeping berths on both the Transcontinental and State Railways, and first-class meal tickets on the Transcontinental Railway.

(3) Sleeping berth accommodation shall not be allowable to Chief Petty Officers travelling by rail on any other journeys.

(4) Commanding Officers may assign a superior class of accommodation to invalids upon medical recommendation; and, in special cases, to others where suitable accommodation by sea is not available.

(5) Petty Officers and other ratings travelling intra-State at Government expense by steamer or other vessel on the Queensland or Western Australian coasts may be allowed saloon accommodation.

(6) Petty Officers and other ratings may be allowed first-class accommodation when travelling by railway, at Government expense, upon journeys exceeding twelve (12) hours’ duration north of Rockhampton, in Queensland, and within the Northern Territory.

(7) Where a warrant is issued chargeable to the Department, the cost of booking a seat, if necessary, shall be included in the warrant. ???


(8) Petty Officers shall generally be given second-class accommodation when travelling by mercantile vessels, except—

(i) In the circumstances prescribed in sub-regulations (5) and (6) above.

(ii) When travelling in company with members of the Royal Navy, they shall conform to the arrangements adopted for their corresponding Royal Navy ratings.

(9) When drafts are sent by train, seats shall be reserved, whenever possible, in proximity, in one or more compartments for the Petty Officer in charge or sub-charge and men.

(10) The means of conveyance shall be by railway if the cost be not greater than by other mode of conveyance.

Deferred passage of ratings proceeding overseas.

(11) A rating whose steamer passage has been booked for draft overseas who, consequent upon a medical examination, is found to be medically unfit for draft owing to his own default may, at the discretion of the Naval Board, be debited with any charges made by the shipping company arising out of the cancellation of his passage.

Officers making own arrangements.

108. Officers travelling overseas on duty, in such special cases as may be approved by the Naval Board, may receive the passage money and be allowed to make their own arrangements for passage, provided that, except where otherwise approved, such Officers shall travel by the cheapest and most direct route. Where, in special circumstances, approval to travel by another route is given at an Officer’s own request, the additional expense thus incurred must be borne by such Officer. In every case, Shipping Companies’ first-class vouchers must be produced for the full sum advanced.

Families.

109. (1) In those cases where Officers and men are entitled to passages by sea or rail, at Commonwealth expense, for their wives and families, the term “children” is to be understood to include only such sons as are not over 16 years of age at the date of commencement of the journey, and unmarried daughters dependent on and residing with their fathers. An exception to this rule may be permitted in the case of sons over 16 years who by reason of physical or mental infirmity are necessarily dependent on their parents.

(2) Steamer, rail, or other fares of adopted children are not allowable except in special circumstances with the approval of the Naval Board.

Completion of leave after recall.

110. Officers and men proceeding to complete unexpired leave after recall shall be entitled to railway warrants at Government expense for both the forward and return journeys, but shall not be entitled to such railway warrants or any expenses in the following cases:—

(i) Where the unexpired portion of the leave subsequent to recall will not admit of at least 24 hours being spent at their destination;

(ii) Where the additional leave is granted in excess of four days over the unexpired period of leave originally granted; and

(iii) Where they are aware, before proceeding on leave, that it is probable they will be recalled.

Travelling warrants for leave.

111. Warrants chargeable to the Department may be issued in the following cases:—

(i) Officers and men of the Sea-going Forces given Christmas leave at Sydney or Melbourne, in respect of the journey beyond Adelaide or Brisbane to home, such ranks and ratings themselves bearing the cost of the journey as far as Adelaide or Brisbane.


(ii) Boys and ratings under 18 years of age who are proceeding to their homes within the Commonwealth on Christmas Leave, and boys on final leave from Training Ship prior to being drafted to sea service, provided that a period of three months has elapsed since return from Christmas Leave.

Travelling warrants on Discharge.

112. Ratings discharged—

(i) time expired,

(ii) for misconduct,

(iii) invalided,

(iv) demobilized,

may be granted railway or steamer warrant, chargeable to the Department, and, where necessary, warrant for transport of excess luggage within the limits of the scale prescribed in sub-regulation (1) of regulation 112, to actual place from which they were originally recruited within the Commonwealth, or to Port Division, as they may elect. Railways are to be used whenever possible.

Ratings discharged at own request whose engagements have not expired will not be entitled to this concession.

Freight—Sea-going Forces.

113. (1) Payment, according to the following scale, for freight on service baggage actually necessary to be carried will be allowed to Officers and Men of the Permanent Naval Forces (Sea-going) travelling on duty, and in receipt of Sea-going rates of pay.:—

(2) Flag Officers, Commodores, and Officers in Command, appointed in the United Kingdom to the Royal Australian. Navy, who join their ships at ports in Australia, may be allowed free conveyance to Australia of combined baggage and mess stores in accordance with the scale prescribed in King’s Regulations and Admiralty Instructions.

(3) Chaplains will be allowed 2 cwt. for Books, Medical Officers 2 cwt. for professional books and instruments, and Officers in charge of Paymasters’ Accounts 1 cwt. for books and accounts in addition to their allowance of Baggage according to their seniority, as prescribed in sub-regulation (1).

Cab hire (including taxi cabs)

114. (1) Except as provided in sub-regulation (8) hereof, cab hire shall be allowed to Officers only when travelling with baggage.

(2) Except as provided in sub-regulation (8) hereof, cab hire will not be allowed when railway or other ordinary public conveyance is available. Claims for cab hire must be supported by a statement showing the necessity for using carriages or cabs, also the places from and to, and distance travelled.

(3) Except as provided in sub-regulation (8) hereof, cab hire will not be admissible for distances of less than 2 miles, unless baggage of a bulky nature or of over 28 lbs weight is necessarily taken, or unless such conveyance is required for necessary saving of time apart from all circumstances under the Officers’ own control.

