Overview

Statutory Rules 1957 No. 68, the Regulations under the Naval Defence Act 1910-1952, was enacted to amend the Naval Financial Regulations. The enacting body was the Governor-General in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council. This legislative instrument aims to address specific financial allowances within the naval service, enhancing the provisions for certain categories of personnel and married members living in isolated districts. The regulations were designed to ensure appropriate financial support for naval personnel, reflecting changes in service roles and family circumstances. The primary policy objective is to provide clarity and adjust the allowances for certain ranks and situations within the naval service, ensuring that the financial support aligns with current service requirements and the living conditions of naval families. By amending the existing Naval Financial Regulations, these statutory rules seek to address gaps and ensure that the financial provisions for naval personnel are fair and reflective of their specific roles and living circumstances.

Scope and Application

The Statutory Rules 1957, No. 68, which are regulations made under the Naval Defence Act 1910-1952, apply to specific allowances within the Naval Financial Regulations. The regulations are designed to amend the existing rules to adjust the Navigator’s Yeoman allowance and introduce a new provision for district allowance. The amended regulations apply to particular categories of naval personnel, specifically targeting Ordinary Seaman (R.P.3), Naval Airman I (Met. 3), and Naval Airman II (Met. 3) for the Navigator’s Yeoman allowance, and married members eligible for district allowance who have their spouses employed in isolated districts by the Commonwealth or a Commonwealth authority. These regulations are applicable across the Commonwealth of Australia, reflecting the national scope of the Naval Defence Act. There are no stated exclusions or exemptions in these regulations, and they extend the application of the Naval Financial Regulations to cover the specified changes, effective from 3 July 1957.

Key Provisions

The main operative sections of these regulations pertain to amendments of the Naval Financial Regulations, specifically concerning the Navigator’s Yeoman allowance and district allowance. Regulation 64 is amended to expand the categories of personnel eligible for the Navigator’s Yeoman allowance, now including an Ordinary Seaman (R.P.3), a Naval Airman I (Met. 3), and a Naval Airman II (Met. 3). This change broadens the scope of those who may receive the allowance, reflecting a shift in eligibility criteria. Regulation 107 is amended to adjust the district allowance for married members who live out and whose wives are employed in an isolated district by the Commonwealth or a Commonwealth authority. Under this amendment, the district allowance for these married members is set at the rate applicable to a member who is not married. These regulations impose specific obligations and requirements on the parties they govern. For the Navigator’s Yeoman allowance, eligible personnel must now meet the updated criteria, which includes the addition of Naval Airman I (Met. 3) and Naval Airman II (Met. 3) to the list of eligible categories. This necessitates a review of personnel records to ensure accurate classification and payment of allowances. For the district allowance, the regulations require that married members living out and whose spouses are employed in an isolated district by the Commonwealth receive the allowance at the rate applicable to non-married members. This adjustment affects the calculation and payment processes for these members. In terms of breaches and consequences, the regulations do not explicitly detail offences, penalties, or civil/criminal consequences for non-compliance. However, the omission of certain personnel from the updated Navigator’s Yeoman allowance list or incorrect calculation of district allowances could result in financial discrepancies or legal challenges. Non-compliance with these financial regulations could potentially lead to administrative reviews or financial audits, with corrective actions taken to rectify any inaccuracies in allowance payments.
