Overview

The Statutory Rules 1936 No. 70, enacted under the Naval Defence Act 1910-1934, was introduced to amend the Naval Financial Regulations, addressing the need for adjustments to naval personnel's pay rates and allowances in response to the economic conditions of the time, specifically aligning with the Financial Emergency Act 1931-1935. The regulations were made by the Governor-General in Council, under the authority of the Federal Executive Council, with the intent to ensure that the financial provisions governing the pay and allowances of naval officers and personnel were consistent with the prevailing financial constraints and adjustments mandated by the Financial Emergency Act. These amendments aimed to provide a structured approach to managing naval financial resources during a period of economic difficulty, ensuring the financial stability of naval operations while maintaining the operational effectiveness of the naval force.

Scope and Application

The Naval Defence Act 1910-1934, through the Regulations made under it, applies to officers and personnel within the Naval Forces of the Commonwealth of Australia. The Act affects those who are serving in various ranks within the naval services, including officers from the Schoolmaster Branch, petty officers, warrant officers, and men. It governs the pay rates, allowances, and increments for these personnel, and also covers the marriage allowance and entertaining allowances for officers. The rates of pay and allowances are subject to adjustments under the Financial Emergency Act 1931-1935. The regulations also address the conditions for increments of pay and the rates applicable to officers and other personnel in the Auxiliary Services. The application of these regulations is nationwide, as they are established under Commonwealth law. The regulations do not specify any exclusions or exemptions but are subject to further determinations by the Naval Board regarding conditions and approvals for increments of pay. The scope of the Act can be further extended or restricted through subordinate instruments made by the Naval Board under the authority provided by these regulations.

Key Provisions

The main operative sections of the Naval Financial Regulations (1936) amend several provisions concerning the rates of pay, allowances, and conditions of service for officers and personnel in the Naval Defence Act 1910-1934. Specifically, section 1 allows for adjustments in the rates of pay, fees, or allowances under the Financial Emergency Act 1931-1935, ensuring that they can be altered in line with broader financial policies. Section 2 replaces the existing regulation 22 to establish new daily rates of active pay for officers serving in the Schoolmaster Branch, with incremental increases based on service duration (section 2). Section 3 modifies regulation 25 to include prior service in approved civil hospitals towards the three-year period required for increment as a Surgeon Lieutenant. Section 4 replaces regulation 41, detailing new scales for marriage allowances based on rank, seniority, and family composition. Section 5 amends regulation 45 to refine allowances for entertaining officers, while section 6 modifies regulation 51, sub-regulation (9), to adjust deferred pay provisions. Section 7 replaces regulation 64, setting consolidated rates of active pay for various ranks and positions within the Naval Forces, with specific increments outlined in sub-regulations (section 7). These regulations impose several obligations and requirements on the parties governed by them. Officers and personnel must adhere to the specified rates of pay, allowances, and conditions of service as detailed in the regulations. The Naval Board has the authority to determine conditions for marriage allowances and to approve increments of pay, ensuring that all financial adjustments comply with the regulations. Personnel must also comply with the conditions set for deferred pay and increments, which are subject to Naval Board approval. Additionally, the regulations require that certain prior service, such as time spent in approved civil hospitals, be counted towards qualifying for pay increments. Violations of these regulations can result in various consequences. While specific offences and penalties are not detailed in the provided text, breaches of financial regulations generally could lead to disciplinary actions, financial penalties, or other administrative consequences as determined by the Naval Board. The regulations emphasize that increments of pay are subject to the approval of the Naval Board, indicating that failure to meet these conditions could result in the denial of pay increments. Furthermore, adherence to the conditions of service and financial allowances is crucial to avoid any financial or administrative repercussions.
