REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1952.*

WHEREAS, by sub-section (4.) of section forty-one of the Naval Defence, Act 1910-1952, it is provided that the fixing of rates of salary for persons employed in a civil capacity in pursuance of that section, other than rates fixed by an industrial award, order, determination or agreement shall be subject to the approval of the Public Service Board:

And whereas the rates of salary specified in the following Regulations have been approved by the Public Service Board:

Now therefore, I, the Governor-General in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910-1952.

Rates of pay.

1. Regulation 43 of the Naval Establishments Regulations is amended—

(a) by omitting sub-regulation (1.) and inserting in its stead the following sub-regulation :—

“ (1.) Subject to this regulation, an officer or employee occupying a position the designation of which is specified in the table in this sub-regulation shall be paid—

(a) at the rate of annual salary or salary within the limits of the rates of annual salary, as the case may be, specified in the table opposite to that designation ; or

(b) where a rate of annual salary according to age is specified opposite to a designation of the position and an officer or employee occupying that position is of an age, so specified—the rate of annual salary specified in the table in relation to the age of the officer or employee.

(b) by omitting from sub-regulation (2.) the words “ Foreman (Laboratory), Grade ‘ A ’, ‘B’ or ‘ C ’, Foreman (Storehouse), Grade ‘ A ’, ‘ B ’ or ‘ C ’ ” and inserting in their stead the words “Foreman (Storehouse and Laboratory), Grade ‘ A ’, ‘ B ’ or ‘ C ’ ” ; and

(c) by omitting from sub-regulation (7.) the words and figures “ £402 per annum ” and inserting in their stead the words and figures “ £764 per annum ”.

2. Regulation 44 of the Naval Establishments Regulations is repealed and the following regulation inserted in its stead :—

Variations of salary on account of variations in cost of living.

“ 44.—(1.) For the purposes of this regulation ‘ index number ’ means the weighted average retail price index number for the six State capital cities of the Commonwealth as shown in the ‘ Court ’ index (Third Series) of retail price index numbers published from time to time by, or at the direction of, the Commonwealth Court of Conciliation and Arbitration.

“ (2.) Where the index number for the three months ended on the thirty-first day of March, the thirtieth day of June, the thirtieth day of September or the thirty-first day of December, in any year is less than 159.9, the salary payable to an officer or employee shall, as from the commencement of the first fortnightly pay period beginning in the next succeeding month of May, August, November or February (as the case may be), be decreased by—

(a) an amount of Six pounds per annum in the case of a male officer or employee who has attained the age of twenty-one years ;

(b) alternate amounts of Four pounds per annum and Five pounds per annum in the case of a female officer or employee who has attained the age of twenty-one years ;

(c) an amount of Four pounds per annum in the case of an officer or employee who has attained the age of nineteen years but has not attained the age of twenty-one years ; or

(d) an amount of Three pounds per annum in the case of an officer or employee who has not attained the age of nineteen years,

for each 2.3 points by which that index number is less than 162.1.

“ (3.) Where the index number for the three months ending on the thirty-first day of March, the thirtieth day of June, the thirtieth day of September or the thirty-first day of December in any year exceeds 162.1, the salary payable to an officer or employee shall, as from the commencement of the first fortnightly pay period beginning in the next succeeding month of May, August, November or February (as the case may be), be increased by—

(a) an amount of Six pounds per annum in the case of a male officer or employee who has attained the age of twenty-one years ;

(b) alternate amounts of Five pounds per annum and Four pounds per annum in the case of a female officer or employee who has attained the age of twenty-one years ;

(c) an amount of Four pounds per annum in the case of an officer or employee who has attained the age of nineteen years but has not attained the age of twenty-one years ; or

(d) an amount of Three pounds per annum in the case of an officer or employee who has not attained the age of nineteen years,

for each 2.3 points by which that index number exceeds 159.9.

“ (4.) Notwithstanding anything contained in this regulation, the salary of an officer or employee who has not attained the age of twenty-one years shall be varied as if that officer had attained that age if he occupies a position for which the rate of salary payable to an officer or employee under the age of twenty-one years is not prescribed.”.