(4) Cab hire shall be allowed to Petty Officers when travelling with baggage if no cheaper mode of conveyance is available.

(5) When cab hire is claimed for more than 5s., receipt for such payment must accompany claim. Claims for cab hire at rates in excess of the legal fares are not admissible. Claims for hire of taxi-cabs shall not be admitted where the rates for hire of such cabs exceed the rates for hire of ordinary cabs.

(6) When an Officer or Petty Officer proceeds on duty by rail or steamer, the amount which may be approved for cab or taxi hire between ship, depôt or home and railway station or steamer shall be limited to 5s. except in special cases when the Officer in Command may approve of a larger amount being paid on production of supporting receipt. When such special approval is given the reason shall be stated on the voucher.

(7) When two or more Officers or two or more Petty Officers proceed from one quarter on the same duty, a separate cab will not be allowed for each, unless it be shown that it was impracticable for the Officers or Petty Officers to perform the journey together.

Cab hire for official calls

(8) Notwithstanding that ordinary public conveyance may be available, motor cars may be utilized in the case of Officers required to travel on duty through the public streets in No. 3 or No. 4 dress with swords, in connexion with the paying of official calls, attendance at funerals, special church parades, and police courts, or in the case of Aides-de-camp on duty when required to wear the dress aforementioned.

(9) In the case of Officers not in command, the Commanding Officer shall certify on the voucher that the Officers for whom the cars were hired under the provisions of sub-regulation (8) were officially detailed for the duty.

Motor cars

115. Claims for hire of motor cars in excess of £1 must receive the prior approval of the Naval Board or Secretary. Motor cars are only to be engaged when their use is as economical as cabs.


Allowance for use of private motor cars.

116. (1) Officers who use their own motor cars when travelling on public business, or any member whose motor car is used for such purpose, may be allowed in respect thereof payment at the rate of 8d. per mile.

(2) The prior approval of the Naval Board or the Secretary must be obtained to use a private car, and proof must be produced that the use of a motor car results in greater efficiency and saving than would be the case if any other conveyance were employed.

V.—Transfers and Removals.—Auxiliary Services.

Removal of families.

117. (1) When a member of the Royal Australian Auxiliary Services or other persons on consolidated rates of pay is transferred from a District, Sub-District, or station to another District, Sub-District, or station, the actual cost of rail, steamer, coach, or other fares, at Government rates, of such member, his wife, and children (as defined in regulation 109) shall be paid by the Department, in addition to Travelling Allowance for such a member, provided such transfer is not made by way of punishment, or at the member or person’s own request.

Removal of furniture.

(2) Reimbursement of cost of removing necessary household furniture and effects shall be made subject to the following limitations:—

(3) In very exceptional circumstances where it can be satisfactorily proved that the amount as set out in sub-regulation (2) is not sufficient to cover the actual cost of removal of necessary household furniture and effects, the Naval Board may approve the payment of an additional amount towards such actual cost.

(4) Persons shall not be entitled to any compensation for losses or damages arising from removal, nor to repayment of cost of insurance on household furniture and effects in transit.

(5) Furniture, where practicable, shall be removed by railway if the cost be not greater than by other means of conveyance.

Replacement of furniture.

(6) The Naval Board may, in lieu of cost of removal, authorize payment of an amount not exceeding the maximum prescribed for removal expenses to compensate for loss in any case where an officer elects to dispose of his furniture and effects instead of removing them to his new station.

Removal on discharge

118. On discharge on account of having been found medically unfit for further service, or on completion of the term of service for which he was engaged or appointed, free rail, steamer, or coach transport may be provided for the member, his wife and children, to home port, or in lieu thereof transport to any other place in the Commonwealth, provided that the cost of such transport does not exceed the cost of transport to the member’s home port.

(2) The cost of conveyance of the furniture and effects in the possession of married members who are transported under sub-regulation (1) may be borne by the Department.


(3) Except in special circumstances where the approval of the Naval Board has been obtained, the transfer at departmental expense must be carried out within three months of the member’s retirement or discharge.

Allowance where official quarters or private residence are not available.

119. Where a married member, upon transfer, cannot enter into occupancy of quarters or private residence through unavoidable delay in transmission of his furniture and household effects, or for any other reason approved by the Naval Board, and the member must therefore reside, for the time being, with his family at an hotel or other house of accommodation, the Naval Board may approve of payment to such member of an allowance not exceeding half the cost of board and lodging of himself and family, provided that the amount payable shall not exceed the daily rate of travelling allowance to which the member is entitled under the Regulations, and shall not be paid beyond one month unless in exceptional circumstances approved by the Naval Board.

PART VII.

MEDICAL ATTENDANCE, MEDICINES, AND DENTAL TREATMENT.

I.—Permanent Naval Forces (Sea-going).

Medical attendance.

120. (1) Members of the Permanent Naval Forces (Sea-going) shall be granted free medical attendance subject to the following sub-regulations.

Hospital accommodation.

(2) Arrangements may be made for admission and treatment of officers and men in a hospital with approved accommodation, and the expense so incurred shall be defrayed by the Department.

(3) The term “hospital” referred to in these Regulations shall include any hospital—Naval, Military, civil (general or private), receiving home or ward, but shall not include Naval Sick Quarters.

In cases of venereal disease, however, the Sick Quarters at Garden Island and Venereal Ward at Flinders Naval Depôt shall be regarded as a hospital, and all medical cases under “bed’’ treatment at Flinders Naval Depôt shall be regarded as receiving treatment in a hospital with approved accommodation.

Private hospitals.

(4) In cases where an officer or man elects to be treated in a private hospital, or by a private practitioner, a Naval hospital, or hospital with approved accommodation being available, or where a patient, being an invalid or otherwise, is discharged, at his own request, from such hospital or from the care of a medical officer against the advice of such medical officer, such member shall assume all financial responsibility consequent upon his action, and, before his request is approved, shall sign a written undertaking to that effect, which shall be transmitted to the Naval Board.

