Overview

Statutory Rules 1940, No. 254, made under the Defence Act 1903-1939 and the Naval Defence Act 1910-1934, were enacted to amend the Naval Financial Regulations. This legislative instrument, issued by the Governor-General in accordance with the advice of the Federal Executive Council, addresses specific financial and administrative needs within the naval sector, ensuring updated and appropriate remuneration and allowances for personnel. The policy objective of these regulations is to provide precise and fair compensation structures, reflecting the evolving requirements of naval operations and personnel roles during a period of heightened military activity. These amendments aim to maintain morale and efficiency by addressing discrepancies in existing allowances and pay rates.

Scope and Application

The Statutory Rules 1940, No. 254, made under the Defence Act 1903-1939 and the Naval Defence Act 1910-1934, pertain to the amendment of the Naval Financial Regulations, which apply to personnel within the Royal Australian Navy. The regulations affect various aspects of financial allowances and benefits for naval officers and ratings, including active pay, turret kit allowance, outfit gratuities, special allowances, victualling allowance, messing allowance, leave allowance, and provision allowance. These amendments apply nationally within the Commonwealth of Australia, ensuring uniformity in the financial entitlements across the navy. The regulations do not explicitly state any exclusions or exemptions, but their application is subject to the approval of the Naval Board for certain allowances. Additionally, the regulations provide for adjustments of payments for certain allowances retroactively from October 1, 1940, to the date the regulations came into effect.

Key Provisions

The regulations primarily revise various allowances and payments outlined in the Naval Financial Regulations under the Defence Act 1903-1939 and the Naval Defence Act 1910-1934. For instance, Regulation 23a of the Naval Financial Regulations sees amendments in the pay rates for Chief Mechanicians, Chief Engine Room Artificers, Chief Electrical Artificers, Chief Ordnance Artificers, and Chief Shipwrights, based on years of service (Regulation 1). A new allowance for a turret kit, subject to Naval Board approval, is introduced for ratings employed in oil-operated gun turrets (Regulation 2). Additionally, the regulations adjust outfit gratuities for different classes of uniforms and special allowances for writers and supply ratings (Regulations 3 and 4). The regulations impose specific obligations on the parties governed by them, particularly the Naval Board and the personnel involved in the specified roles. The Naval Board must approve turret kit allowances for eligible ratings (Regulation 2). Personnel must ensure they meet the criteria for the new pay rates and allowances, and they must apply for any adjustments due to changes in rates from prior periods (Regulation 9). The regulations also require accurate record-keeping and reporting of allowances and payments to ensure compliance and proper financial management within the naval forces. For breaches of the regulations, particularly if they involve fraudulent claims or intentional non-compliance, the consequences can be severe. While specific offences and penalties are not detailed within the text, under the Defence Act 1903-1939 and the Naval Defence Act 1910-1934, breaches of financial regulations can lead to disciplinary actions, fines, or other penalties as determined by the appropriate authorities. The severity of penalties would depend on the nature and extent of the breach, potentially leading to criminal charges in cases of serious misconduct or fraud.
