Overview

Statutory Rules 1929, No. 64, are Regulations under the Naval Defence Act 1910-1918, enacted by the Governor-General on advice from the Federal Executive Council. This legislative instrument was introduced to amend existing naval financial regulations, specifically addressing matters related to the payment rates for various naval personnel, including ratings under training, yeoman of stores, and deferred pay for both officers and enlisted personnel. The aim of these regulations is to ensure that the financial provisions for naval personnel are updated and reflect current conditions, thereby maintaining the efficiency and readiness of the naval force. These regulations are designed to come into operation immediately unless otherwise specified within the document.

Scope and Application

The Regulations under the Naval Defence Act 1910-1918 apply to personnel within the naval forces of Australia, including both commissioned and non-commissioned officers, as well as other ratings not specifically mentioned in the regulations. The scope of these regulations includes amendments to the Naval Financial Regulations, affecting various ranks and roles within the naval hierarchy, such as ratings under training, yeoman of stores, and naval dockyard police. The amendments adjust the pay scales, increments, and deferred pay rates for these roles, with specific provisions for different ranks and conditions of service. These regulations have a national jurisdictional reach, applying across the Commonwealth of Australia, as they are enacted under federal authority. The regulations provide specific amendments to the existing financial regulations without introducing new overarching provisions or exclusions, thus directly impacting the financial conditions of naval personnel.

Key Provisions

The main operative sections of these regulations under the Naval Defence Act 1910-1918 include several amendments to the existing Naval Financial Regulations. Firstly, Regulation 48 is amended by adding new categories of ratings under sub-regulation (55)(c) and by changing sub-regulation (65) to adjust the rates for Yeoman of Stores (paragraph 1). Secondly, Regulation 64 is altered to modify the scale of rates of pay for Naval Dockyard Police, introducing new increments and long service bonuses (paragraph 2). Thirdly, Regulation 72 is updated to remove the mention of Senior Constable from sub-regulation (5) (paragraph 3). Lastly, Regulation 74 is revised to provide new daily rates for Deferred Pay for various ratings and officers (paragraph 4). These regulations impose specific financial obligations on the parties governed by them, primarily concerning the pay and increments for naval personnel. The changes introduced affect both enlisted personnel and officers, including their base pay, increments, and deferred pay rates. The regulations also address the pay scale for Naval Dockyard Police, which is now adjusted to include various annual and biennial increments as well as long service bonuses. These amendments aim to ensure that all personnel receive fair and updated remuneration according to their rank and service duration. The consequences of breaching these regulations are not explicitly stated within the text of the legislation. However, as these regulations are made under the authority of the Naval Defence Act 1910-1918, any failure to comply with them could potentially lead to disciplinary action, fines, or other penalties as prescribed under the broader Act. The specific penalties would depend on the nature and severity of the breach, and the applicable laws at the time of the offence.