Surgical operations.

(5) When, in an emergency, operations are performed by civil surgeon upon officers and men at hospitals with which the Department has no arrangements as to fees, and when patients cannot travel to a recognised hospital, the sum allowed in payment of such operations shall be determined by the Naval Board, but shall not, unless in special circumstances, exceed £30.

Appliances, &c.

121. Except where the Naval Board may otherwise direct, spectacles, orthopœdic or other surgical appliances are to be supplied only when recommended by the Board of Medical Survey, and approved by the Naval Board, in these cases where disability is directly attributable to service in the Permanent Naval Forces (Sea-going).


Dental treatment.

122. (1) Full dental treatment, at the expense of the Department, shall be allowed to officers and men such treatment shall include extractions, scaling of teeth, fillings (amalgam or cement), treatment of pyorrhœa and supply of dentures.

(2) The supply of dentures shall be limited to one upper and one lower set, except in these cases where a new denture is considered necessary by the Medical Officer and the Surgeon Dentist owing to subsequent extractions. Ordinary repairs may be undertaken.

II.—Permanent Naval Forces (Auxiliary Services).

Medical Attendance.

123. Members of the Auxiliary Services shall be entitled to medical attendance and treatment, including drugs, dressing and hospital treatment, to the same extent as members of the Sea-going Forces, subject to such arrangements as may be made by the Naval Board from time to time, provided that they shall not be entitled to the sick allowance whilst on leave prescribed in regulation 131, nor to be refunded the cost of medical attendance whilst on recreation leave.

Dental treatment.

124. Members of the Auxiliary Services may, where circumstances permit, receive free dental treatment by the Surgeon Dentist so far as is necessary for the relief of pain only.

III. Royal Australian Naval College Staff.

Medical Attendance.

125. (1) Civilian masters and employees permanently or temporarily employed at the Royal Australian Naval College, their wives and families, also the wives and families of members of the Permanent Naval Forces (Sea-going) detailed for duty at the Royal Australian Naval College, may be granted medical attendance at the College free of charge, by the Surgeon appointed for duty.

(2) The concession of free medical attendance for all persons referred to in sub-regulation (1) above is conditional upon the work being carried out by the Surgeon appointed for official duty at the College, and subject to no additional expense being incurred by the Department.

(3) The cost of medical attendance for confinements shall not be allowed.

Hospital accommodation.

126. Civilian Masters and Employees, their wives and families, and the wives and families of members of the Permanent Naval Forces (Sea-going) detailed for duty at the College may, subject to the approval of the Commanding Officer, be admitted to the Hospital at the College. No charge for such accommodation shall be made in respect of the Masters and Employees, but a charge at the rate of 30s. per capita per week shall be made in the cases of wives and families.

Dental treatment.

127. Civilian Masters and Employees may, where circumstances permit, receive free dental treatment by the Dental Surgeon so far as is necessary for the relief of pain only, provided no extra expense to the Department is incurred.

PART VIII.

LEAVE OF ABSENCE ON GROUND OF ILLNESS.

I.—Permanent Naval Forces (Sea-Going).

Sick leave.

128. (1) Sick Leave may be granted only to persons requiring convalescence after a severe illness, operation, illness due to service in the tropics or in an unhealthy climate, and then only upon the recommendation of a Naval Medical Officer.


(2) The period of Sick Leave on full pay is limited to 30 days, but in exceptional circumstances may be extended by the Naval Board to a period not exceeding 91 days, provided there is a reasonable probability of the person returning to duty.

(3) The Department will not be responsible for the payment of expenses incurred for Medical and Surgical treatment whilst on Sick Leave, unless in such exceptional circumstances as may be specially approved by the Naval Board.

Period of full pay during illness.

129. (1) In peace time, members sent to approved hospitals on account of disabilities for which they are not themselves responsible shall, if not previously invalided from the service, be borne on full pay for a period not exceeding six months. During war-time, the period of full pay under this regulation may be extended to eighteen months.

(2) In special cases, such as where a member is sent to hospital for treatment of any serious bodily injury received whilst serving, insanity resulting from an accident on duty, extraordinary exposure or exertion on service, the Naval Board may determine the period, in addition to that prescribed in sub-regulation (1), during which the member shall receive the full rate of pay.

Venereal disease and other disabilities due to members default.

130. (1) Members sick on shore or sent to hospital suffering from venereal disease, or from disabilities which are the result of the member’s own misconduct, carelessness or neglect, shall be placed on half pay at the expiration of 30 days and cease pay at the expiration of 91 days.

(2). All such members again checked sick on shore or in hospital, within fourteen days from expiration of their previous period of sickness on shore or in hospital, shall be considered as being under continuous treatment, but only these days actually so cheeked shall be counted for the purposes of reduced pay in accordance with the terms specified in sub-regulation (1).

Sick allowance.

131. When on leave and under treatment of a private practitioner, in consequence of being unfit to travel, a sick allowance of 6s. per diem may be granted up to a limit of 91 days. In exceptional cases this period may be extended by the Naval Board.

Private hospitals.

132. In cases where an officer or man elects to be treated in a private hospital, under the conditions prescribed in regulation 119, sub-regulation (4), the period of full and of half pay shall be determined by the Naval Board according to the circumstances of each case, but shall, generally, not exceed 91 days.

Allowances.

133. (1) Married and Dependant allowances shall be paid continuously during sickness, from whatever cause arising, when full or half pay is paid; but when a member is placed on half pay the provisions of sub-regulations 45 (5) (g) and 46 (8) in regard to allotment of proportion of pay shall apply to the reduced pay.

(2) Whilst undergoing hospital treatment at Government expense, allowance in lieu of rations, or of quarters, shall not be payable.

Reduced pay.

134. Half pay during illness shall consist of half the substantive and non-substantive rates of pay received by or credited to the member at the date of being placed on reduced pay. Married or Dependant allowance, if previously paid, shall, however, continue to be credited in full, subject to the provisions of regulation 133.

