Overview

Statutory Rules 1938, No. 116, issued under the Defence Act 1903-1934 and the Naval Defence Act 1910-1934, was enacted to address the need for amendments to the Naval Financial Regulations. The Governor-General, acting on the advice of the Federal Executive Council, introduced these regulations to modify the financial regulations for members of the naval forces, ensuring they are aligned with contemporary requirements. The policy objective of these regulations is to provide clarity and adjustments to the payment of allowances, deferred pay, and other financial considerations for naval personnel, ensuring that the regulations are both fair and reflective of the current operational and administrative needs.

Scope and Application

The Statutory Rules 1938, No. 116, made under the Defence Act 1903-1934 and the Naval Defence Act 1910-1934, pertain to the amendment of the Naval Financial Regulations. This legislative instrument applies to members of the naval forces, including midshipmen, sub-lieutenants, and ratings, and governs their financial entitlements such as Active Pay, Deferred Pay, and various allowances. The regulations specifically address the non-payment of these financial benefits during periods of imprisonment, detention, or confinement in cells, as well as when a member is convicted of an offence by a civil court and is serving a term of imprisonment. The instrument also specifies conditions under which Kit Upkeep Allowance may be credited to a rating undergoing detention. The regulations are applicable within the national jurisdiction of Australia and are enforced by the Naval Board as per the Defence Act and Naval Defence Act. There are no exclusions or exemptions explicitly stated in the regulations, but certain conditions dictate when pay reductions are not applicable, such as during the initial treatment period for venereal disease or when infection occurs accidentally in the course of duty.

Key Provisions

The key provisions of these regulations under the Defence Act 1903-1934 and the Naval Defence Act 1910-1934 introduce several amendments to the Naval Financial Regulations. Regulation 28a (1) states that members of the naval forces will not receive Active Pay, Deferred Pay, or allowances during periods of imprisonment, detention, or confinement, or when convicted of an offence by a civil court and awarded a term of imprisonment. Sub-regulation (2) allows for an exception, permitting ratings undergoing detention to be credited with Kit Upkeep Allowance. Regulation 34 is amended by omitting sub-regulation (2). Regulation 51 (7) is amended to ensure that full Deferred Pay is credited for each day for which Active Pay is payable, except as otherwise prescribed. Regulation 56 is repealed, and Regulation 72 (3) is amended to specify that Kit Upkeep Allowance at the rate of 6d. per diem will be paid to ratings of the Auxiliary Services, except during periods of sick leave granted without pay. Regulation 74 (7) and (8) are amended to prohibit Deferred Pay credit during periods on the half pay list and to ensure full Deferred Pay credit for each day Active Pay is payable, except as otherwise prescribed. Regulation 127 introduces a new regulation on the reduction of pay for members suffering from venereal disease, with specific scales and exceptions. These regulations impose various obligations and requirements on the parties governed by them. Members of the naval forces must adhere to the conditions outlined in Regulation 28a for the suspension of pay and allowances during periods of imprisonment, detention, or confinement, and when convicted by a civil court. The amendment to Regulation 34 removes certain provisions that may have been previously in effect, while the amendment to Regulation 51 ensures that Deferred Pay is credited appropriately. The amendment to Regulation 72 specifies the payment of Kit Upkeep Allowance to ratings of the Auxiliary Services, with exceptions for sick leave granted without pay. The amendment to Regulation 74 prohibits Deferred Pay credit during periods on the half pay list and ensures full Deferred Pay credit for each day Active Pay is payable, except as otherwise prescribed. Regulation 127 imposes a requirement to reduce pay for members suffering from venereal disease according to a specific scale, with certain exceptions. The regulations also outline potential offences and penalties for breaches. While specific penalties are not detailed within the provided text, breaches of these financial regulations could potentially lead to disciplinary actions, financial penalties, or other consequences as prescribed by the overarching Defence Act 1903-1934 and the Naval Defence Act 1910-1934. The maximum penalties for such breaches would be determined according to the severity of the offence and the specific provisions of the Defence Act and the Naval Defence Act.
