Overview

The Statutory Rules 1939, No. 71, Regulations under the Defence Act 1903-1939 and the Naval Defence Act 1910-1934, were enacted by the Governor-General in Council, providing amendments to the Naval Financial Regulations. This legislative instrument addresses the need to update financial allowances and gratuities for personnel within the naval forces to align with the evolving roles and responsibilities of naval officers and warrant officers. The policy objective is to ensure that the financial compensation for naval personnel is fair and reflective of their duties and ranks, thereby maintaining morale and efficiency within the naval service. The Regulations were made to bring certain financial provisions up to date and to address specific allowances for officers performing dual duties, as well as to adjust rates of active pay for auxiliary services.

Scope and Application

This statutory instrument pertains to the Defence Act 1903-1939 and the Naval Defence Act 1910-1934, and it applies to the amendment of existing financial regulations within the Australian Defence Force, specifically within the naval division. The scope of this regulation includes adjustments to financial entitlements for various ranks of naval officers, such as outfit gratuities, allowances, and special allowances. It also impacts the rates of active pay for certain auxiliary services within the naval force. The regulations are designed to update and refine the financial structures and benefits offered to personnel within the naval sector, ensuring that the compensation aligns with their roles and responsibilities. This legislation applies nationally as it is issued under Commonwealth authority, and it does not explicitly state exclusions or thresholds, implying that the changes are broadly applicable within the stipulated ranks and roles.

Key Provisions

The Statutory Rules 1939 No. 71, made under the Defence Act 1903-1939 and the Naval Defence Act 1910-1934, introduce several amendments to the Naval Financial Regulations (regulations 30, 45, 46, 48, and 64). For example, Regulation 30 (paragraph 1) modifies the outfit gratuities for seagoing officers, removing the previous gratuity for an Acting Warrant Officer (excluding Schoolmaster Branch) and introducing new rates for Acting Warrant Officers and Warrant Officers. Regulation 45 (paragraph 2) introduces new allowances for specific officers performing dual roles, while Regulation 46 (paragraph 3) revises the rates for Warrant Officers and Commissioned Officers from Warrant rank. Regulation 48 (paragraph 4) adjusts special allowances for various ranks involved in submarine detection duties, and Regulation 64 (paragraph 5) includes the Director of Naval Reserves and Naval Reserves Mobilization in the active pay scale. These regulations impose specific financial obligations on the naval officers and warrant officers affected by the amendments, ensuring they receive appropriate allowances and gratuities based on their roles and ranks. They also require the Naval Board's approval for certain payments, such as those outlined in Regulation 45 (paragraph 2). The regulations do not explicitly state any offences, penalties, or civil/criminal consequences for non-compliance with the financial provisions. However, given the formal nature of statutory regulations, non-compliance could potentially lead to disciplinary actions or other administrative consequences under the Defence Act 1903-1939 and the Naval Defence Act 1910-1934. The precise penalties would depend on the specific circumstances and applicable laws governing the Defence Force.