Deferred pay.

135. No reduction shall be made in deferred pay in respect of any period during illness when reduced pay is drawn or of sick leave granted on reduced pay.


II.—Permanent Naval Forces (Auxiliary Services).

Sick leave granted by D.N.O.

136. District Naval Officers may grant leave of absence, on full pay, on the ground of illness in cases in which such leave does not exceed one month in any triennial period provided the conditions and periods laid down in succeeding regulations are not exceeded.

Extension by Naval Board.

137. (1) In cases of continued sickness or ill health, the Naval Board may, on production of satisfactory evidence, grant extended leave, not exceeding three months, in accordance with the following schedule:—

138. In exceptional cases, the Minister may take any special circumstances into consideration, and vary the scale of leave, provided that in no case shall the leave granted exceed three months on full pay.

Extension by Governor-General

139. Where in cases of illness any member who has received leave of absence for three months is not so far recovered as to be able to resume his duties, further extensions of leave may be granted, with the approval of the Governor-General, in accordance with the following schedule; provided that on each extension of leave the applicant shall be subjected to medical examination:—

Special cases.

140. In exceptional cases, special circumstances may be taken into consideration, e.g., where a member in discharge of his duty sustains injuries of such a nature as to incapacitate him for all duty, this scale may be varied; provided that in no case shall full pay be allowed for a period exceeding nine months in addition to leave granted by the Naval Board on full pay.

Triennial period.

141. (1) Sick Leave allowable under regulations 135, 136, and 138 may be granted in one or more periods, but the aggregate amount of leave provided for in schedules is intended to cover a period of three years, commencing from the date of first absence on Sick Leave.


(2) The second or any subsequent triennial period of Sick Leave shall commence on the date of the first absence on Sick Leave following the date upon which the previous triennial period expires, and, for the three years thus commencing, the full amount of leave provided in the schedules according to length of service may again be allowed.

Leave account of injuries.

142. Leave of absence on account of injuries sustained when in the discharge of duty shall be dealt with as prescribed in these Regulations, but such leave shall not be counted as a portion of the leave which may, under these Regulations, be granted to an Officer, Petty Officer, or man, on account of illness.

Return to duty.

143. If any member is absent from duty on account of illness, and such absence has extended beyond three months, he shall not be permitted to return to duty unless and until it is certified that be is medically fit to resume work.

Sundays and holidays.

144. When extended leave is granted other than on full pay, the rate paid for Sundays and holidays shall be the same as that allowed for the period of leave.

PART IX.

FURLOUGH AND EXTENDED LEAVE.

Furlough.

145. (1) When a person has continued in the service of the Commonwealth under the provisions of the Defence or Naval Defence Acts for at least twenty years, the Naval Board may grant him leave of absence for a period not exceeding one month and a half on full pay, or three months on half pay, in respect of each completed five years of continuous service.

Provided that such person shall not be granted leave of absence to exceed a continuous period of twelve months at any one time, and that service in the Permanent Naval Forces on loan from the Royal Navy shall not be counted as service qualifying for such leave of absence.

Provided further that in the case of any person being appointed to or enlisting in the Naval Forces after 30th November, 1919, the service which shall be taken into account for the purposes of this regulation shall not include any service in a temporary capacity.

Previous service, in State or Commonwealth.

(2) Where a person has become transferred or appointed from any position of a permanent nature under the State or Commonwealth to a permanent position in the service of the Commonwealth under the provisions of the Defence Act or Naval Defence Act, all continuous service of such person under the State or Commonwealth shall, for the purpose of furlough, be reckoned as service in the service of the Commonwealth under the provisions of the Defence Act or Naval Defence Act.

(3) Members of the Permanent Naval Forces who served under the terms of the Naval Agreement Act 1903, may, for the purpose of furlough, be allowed to count service under the terms of the Naval Agreement Act 1903 as service in the service of the Commonwealth under the provisions of the Defence Act or Naval Defence Act, provided that service under the Defence Act or Naval Defence Act is continuous with service under the Naval Agreement Act 1903.

Furlough due on retirement.

(4) When a person who has continued in the service of the Commonwealth for at least twenty years is retiring, the Naval Board may authorize payment to him upon retirement of a sum equivalent to the amount of pay that would have been received by him during such leave of absence as would immediately prior to retirement have been granted to him under sub-regulation (1) of this regulation.


Furlough due at death.

(5) Upon the death of a person who at the date of his death was eligible under this regulation for grant of leave of absence, the Naval Board may authorize payment to the dependants of the member of a sum equivalent to the amount of pay which would, under this regulation, have been granted to the person had he retired immediately prior to the date of his death.

(6) Notwithstanding anything contained in this regulation—

(а) There shall not be granted under this regulation, in respect of the service of any person, leave of absence or pay on retirement or death exceeding in the whole twelve months on full pay or its equivalent;

(b) Except upon the retirement of a person who had attained the prescribed age of retirement, leave of absence for recreation shall not be granted under regulation 140 of the Naval Forces Regulations in respect of the year in which leave of absence granted under this regulation commences, and, if leave of absence for recreation has been granted in the year in which leave of absence granted under this regulation commences, it shall be regarded as part of the period of leave of absence granted under this regulation provided that the total period of leave of absence for recreation, which may under this paragraph be withheld or regarded as portion of the period of leave of absence granted under this regulation during any person’s period of service, shall not exceed the period of absence for recreation which may be granted in respect of one year of service; and

(c) The official conduct record of a person shall be taken into consideration in determining whether the whole or any portion of the leave of absence or pay provided in this regulation may be granted.

Scale of extended leave when not eligible for furlough.

146. (1) The Naval Board may grant to any person whose period of service is less than twenty years who is ineligible for furlough under the last preceding regulation immediately prior to his retirement from the service on or subsequent to his attaining the prescribed age for retirement, leave of absence on full pay for a period not exceeding that appropriate to his service, as specified in the following scale:—

Service of sixteen years and less than twenty years—five months.

