Overview
Statutory Rules 1938, No. 66, the Regulations under the Naval Defence Act 1910-1934, were enacted to refine and adjust various financial allowances for naval personnel, ensuring their compensation aligns with current economic conditions and service requirements. This legislative instrument was introduced to address the need for regular updates to financial provisions within the Naval Financial Regulations, thereby maintaining the operational efficiency and morale of the naval force. Enacted by the Administrator of the Government of the Commonwealth of Australia, acting on the advice of the Federal Executive Council, the regulations specifically aimed to amend the victualling, messing, leave, and provision allowances to reflect minor adjustments in financial support for naval officers and crew.
The enacting body, the Federal Executive Council, undertook this action to ensure the Naval Defence Act 1910-1934 remains effective and relevant, with a policy objective of providing necessary adjustments to the financial regulations without disrupting ongoing naval operations. These amendments were designed to be practical and to provide immediate effect, reflecting a commitment to maintaining the integrity and functionality of the naval defence framework.
Scope and Application
The Statutory Rules 1938 No. 66, which are regulations made under the Naval Defence Act 1910-1934, apply to personnel within the Australian Naval Defence Force, specifically targeting the financial allowances and provisions for naval officers. These regulations impact both individuals and the broader operational financial framework of the Navy, thereby ensuring that financial support mechanisms are aligned with the evolving economic conditions of the time. The scope of these regulations is confined to the Commonwealth level, reflecting the national jurisdiction of the Australian government over naval defence matters. These regulations do not explicitly state exclusions or exemptions, implying a general applicability to all eligible personnel within the Navy. Additionally, the regulations are subject to further refinement and extension through subordinate instruments, ensuring that they can be adapted to meet changing requirements or circumstances within the naval service.
Key Provisions
The Regulations under the Naval Defence Act 1910-1934, enacted on 29 June 1938, make specific amendments to the Naval Financial Regulations. These amendments primarily adjust monetary allowances for naval personnel. Regulation 76 now adjusts the Victualling Allowance by increasing it from 1s. 6d. to 1s. 7d. (section 2). Similarly, Regulation 78 modifies the Messing Allowance, increasing it from 8d. to 8½d. (section 3). Regulation 79 modifies the Leave Allowance, increasing it from 2/7 to 2/9 (section 4). Lastly, Regulation 80 increases the Provision Allowance from 2s. 7d. to 2s. 9d. (section 5). These Regulations came into effect on 1 July 1938.
These Regulations impose certain financial obligations on the naval authorities and personnel. Specifically, they require the payment of updated allowances as per the amended Regulations. The authorities must ensure that the correct amounts, as specified in the Regulations, are disbursed to the naval personnel for their victualling, messing, leave, and provision needs. These financial obligations are necessary to maintain the welfare and operational efficiency of the naval service, as outlined in the amended Naval Financial Regulations.
The Regulations do not explicitly outline any specific offences, penalties, or civil or criminal consequences for non-compliance with the amendments. However, the amendments are made under the authority of the Naval Defence Act 1910-1934, and non-compliance with any regulations under this Act could potentially result in legal repercussions. It is expected that the naval authorities adhere strictly to these updated financial provisions to avoid any adverse consequences that might arise from non-compliance.