Service of twelve years and less than sixteen years—four months.

Service of eight years and less than twelve years—three months.

Service of four years and less than eight years—two months.

(2) Except as provided in sub-regulations (4) and (5) of this regulation, a person shall not be eligible for the grant of extended leave under this regulation unless he has completed twelve years’ service.

Payment may be allowed in lieu.

(3) In lieu of leave in accordance with sub-regulation (1) of this regulation, the Naval Board may authorize payment to a person eligible for leave in pursuance of this regulation upon his retirement from the service of a sum equivalent to the pay for a period of leave not exceeding that which the person could have been granted under this regulation.

(4) When a person who has not attained the prescribed age for retirement is invalided from the service after less than twenty years’ service, and the cause of such invaliding is permanent and is not due to misconduct or to causes within his own control, the Naval Board may authorize payment to the person of a sum equivalent to the pay for a period of leave not exceeding that for which, had he attained the prescribed age for retirement, he would have been eligible under sub-regulation (1) of this regulation.


(5) In the event of the death of a person before he has completed twenty years’ service and either before or after he has attained the prescribed ago for retirement, the Naval Board may authorize payment to the dependants of the person of a sum equivalent to the pay for the period of leave which the member would have received had he been eligible for, and granted leave of absence under sub-regulation (1) of this regulation.

(6) The official conduct record of a person shall be taken into consideration in determining whether the whole or portion of his leave of absence or pay provided in this regulation may be granted.

(7) A member of the Auxiliary Services of the Permanent Naval Forces who is retired voluntarily or compulsorily in pursuance of the decision of the Government to re-organize and retrench the Department of Defence, may, notwithstanding that he has not reached the age for retirement, be paid, subject to the approval of the Governor-General, the sum equivalent to the pay for the period of leave for which he would be eligible under sub-regulation (1) of this regulation had he reached the age for retirement at the date of the termination of his appointment or of his discharge.

Definition of pay.

147. (1) For the purposes of extended leave or furlough as regards persons on Sea-going rates of pay the following payments and allowances only shall be considered as pay:—

(а) Active Pay.

(b) Deferred Pay.

(c) Good Conduct Badge Pay.

(d) Allowances for special qualifications.

(e) Victualling Allowance.

(f) Kit Upkeep Allowance.

(g) Married Allowance.

(h) Dependant Allowance.

The Allowance under (d) shall be included only for members actually entitled under Regulations to receive such allowances by reasons of qualifications held. Victualling Allowance under (e) represents the daily Allowance for rations fixed from time to time, to be allowed under the general messing system.

(2) When payment of a lump sum is granted in lieu of extended leave or furlough the payments and allowances referred to in sub-regulation (1) of this regulation shall be included in the payment in respect of the whole period at the rate which the member was entitled to receive at the date of termination of his appointment.

PART X.

MISCELLANEOUS.

Sale of stamps.

148. Accountant Officers are authorized to purchase a supply of ordinary postage stamps from the public money in their charge for sale to the Ship’s company.

Replacement of medals.

149. Medals accidentally lost on duty by some accident beyond the control of the loser may, subject to the approval of the Naval Board, be replaced free of cost to the member.

Loan and sale of Stores and supplies.

150. (1) Government stores, except as hereinafter provided, shall not be lent, exchanged, or sold without Minister’s approval.

(2) Obsolete or unserviceable stores, arms and equipment may be lent with the approval of the Naval Board.


(3) Stores which form part of the equipment of the Naval Forces for war shall not be issued on loan for use for other than naval purposes except for charitable purposes and then only by special consent of the Minister.

(4) The Naval Board may approve of the sale or the writing off of condemned, unfit, damaged or deficient stores, the value of which does not exceed £100.

(5) The Director of Naval Stores and Victualling, and the Director of Ordnance, Torpedoes and Mines, may approve of the sale or writing off of condemned, unfit, damaged or deficient stores, the value of which does not exceed £5.

(6) The Naval Board may, subject to naval requirements approve of the issue of stores on repayment of not less than cost, to other Commonwealth Departments, to the Imperial Government and to other Governments.

(7) This regulation shall not apply to the sale of articles of kit and other articles, the issues of which are governed by regulation.

Funerals—Auxiliary services and Reserves.

151. (1) An expenditure not exceeding Ten pounds may be authorized by District Naval Officers on funerals of members of the Permanent Naval Forces and members of the R. A. N. Reserve mobilized or enlisted for service in time of war or national emergency.

(2) Where it is proved to the satisfaction of the Naval Board that the actual necessary expenses incurred were in excess of £10, the Naval Board may approve payment of such further sum as may be considered reasonable.

Funerals—Sea-going personnel

152. (1) An expenditure not exceeding Ten pounds (£10) may be authorized by Commanding Officers for funerals of members of the Permanent Naval Forces (Sea-going) who are buried on shore.

(2) Where it is proved to the satisfaction of the Naval Board that the actual necessary expenses incurred on the burial were in excess of £10, the Naval Board may approve payment of such further sum as maybe considered reasonable.

(3) Where the burial is undertaken by relatives, the Naval Board may approve of re-imbursement of funeral expenses incurred. The sum approved however, shall not exceed the cost which would have been incurred had the funeral been carried out by the Department, and shall be subject to deduction of cost of the coffin and other expenses which may have been incurred by the Department prior to the removal of the body.

(4) The relatives may have the body conveyed, at their own expense, from the place of death to the deceased’s home for burial, or may be issued with two second-class railway warrants, at Government expense, to enable the nearest relative and one other to proceed to and return home from the Naval Funeral.

(5) The procedure to be adopted by Commanding Officers of Ships in which a member of the Permanent Naval Forces (Sea-going) dies whilst the vessel is in a port of the Commonwealth or outside the Commonwealth, in regard to obtaining quotations from local undertakers for the funeral and payment of the undertaker’s account shall be such as the Naval Board may approve from time to time.

Charges for admission to sports grounds.

153. (1) The Naval Board may approve of a charge being made for entrance to sports grounds enclosed in Naval property, subject to such conditions as may be approved.


(2) Amounts collected as a result of such charge shall be paid to the credit of a General Fund or Sports Fund, but shall not be used for the advantage of individual members.

Torpedo Efficiency Funds.

154. (1) payment of Torpedo Efficiency Allowances shall be allowed in accordance with the scale set forth in sub-regulation (2) of this regulation in respect of H. M. A. Ships in full commission only.

(2) The scale of payment shall be as follows:–

(3) H. M. A. Ships in “Reserve commission are not eligible for payment of these allowances or for a grant from the Torpedo Efficiency Fund of any other H. M. A. Ship.

(4) The whole of the amount of the allowance shall be credited to a fund to be called the Torpedo Efficiency Fund which shall be utilized to meet minor expenses in the interests of torpedo efficiency generally, such as the provision of small fittings and devices, not included in the usual torpedo equipment of H. M. A. Ships, which would tend to promote efficiency. No portion of the Torpedo Efficiency Fund shall be expended on Prize Money or as an emolument for any person in the Naval Service.

(5) No refund shall be required from the Torpedo Efficiency Fund of any H. M. A. Ship on paying off or on dispersal of a Flotilla, but any amounts remaining on hand shall be communicated to the Officer Commanding H. M. A. Fleet, who may, at his discretion, cause same to be transferred to another Torpedo Efficiency Fund or repaid to the Accountant Officer for payment to Revenue.

Chaplains travelling and lodging allowances.

155. Chaplains’, having no relative rank, Lodging and Travelling Allowances rates shall be—

Chaplains under four years’ seniority, the rate as prescribed for a Lieutenant.

Chaplains of four years’ seniority, the rate as prescribed for a Lieutenant Commander.

Chaplains of eight years’ seniority, the rate as prescribed for a Commander, and

Chaplains of fifteen years’ seniority, the rate as prescribed for a Captain.

Ship’s Fund and Canteen rent.

156. (1) Any amount received from Canteen tenants as rent shall be paid to the General Ship’s Fund, or, in the absence of such Fund, disposed of as the Naval Board may approve.

(2) The Ship’s Fund shall consist of moneys received in the nature of rent from the Canteen tenant.

(3) The Fund is primarily intended to meet the cost of recreation for the Ship’s Company and for benevolent purposes connected with the Ship. The Commanding Officer shall satisfy himself that sufficient allowance is made for these objects, due regard being had to the proportion of the Ship’s Company who are able to participate in any form of recreation.

(4) The administration of this Fund, shall, subject to the provisions of sub-regulation (3) be under the control of the Canteen Committee.

(5) The accumulation of a large surplus in the Ship’s Fund shall not be permitted, and any balance remaining after making allowance for probable current expenses is to be returned to the messes periodically in proportion to the amount of their Canteen bills.


(6) All accounts in connexion with the Ship’s Fund, including all subsidiary funds, e.g.. cricket club and rifle club, shall be audited quarterly by officers nominated by the Commanding Officer, who are to be independent of these serving on the Canteen Committee. After each audit, a statement of accounts shall be prepared, submitted for approval by the Commanding Officer, and publically exhibited.

Allowances to witnesses at courts martial and courts of inquiry.

157.—(1) Witnesses who are summoned or ordered to attend at a Court Martial or a Court of Inquiry at the request of the Department or by order may receive remuneration for such attendance as follows:—

(a) For Civilians.—In accordance with the rates payable (in the State in which the Court Martial or Court of Inquiry is held) to witnesses attending the Supreme Court of that State in its criminal jurisdiction.

(b) For Members of Forces not permanently employed.—At the rate of travelling allowance prescribed for the Permanent Force (Sea-going).

(c) For Members of Forces Permanently Employed.—At the usual rate of Travelling Allowance if so entitled.

Courts martial and disciplinary courts.

158. The allowances prescribed in King’s Regulations and Admiralty Instructions shall be paid to the Officiating Deputy Judge Advocate or Clerk of Court and to the Provost-Martial at Courts Martial.

PART XI.

AUTHORITIES FOR EXPENDITURE.

Ministerial approval and delegation of powers.

159. (1) The Minister may approve of any expenditure not covered by these Regulations provided that the necessary Funds have been made available by Parliamentary Appropriation or by the Treasury in anticipation of Parliamentary Appropriation.

(2) The Minister may, by writing under his hand, delegate any of the powers, functions, and authorities conferred upon or vested in him by these Regulations.

(3) Every delegation under this Regulation shall be revocable at will, and no delegation shall prevent the exercise of any power, function, or authority by the Minister.

Authority of Naval Board.

160. (1) In addition to the authorities specifically vested throughout these Regulations, the Naval Board is authorized—

(i) To approve of increments to members of the Permanent Naval Forces where such increments are prescribed by these Regulations and require Naval Board approval, subject to provision being made therefor in the Appropriation Act;

(ii) To approve up to the value of £10,000 in each case of all requisitions for supplies within the Votes on the Estimates;

(iii) To approve up to the value of £10,000 in each case of expenditure under the Division or Subdivisions of any Votes for contingencies, General Services, and for Maintenance of Ships and Vessels and existing Establishments;

(iv) To approve of requisitions on Works and Railways Department for repairs and maintenance, sanitation and water supply, and fittings and furniture, within the Votes on the Estimates.


(2) All authorities vested in Directors and Officers-in-Charge by these Regulations may also be exercised, where necessary, by the Naval Board.

(3) The Naval Board may approve of the taking on charge of excess Stores.

(4) In all cases where expenditure is approved by a majority of the Board, such cases shall, unless the majority includes the Finance Member, be referred to the Minister for decision before any liability is incurred.

Authorities of Directors.

161. (1) Directors are authorized to incur expenditure as set forth in the following sub-regulations.

(2) The Director of Naval Stores is authorized to approve of expenditure not exceeding £300 in any one case on the following items:—

(а) Naval Sea Stores for equipment and maintenance of H.M.A. Fleet not in excess of stocks authorized to be maintained;

(b) Coal and Oil Fuel for H.M.A. Fleet;

(c) Naval Stores for—

(i) Construction and repair of H.M.A. Ships, and Maintenance of Dockyards and Naval Yards;

(ii) Fleet Auxiliaries;

(iii) Naval Establishments, Naval Barracks, Official Residences, Naval Colleges, Naval Detention Quarters;

(iv) Naval Reserves;

(d) Stores for Central Administration;

(e) Office requisites and stationery subject to the approval of superior authority, where necessary;

(f) Stores in excess of these authorized to be maintained not exceeding £2 in any one case.

(3) The Director of Victualling is authorized to approve of expenditure on victualling stores not exceeding £300 in any one ease.

(4) The Director of Naval Medical Services is authorized to approve of expenditure not exceeding £100 in any one case on medicines and medical stores required for the Naval Medical Service.

(5) The Director or Ordnance, Torpedoes and Mines is authorized to approve of expenditure not exceeding £100 in any one case on Naval Armament Stores.

Authorities of Officers-in-Charge.

162. (1) Officers-in-Charge are authorized to incur expenditure as set forth in the following sub-regulations.

Captain-in-Charge, New South Wales.

(2) Captain-in-Charge, H. M. A. Naval Establishments, New South Wales, is authorized—

(i) To engage skilled or unskilled labour at ruling rates of wages provided such are not less than Award rates, and provided that the work on which such labour is employed has been duly authorized. No person is to be employed at any wage in excess of 15s. per diem, unless the rate is that prescribed by an Award, or has been approved by the Naval Board.


(ii) To engage temporary draughtsmen for such limited periods as may be necessary, and to renew such appointments from time to time as requisite, provided that total period shall not exceed twelve months without Naval Board approval, at the rates prescribed in Arbitration Court Awards. The approval of the Naval Board is to be obtained for all increases beyond the rates prescribed in the Awards. The employment of all temporary draughtsmen is to be reported to the Naval Board for confirmation.

(iii) To approve of payment of claims for Overtime and Sunday Pay.

(iv) To approve of Yard demands on the Naval Store Officer for materials for Yard Services and upkeep of Yard Plant and Floating Craft, which the Captain-in-Charge is authorized to put in hand, or for which Naval Board approval has been received.

(v) To approve of special demands from H.M.A. Ships on the Naval Store Officer for stores in excess of quantities allowed by Establishment provided the excess quantities are essential for ordinary services.

(vi) To approve of repairs to Yard Plant Moorings and Floating Craft being carried out, provided the cost of same, including labour and material, does not exceed £100 in any one case. This includes cost of replacements to make good defects, e.g., tools to maintain stocks, but does not include new work.

(vii) To approve of expenditure for Contingencies, e.g., towage, not exceeding £100 in any one case and for all recurring services such as electric supply and telephones.

(viii) To approve of purchases under established procedure of authorized fresh provisions required for victualling sea-going personnel of H.M.A.S. Penguin and Depôt Ship for Ships in Reserve.

(ix) To approve, in emergent cases, of expenditure in anticipation of superior authority.

(x) To requisition on the Works and Railways Department for Repair and Maintenance in connexion with H.M.A. Naval Establishments, Sydney, not exceeding £50 in any one case.

Naval Store Officer, Sydney.

(3) The Naval Store Officer, Sydney, is authorized—

(i) To approve of Contract Demands on the Contract Board or the District Contract Board or requisitions for the local purchase of—

(a) Naval Stores which are authorized for local purchase and which are required to replenish authorized stock, which will not be exceeded on receipt of Stores purchased;

(b) Naval Stores which are required for repair and refit of H. M. A. Ships approved by the Naval Board;

(c) Naval Stores for supply to H. M. A. Ships or Shore Establishments in accordance with a demand specially approved by superior authority.

(ii) To approve of requisitions for minor items of Naval Stores not ordinarily kept in stock, not exceeding £5 in value in each case, required for specific Yard Services.

(iii) To approve of Requisitions for all Services in connexion with Naval Stores not exceeding £20 for any particular service in respect of any one shipment.


Victualling Store Officer, Sydney.

(4) The Victualling Store Officer, Sydney, is authorized—

(i) To approve Contract Demands on the Contract Board or District Contract Board as necessary or requisitions as applicable for local purchase of—

(a) Victualling Stores which are authorized for local purchase and which are required to replenish authorized Yard Stocks which will not be exceeded on receipt of stores purchased.

(b) Authorized Victualling Stores for supply to H. M. A. Ships, or Shore Establishments not ordinarily kept in stock.

(ii) To approve of Requisitions for minor items of stores not ordinarily kept in stock, and not exceeding £5 in value in each case, required for specific Yard Services.

(iii) To approve of Requisitions for all Services in connexion with Victualling Stores not exceeding £20 for any particular service in respect of any one shipment.

(5) The Deputy Armament Supply Officer, Sydney, is authorized—

To approve of Contract Demands on the Contract Board or the District Contract Board, or requisitions for the local purchase of stores up to £10 in any one order and not exceeding £50 in any one month.

Captain Superintendent of Training.

(6) Captain Superintendent of Training, Flinders Naval Depôt, is authorized—

(i) To approve of demands upon Naval Store Depôts for Stores allowed by Establishment.

(ii) To approve of Contract Demands or requisitions as applicable for the local purchase of stores (other than Victualling Stores) authorized for local purchase and in accordance with Establishment.

(iii) To approve of expenditure, other than for Stores, not exceeding £25 in any one case under Contingencies.

(iv) To approve of the employment of casual labour (non-clerical), but no person is to be employed under this authority for any longer time than an aggregate period of six (6) weeks in any financial year without the approval of the Naval Board.

(v) To approve of purchase under established procedure of authorized fresh provisions required for victualling sea-going personnel of H. M. A. S. Cerberus and Tenders.

(vi) To requisition on the Works and Railways Department for Repair and Maintenance in connexion with Flinders Naval Depôt, not exceeding £50 in any one case.

Commanding Officer, Naval College.

(7) Commanding Officer, Royal Australian Naval College, is authorized—

(i) To approve of demands upon Naval Store Depôts for Stores allowed by Establishment.

(ii) To approve of requisitions as applicable for the local purchase of Stores (other than Victualling Stores) authorized for local purchase and in accordance with Establishment.

(iii) To approve of expenditure, other than for Stores, not exceeding £25 in any one case, under Contingencies.

(iv) To approve of the employment of casual labour (non-clerical), but no person is to be employed under this authority for any longer time than an aggregate period of six (6) weeks in any financial year without the approval of the Naval Board.


(v) To approve of purchase under established procedure of authorized fresh provisions required for victualling sea-going personnel of H.M.A.S. Franklin and Tenders.

(vi) To requisition on the Works and Railways Department for Repair and Maintenance in connexion with R. A. N. College, not exceeding £25 in any one case.

Commanding officer, Boys Training Ship.

(8) Commanding Officer, H.M.A.S. Tingira, is authorized—

(i) To approve of demands upon Naval Store Depôts for Stores allowed by Establishment.

(ii) To approve of expenditure, other than for Stores, not exceeding £25 in any one case, under Contingencies.

(iii) To approve of purchase under established procedure of authorized fresh provisions required for victualling sea-going personnel of H.M.A.S. Tingira.

District Naval Officers.

(9) District Naval Officers are authorized—

(i) To approve of demands upon Naval Store Depôts for Stores allowed by Establishment.

(ii) To approve of Contract Demands or requisitions as applicable for local purchases of other stores and for such stores allowed by Establishment, the local purchase of which may be authorized by the Naval Board.

(iii) To approve of expenditure, other than for Stores, not exceeding £25 in any one case, under Contingencies, in connexion with the R.A.N. Reserve, expenditure incurred by District Naval Officer acting as Local Representative of the Naval Board or Naval Intelligence Officer, care and maintenance of ships and craft under his orders, recruiting for the R.A.N.

(iv) To approve, in emergent cases, of expenditure in anticipation of superior authority.

(v) To requisition on the Works and Railways Department for Repairs and Maintenance in connexion with Buildings under their control not exceeding £25 in any one case.

Naval Representative, London.

(10) Naval Representative, London, is authorized—

(i) To engage, at ruling rates of pay, temporary clerks, draughtsmen, or typists, for such limited periods as may be necessary, and to renew such appointments from time to time as requisite, provided that total period shall not exceed six (6) months without special Naval Board approval. The approval of the Naval Board is to be obtained for all increases beyond ruling rates of pay. Report of the engagement of any temporary clerk, draughtsman, or typist under this authority shall be made forthwith to the Naval Board.

(ii) To approve of demands on the High Commissioner for Stationery and incidentals not exceeding £5 in any one demand, or £25 in any one month. This limit may be exceeded in emergent cases, but covering approval of the Naval Board shall be sought at the earliest possible moment.

(iii) To approve of expenditure under Contingencies (e.g., Rail Fares, Postages, Cablegrams, &c.), not exceeding £10 in any one case. This limit may be exceeded in emergent cases and in regard to travelling expenses and rail fares and freights, but the covering approval of the Naval Board shall be sought at the earliest possible moment.


(iv) To approve of payments under Regulations to sea-going personnel borne on books of London Naval Depôt for pay.

Limits for District Naval Officers.

(11) The expenditure to be authorized by District Naval Officers under clauses (ii) and (iii) of sub-regulation (9) must not exceed in the aggregate the following amounts per month in the respective States without the approval of the Naval Board:—

Delegated authorities—Conditions.

163. The authorities delegated in regulations 161 and 162 are subject to compliance with the following provisions, except where otherwise specifically stated:—

(i) That provision made on Estimates will not be exceeded, and the requirements for the remaining period of the financial year will not involve the necessity for applying for additional prevision on any Vote concerned.

(ii) That, except in regard to the Naval Representative in London, certificate has been inserted by the local Certifying Officer that funds are available under his control, or by the Director of Navy Accounts that funds can be made available.

(iii) That the expenditure does not involve any alteration in existing rules or practice.

(iv) That there is nothing irregular in the character of the expenditure.

(v) That the expenditure is not an allowance or payment to any member of the Department except such as is governed by regulations and does not require superior approval.

Naval Works—Performance by Naval Ratings.

164. (1) Each Officer-in-Charge is authorized to carry out the following Naval Works by Naval ratings and employees under Naval supervision:—

(i) Jobbing and urgent minor repairs estimated to cost £2 or less.

(ii) Urgent repairs prescribed in Public Works Regulation 56.

(iii) Maintenance of Stations, Switchboard and Wiring, and other plant in generating stations installed by the Naval Authorities.

(iv) Such works of repairs and maintenance estimated to cost more than £2 as may be delegated specifically by the Minister for Works and Railways:

Provided that works set forth in paragraphs (i), (ii), and (iii) only of sub-regulation (1) shall be carried out at Naval Staff Offices under the supervision of District Naval Officers and Sub-District Naval Officers.

(2) The cost of the works shall be recoverable from the Department of Works and Railways, except that works executed by the Naval authorities as at paragraph (iii) of sub-regulation (1) shall be maintained from Naval Votes.

(3) The above authorities shall be subject to such conditions as may be approved by the Naval Board.
